WHEREAS, the City has the facilities for the apprehension and holding of animals ; and � WHEREAS, the Fair is permitted to contract for the performance of said service or any portian therof; and WHEREAS, it is deemed in the best interest of the Fair to contract for said serviee, ' " �"�-- NOW, THEREFORE, IT IS MUTUALLY AGREED by and between the City and the Fair as follows : 1. The City will provide on-call service by its Animal Control Section. Employees of the City shall be authorized by the Fair to apprehend and retain dogs, cats and other animals which are in violation of the Fair's ordinance. 2. The City will not invade the private property, contrary to the wishes of the owner of said property, or forcibly take any animal from any person without the approval and assis- tance of a regular officer and/or security officer of the Fair. 3. The City agrees that all ani�als impounded shall be kept at the Saint Paul Animal Control Center, 1285 W. Jessamine, � .. _ . ,. _ , _ _ .. __. . .. , : ,. . _ _ C� �.s��� Saint Paul, Minnesata and the City agrees and warrants that all animals impounded shall be kept in a comfortable and humane manner for a period required by the Fair ordinance. 4. The City agrees that the Animal Control Center shall be open and available to reclaim animals from: Monday through Friday 8: 00 a.m, to 5: 00 p.m. Saturday, Sunday & Holida.ys 8: 00 a.m, to 12: 00 noon 5. At the time that an animal impounded under this contract is reclaimed the City or its agent shall collect the impounding fee and boarding charges provided by the City 's Regulations. 6. The City shall furnish monthly reports to the Fair as requized, as to the service or services rendered in connection with each animal impounded. All impound fees, license fees and other penalties collected by the City or its agent shall be remitted to the City. 7. In the event an animal is impounded and boarded by the order of the Fair or placed under quarantine by ruling of the State Board of Health, said animal shall be boarded as required by the order or ruling. At the end of such period, the Fair releases all of its interest, rights and control of said animals which then may be disposed of at the discretion of th�e �� City. In the event that cats, dogs or other impounded animals are unclaimed after five (5 ) days and after advising the Fair - Officials of this fact, the animal shall become the property of the City and may be disposed of or sold at their discretion. The City shall keep records of all animals impounded together with the description of the same. 9. Hourly rate: _ a) Hourly rate of $28. 00 for service provided 7: 00 a.m. to 8: 00 p.m. Monday thraugh Friday - one hour minimum. b) Service provided Saturdays, Sundays and Holidays and outside of a reqular, scheduled list will be $28. 00 per hpur - minimum three hours. c) Board fee of $2.50 per day, per dog impounded. 10. Price per each animal for destroying dogs and cats - $7. 00.. 11. All payments shall be made by the�Fair upon receipt of a mdnthly statement of the City. 12. The Fair shall provide the City with the name and phone number of the responsible person(s ) within the fairgrounds to contact oh animal control matters. The Fair shall also. provide a means of access to the fairgrounds for vehicles and staff used in the performance of this agreement. � 3. This Agreement may be terminated by either party with or with- out cause upon 30 day written notice. The Fair shall pa� for services rendered up to the date of termination and is not , responsible for services rendered a£ter the termination date. 14. That nothing in this Agreement shall be construed as limiting the right of independent operation of either the City, the Fair or the affiliation or right to contract with any other in- stitution, or agency while this Agreement is in effect. 15. That the City and the Fair mutually agree to defend and to save the other harmless from any claims, demands, actions or causes or actions arising out of any act or admission on the part of the other of the agents, services or employees ' in the perfor- mance of or with relation to any of the work or services pro- vided, to be performed or furnished under the terms of this Agreement. , _ 17. That any ,�alteration, variations, modifications or waivers of provisions of this Agreement shall be valid only when they . have been reduced to writing, signed both parties and attached to the original of this Agreement. 18.
