THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: Section 1. Pursuant to Council Resolution No. 85-396 of March 19, 1985, the Saint Paul Planning Commission is preparing a plan for Sumnit Avenue from the Cathedral to the Mississippi River which will include guidelines for land use • and transportation, historic preservation, and urban design. The Planning Commission organized a Sumnit Avenue Planning Committee which has been meeting twice a month since May. The new plan is expected to contain zoning text and zoning policy recommendations designed to protect the neighborhood environments and historic architecture along Surr�nit Avenue. Section 2. This ordinance recognizes that the east end of Summit Avenue from Selby Avenue to Dale Street is within the Historic Hill District. Exterior changes in property within the Historic Hill District are subject to design review by the Heritage Preservation Corrrnission. This detailed level of regulatory control is the basis for distinctions between property located east of Dale and property located west of Dale. Pending the completion of the studies and the adoption of necessary amendments to the City's Comprehensive Plan and zoning regulations, not to exceed 120 days from the date of this ordinance, the City Council shall not approve lot splits that create new buildable parcels for property along Sumnit Avenue, nor shall the City Council conduct public hearings on rezoning petitions. Section 4. Pending the completion of the studies and the adoption of necessary amendments to the City' s Comprehensive Plan and zoning regulations, not to exceed 120 days from the date of this ordinance, the Planning Comnission is hereby directed not to approve for property along Summit Avenue any application for a change of nonconforming use permit, a determination of similar use permit, or a special condition use permit except for special condition use permits issued to colleges in accordance with the findings of the College Zoning Task Foree. Furthermore, neither the Planning Commission nor Planning Division staff shall approve any site plans for Summit Avenue west of Dale Street„ unless the site plan application was received prior to the effective date of this ordinance. Section 5. Pending the completion of the studies and adoption of necessary amendments to the City' s Comprehensive Plan and zoning regulations, not to exceed 120 days from the date of this ordinance, the Building Official is hereby directed not to issue any building permits for Summit Avenue west of Dale Street for the following activities: (1) Demolition of principal structures; (2) House moves, either in or out; (3) New construction of principal structures; or (4) Additions to principal structures affecting f acades readily visible from a street. Nor shall the Building Official issue any building permits, except for the correction of life safety code violations, anywhere along Summit Avenue for: (1) Ma,jor repairs on a nonconforming use under zonin unless the ma,jor repairs reduce the property's level of nonconformity; or (2� Parking lots. However, the Building Official may grant building permits that would otherwise be affected by this ordinance if the permit is pursuant to zoning applications filed prior to the effective date of this ordinance. The corr�nittee is concerned that some undesirable developments may slip through before new regulations become effective (just as Milton Square and 0'Gara's Garage did without meeting the new commercial parking requirements that came into effect last February). The comnittee's interest in a moratorium was sparked at the end of July when a house was moved onto Sumnit Avenue at Griggs Street with only a 13-foot sideyard as its setback from Surr�nit Avenue. The proposed moratorium is detailed so that it can block undesirable developments while permitting most building projects, which are desirable, to proceed. A chart attached to the moratorium surranarizes which development activities are delayed by the language of the moratorium and which are not. Projects that are already going through City review processes, such as the executive retreat house at 266 Summit and the proposed William Mitchell parking lot, are not delayed by the moratorium as drafted. The moratorium is proposed to last for five months. The Planning Division staff informs me that the new Surr�nit Avenue Plan cannot be completed by the November 1 target date contained in the Council Resolution, primarily because of unforeseen staff changes that left the Planning Division spread thin. The staff now expects the plan to reach the City Council by next February 15. The proposed moratorium is attached.
