2 WHEREAS, the City of Saint has undertaken a study of the White Bear Avenue Area
3 which will result in the adoption of a small area plan smumary for the White Bear Avenue Area
4 into the City's comprehensive plan; and

WHEREAS, the said study may lead to the adoption of amendments to the City's
comprehensive municipal plan and to its official zoning controls within the White Bear Avenue
Area; and
WHEREAS, development within the White Bear Avenue Area during the study could
result in land uses which would not be consistent with the on-going goals and requirements of
the 19991and use plan or comprehensive plan; and
WHEREAS, the potential for incompatible or inconsistent development within the White
Bear Avenue Study Area raises substantial questions relating to the ability of the City's present
official controls to provide compliance with the comprehensive plan; and

18 WHEREAS, in light of the pending White Bear Avenue Area study, for the purpose of
19 identifying an overall vision for this pivotal azea and for the immediate need to preserve the
20 status quo with respect to land use and to protect the generai health, welfare and safety of the
21 public pending the conclusion of the said study, the Council of the City of Saint Paul desires to
22 immediately temporarily prohibit development on any parcel of 1and or part thereof within the
23 areas of the White Bear Avenue Study Area until such time as the aforementioned shxdy has been
24 completed and the Council of the City of Saint Paul has taken action on the recommendations
25 contained therein:

NOW, THEREFORE, BE IT RESOLVED, that under separate ordinance, the Council of
the City of Saint Paul will prohibit on any parcel of land or part thereof within the areas of the
White Bear Avenue Study Area, the issuance or approval of zoning and building pemuts, plat
approvals or lot splits, until the expiration of twelve months as pmvided in Minn. Stat. §
462.355, Subd.(4), or until such earlier time as the Council of the City of Saint Paul has taken
action on the recommendations contained in the study; AND,
BE IT FURTHER RESOLVED, that pending the adoption of the interim ordinance
prohibiting any development inconsistent with the pending study and any amendments to the
City's zoning code within the boundaries of the described areas, no zoning or building permits,
plat approvals or lot spiits may be issued or approved, unless exempted as provided under the
terms set forth in Section Three of that same separate ordinance noted above, from this date and
until the expiration of twelve months as allowed by Minn. Stat. § 462355, Subd.(4), or until such
earlier time as the Council of the City of Saint Paul has taken action on the recommendations O0 -�O'4l
contained in the study; AND
BE IT FTNALLY RESOLVED, that the resh contained in this resolurion and in the
said interim ordinance may be extended by action of the Council of the City of Saint Paul for
those additional time periods not to exceed the time provided in Minn. Stat. § 462355, Subd. (4)
in the event such study and recouunendations and the deliberations of the Council requires such
extensions of time.
