BowsP�-- �^---�� ..._.�/�•�.°.' Assistant City Attorney DATE: September 19, 1985 RE: Olson v. Brown and City of St. Paul; Brown v. City of St. Paul This involves a lawsuit (Olson) and a claim (Brown) resulting from an automobile accident occurring on or about July 8, 1984 at the intersection of Fifth and Forest Streets in the City of St. Paul. The accidents involved automobiles operated separately by Olson and Brown. They both claim, in part, the accident was due to and the result of a stop sign facing Brown which could not be seen because it was obstructed by a tree owned by the City. They both claimed negligence on the part of the City in failing to maintain this street. The City has denied liability claiming the accident resulted from Olson' s and Brown' s failure to maintain a proper lookout. To elimiate the uncertainty of an adverse jury verdict, this office approves the payment of $700 to Olson to fully and completely settle all claims and rnatters which may be asserted by both Olson and Brown resulting from thsi accident.
