Yes No �l� Yes X No Insurance Attached: (SEE REVERSE SIDE FOR INSTRUCTIONS) Revised 12/84 _ , ��� ��!�`v LEASE AGREEMENT THiS AGREEMENT , made and entered into this day of , 1985 by and betwPen the CITY OF SAINT PAUL, MINNESOTA, hereinafter referred to as "City" and INDEPEIVDENT SCHOOL DISTRICT N0 . 625 , hereinafter referred to as "District , " for the lease of portions of the City' s Valley recreation Center , 690 Jackson Street , Saint Paul , i�innesota, hereinafter referred to as "Facility" WITNESSETH; IT IS MUTUALLY AGREED BY AND BETWEEN THE CITY AND DISTRICT AS FOLLOWS: 1 . That the City hereby leases to the District the following areas for the District ' s "Education and Physical Education" program: a. gYmnasium � ,, _. b. lounge c. skating room d . outside field area 2 . That the City also hereby leases to the Distriet the use of the kitchen located in the Facility upon twenty-four (24 ) hours prior notice directed by the District to the City' s Superintendent of Parks and Recreation. 3 . If additional hours of use are needed for any part of the City' s building or grounds , a written notice must be given seven (?) days prior to such need by the School Principal with both parties mutually agreeing to the change in hours. 4 . That the City will provide for all custodial , heat , water , and electrical services to the Facility, including the area subject to this lease during the term heceQf. . ���is�D 5 . The District ' s Building principal or his designee shall provide full time supervisian far all school programs at all times . Said Building ^rincipal or • his designee shall b? responsible for surveying tne condition of the building and ou�side area each day prior to commencing with the distric� ' s program or programs and shall ider�tify and report to the Recreation Director on a daily basis any and a11 damage to said building, grounds , or equipment whic;� . occurs while said facilit�� is under their control or use . 7 . That the District will at all times retain direct possession of and control of the keys to the Facility, and said keys shall not be loaned or given to any person other than a borfafide District employee or agent . , 8 . All parties shall abide by all such rules and regulations mutually agreed on and established by either party or by governmental regulations current --and future to insure safe , sanitary fire and health - protection to all persons. 9. That any alterations of the leased portions of the Facility shall only be performed with th� prior approval of the City; s Superintendent of Parks an3 Recreation, and said alterations shall then be performed under his direction and control . 10 . That the District will save and hold harmless the . City from any and all claims of whatever kind or nature that may arise out of it , its staff, or students' participation in the District' s programs and events at the Facility and as such claims may be occasioned by the negligent acts or omissions of the District or its staff or agents . 11 . That the term of this lease shall be from Sept. 1 , 1985 to June 10 , 1986 7 :00 a .m, to 3 :30 p.m. , Monday ' through Friday, during the regularly establishe3 school year .
