An Ordinance amending section 409. 06 ,
subdivision 5 of the Saint Paul Le�is-
lative Code pertaining to Intoxicating
Liquor and outside areas of service.
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1 .
That section 409.06 , subdivision 5, clause 2, be and is here-
by amended to read as follows :
(2) No outside service area shall be permitted unless the
licensee presents with his application for such out-
side service area a statement in writing by 90 percent
of the owners and tenants of all private residences,
dwellings and apartment houses located within 200 feet
of the proposed outside service area that they have no
objection to such service area. Measurements shall be
determined from the property line of the licensed pre-
mises to the property line of the residential uses.-
, provided, however, that where the licensed premises
is located within a shopping mall or shoppin center,
that the measurements shall be determined from the
nearest corner of the building in which the licensed
premises is located to the property line of the resi-
dential uses.
Section 2.
This ordinance shall take effect and be in force thirty days
from and after its passage, approval and publication.

premises instead of from the property line where said licenses are located in a shopping

Dear Mr. Carchedi :
Attached is a draft of an ordinance amending section 409.06,
subdivision 5 , clause 2, so as to provide that in case of
petitions for outside patio areas for bars located in shopping
malls or shopping centers , the measurement will be from the
nearest corner of the building in which the bar is located
to the residential property lines.
You also asked that we prepare an amendment to section 409. 16
to allow the License Inspector the right to waive a portion
of the 45-day requirements when requested by the District Council .
There is no 45-day notice requirement in section 409. 16. However,
section 17 .07 .2 of the City Charter in relation to on-sale
liquor licenses in liquor patrol limits , provides for a 45
day notice rquirement when requested by the council member
representing the involved council district. The waiver of
the 45-day period may be accomplished by the council member
only, and this may not be changed by means of an ordinance
amendment.

of possible amendments to the City's Comprehensive Plan and
zo�ing � regulations adopted pursuant to Minnesota Statutes
Section 462.355 Subd. 4. Committee recommends approval with
the following amendments: .
At the end of Section 4 "unless the site plan application was
received prior to the effective date of this ordinance"
should be added.
In Sections 3, 4, and 5., "not to exceed 150 days" should be
amended to "not to exceed 120 days".
