00-104Council File # Q� - \b� RESOLUTION CITY OF SAINT PAUL, MINNESOTA Presented By Referred to Green Sheet # 7 (ln(17F Committee: Date 1 WHEREAS, the Ciry of St. Paul has sponsored a Softball on Ice for some 20 years 2 and is planning such an event for Febmary 5 and February 6, 2000 at McCarron's Lake, 3 located in the City of Roseville, Ramsey County: and 4 WHEREAS, the Ramsey county SherifFs Office has jurisdiction over the counry's 5 lakes and waters, and has granted permission for the use of McCarron's Lake for such an 6 event with the stipulation that the City of St. Paui indemnify and hold harmelss the 7 County; and 8 WFIEREAS, the Ramsey County Parks & Recreation Department has jurisdiction 9 over the McCarron's Park and adjacent parking tot, and is �villing to permit the use of 10 these areas on the condition that the City of St. Paul indemnify and hold harmless the County; and 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 WHEREAS, the City of Roseville is supportive of this event on the condition that the City of St. Paul indemnify and hold harmless its agents and officers; and WHEREAS, the Saint Paul Ciry Council finds that the Winter Camival Softball on Ice toumament has a legitimate public purpose ; and WT�REAS, the expenditure of public funds, hich includes the promise of indemnification and defense, for such a purpose will facilitate and enable the event to take place; now, therefore, be it FURTHER RESOLVED, that the foregoing defense and indemnification does not cover: 1) any occurrences or events which are not part of the Softball on Ice event and which do not occur or take piace at McCarron's Lake during the course of the event. 2) injuries or damages which arise from hidden traps or conditions existing on the grounds sunounding McCarron's Lake of which Ramsey Counry or the City of Roseville had actual or constructive notice. 3) injuries which arise out of criminal actions, assaults, batteries or other acts of violence committed by any person or persons; and be it 28 FURTHER RESOLVED, that nothing in the foregoing provisions shall be construed as 29 a waiver of the municipal tort liability limits set forth in Minn. The Winter Carnival Softball on Ice tournament is a popular annual event for recreationa� softball players. The event is planned for Saturday, February 5 and Sunday, February 6, 2000 if the City holds Ramsey County and the City of Roseville harmless related to the management of this event. � ADVANTAGESIFAPPFtOVED: The City will be allowed to use McCarron's Lake for this event. We have the opportunity to work cooperatively with local businesses and to bring this popular event back to its original location. With the Municipal Athletics Office at the Rice Street Dome, it seemed like a perfect fit, getting this event back to McCarron's. It has not been on McCarron's '' Lake since about 7 993. DISADVNNTAGESIFAPPftOVED: NONE DISADVANTAGES IF NOT APPftOVED: Over 80 teams have already registered for this event. If we are not abie to host it at McCarron's, these teams will not ' only be disappointed, but have to be refunded. We aiso run the risk of damaging relationships with area businesses and event sponsors.
