WHEREAS, Phillip M. Winter has submitted the attached proposed lot split
for City Council approval ; and
WHEREAS, the Departments of Planning and Economic Development and Public
Works have revriewed the attached lot split at 745 Parkway Drive, and
757 Parkway Drive, as described on the attached survey; and
WHEREAS, the proposed lot split meets the requirements of Sections 67.304
and 67.406 of the Zoning Code, except that the existing structures are
legally nonconforming as to building setback from existing property lines;
NOW, THEREFORE, BE IT RESOLVED, that the City Council accepts and approves
this lot split, contingent on the applicant recording Resolution #85-1030
vacating all of the alley in Block 2, Budde's Addition, and meeting all
terms and conditions of said resolution; and
BE IT FURTHER RESOLVED, that said resolution be recorded at the time of the
recording of this lot split.

A. PURPOSE: To consider a lot split to allow 7 platted lots and a vacated alley to
be recombined into 3 new tracts for single family homes.
B. SITE & AREA CONDITIONS: The site is basically flat with mature trees. Tract "A"
is a vacant parcel . Tract "B" is occupied by a single family home with an
attached garage. Tract "C" is occupied by a single f amily home with a detached
garage. The parcel has street frontage on its north, south, and west sides, and
a single family home to the east.
C. MINIMUM LOT REQUIREMENTS: 50' and 6,000 sq. ft.
D. AREA & FRONTAGE: 128.72' frontage on California Avenue, 254.81 ' frontage on
Greenbrier Street, 188.07' frontage on Park Drive for a total of 24,025.89 sq.
ft.

Tract A: 102.85' frontage on Greenbrier Street; 63.72' frontage on California
Avenue; 6,553.60 sq. ft.
Tract B: 65' frontage on California Avenue; 50.31 ' frontage on Parkway Drive;

E. FINDINGS:
1 . On August 6, 1985, City Council vacated the alley in Block 2, Budde's
Addition. Council File #85-1030
2. Existing structures are legally nonconforming as to building setback from
existing propeprty lines. Otherwise, the proposal meets all requirement of
Sections 67.304 and 67.406.
3. The proposed division will allow a single family residence to be developed on
Tract "A".
4. The division will not be detrimental to the present or potential development
on the site nor to the neighboring property.
F. STAFF RECOMMENDATION: Based on the above findings, staff recorr�nends approval of
