THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: Section 1 . That section 409.06 , subdivision 5, clause 2, be and is here- by amended to read as follows : (2) No outside service area shall be permitted unless the licensee presents with his application for such out- side service area a statement in writing by 90 percent of the owners and tenants of all private residences, dwellings and apartment houses located within 200 feet of the proposed outside service area that they have no objection to such service area. Measurements shall be determined from the property line of the licensed pre- mises to the property line of the residential uses.- , provided, however, that where the licensed premises is located within a shopping mall or shoppin center, that the measurements shall be determined from the nearest corner of the building in which the licensed premises is located to the property line of the resi- dential uses. Section 2. This ordinance shall take effect and be in force thirty days from and after its passage, approval and publication. You also asked that we prepare an amendment to section 409. 16 to allow the License Inspector the right to waive a portion of the 45-day requirements when requested by the District Council . There is no 45-day notice requirement in section 409. 16. However, section 17 .07 .2 of the City Charter in relation to on-sale liquor licenses in liquor patrol limits , provides for a 45 day notice rquirement when requested by the council member representing the involved council district. The waiver of the 45-day period may be accomplished by the council member only, and this may not be changed by means of an ordinance amendment. If y u have any questions, please contact me.
