In the matter of condemning and taking a permanent easement for street
purposes for the Smith Avenue widening on, over and across the following
described lands:
The westerly 2.5 feet of Lots 13 throu�h 21 of Block 17, Lienau's
Rearrangement of Blocks 17 and 18 of Olivier's Addition; and that part of Lots
22 and 23 of said Block 17 lying westerly of a line beginning at the northwes�;
corner of said Lot 23; thence southeasterly to a point on a line 2.5 feet
easterly of and parallel to the west line of said F31ock 17 which is 3�►.5 feet
southerly of the north line of said Lot 23; thence southerly along said
parallel line to the south line of said Lot 22 and there terminating. -
Also all that part of Lots 7 through 13, Block 27, Balme's Addition lying
easterly of a line beginning at the southeast corner of said Lot 7; thence to
a point on the north line of said Lot 13, 2.85 feet westerly of the northeast
corner and there terminating.
Also sub,ject to street the easterly 2.5 feet of Lots 16 through 22, and the
easterly 2.5 feet of the south one-half of Lot 23, Block 27, Balme's Addition.

Also a temporary construction easement as sho�rn on Slop� Plan No. 1001, dated
October 1, 1985, on file in the Valuations and Assessment Division of the City
of St. Paul, said temporary construction easement to expire upon completion of
the pro�ject or on December 31, �989.
A public hearing having been had upon the taking and condemnation of the lands or easements therein, for the
above improvement, and the award of damages therefor, and also upon the assessment of benefits therefor, and the
Council having duly considered the same, now therefore be it
RESOLVED, That the taking and condemnation of the lands described in the annexed assessment roll, identified
by the signature of the Director of Finance and made a part hereof, and the awards of damages to the owners of such
lands for said taking and condemnation as set forth in said assessment roll, be and the same is hereby in all respects
ratified and confirmed.
RESOLVED FURTHER, That the said assessment of bene�ts, be and the same is hereby in all respects ratified,
and the same is hereby ordered to be submitted to the District Court for confirmation.

Gentlemen:
Please be advised that I object to the award of damages
proposed for the premises commonly known as 533 South Smith
Avenue. The taking not only results in the moving of the
street closer to the residence at 533 South Smith, but will
also result in the loss of two mature trees, one of
approximately eight inches in diameter, and the other a pine
tree approximately fifteen feet tall. I believe that the
compensation for the reduction in the value of the premises
and the loss of the two trees should be $1, 000. 00.
