Presented By Referred o Committee: Date Out of Committee By Date WHEREAS, Irmina �ioefler has submitted the attached proposed lot split for City Council approval ; and WHEREAS, the Departments of Planning and Economic Development and Public Works have reviewed the attached lot split at 1041 Van Buren Avenue, legally described as Lots 15 and 16, Block 1 , University View Addition; and WHEREAS, the Saint Pau1 City Council at a public hearing held in the City Council Chambers of the City Hall on the 17th day of October, 1985 made the following findings of f act with respect to the proposed lot split: 1. Granting the requested variances from the strict application of standards for minimum lot size and required yard areas in the R-4 zone will not change the existing property uses, and will allow owner occupancy of each structure. 2. Failure to grant the requested variances will result in substantial hardship for the present property owner as distinquished from mere inconvenience, in that it will preclude separate sale of two existing residential structures. 3. Granting the requested variances will not be detrimental to present or potential surrounding land uses, and will not deprive them of adequate air, light and ventilation as required by the Zoning Code, provided no additional new construction takes place on the site. 4. Continued use of the existing structures as housing is generally consistent with the Comprehensive Plan for this area of the City. 5. One family residential structures are permitted uses in the R-4 zoning district. SITE & AREA CONDITIONS: A single family home over a 2-car garage occupies Parcel I. A single family home occupies Parcel II. The surrounding area is developed with single family homes. C. MINIMUM LOT REQUIREMENTS: The R-4 district requires a lot width of 40' , a lot area of 5,000 sq. ft., side yards of 4' , and front and rear yards of 25' . D. CURRENT WIDTH & AREA: The lot has 69.68' of frontage on Van Buren Avenue and 124.77' of frontage along Oxford Street. The lot is 8,693.9736 sq. ft. in area. E.
