WHEREAS, Lander Group has submitted for City Council approval the attached preliminary and final plat
for subdivision of property on the block bounded by E. Seventh Street, Sibley Street, E. Eighth Street and
Wacouta Street into two lots; and

WHEREAS, the appropriate City departrnents have reviewed the plat and found, subject to the recommended
conditions, that it meets the requirements of Chapter 67 of the Zoning Code; and
WIIEREAS, notice of a public hearing before the City Council was duly published in the official newspaper
of the City and notices were mailed to each owner of affected property including all property situated within
350 feet of the subject property; and
WHEREAS, the City Council held a public hearing on the proposed plat on October 4, 2000, where all
interested parties were given the opportunity to be heard and the Council considered all the facts and
recommendations concerning the plat;
NOW, THEREFORE, BE TI' RESOLVED, that the City Council accepts and approves the attached
preliminary and final plat for Sibley Park Apartments on the block bounded by E. Seventh Street, Sibley
Street, E. Eighth Street and Wacouta Street, subject to the following conditions:
City Council approval of necessary street vacations;

The petirioner sha11 be required to reroute the existing storm sewer and associated structures at
the southeast corner of Eighth and Sibley Streets to the satisfaction of the Saint Paul Sewer
Engineer;
The petitioner shall pay all costs and expenses for the reconstruction of Seventh, Eighth, Sibley
and Wacouta Streets which are necessary due to this project to the satisfacrion of Public Works,
under and ordinance pernut, or as a City contract, including but not limited to the construction
of new curbs, sidewalks,and drainage structures;
The petifioner/property owner shall enter into a liability and maintenance agreement with the
City far the above-standard improvements in the right-of-way and shall be responsibie for the
annual assessment for the above-standard operation and maintenance;

Water easements created with street vacations shall be retained until the property owner pays a
deposit to St. Paul Regional Water Services to cover the actual cost of construction to abandon
the existing water mains in those easements; and
The applicant shall file a copy of the Council Resolution approving the plat with the Ramsey
Counry Recorder's OfFce.
