WHEREAS, the Division of Housing and Building Code Enforcement
has requested the City Council to hold a public hearing to consider
the advisability and necessity of the correction or wrecking and
removal of the following described building, said structure having
been reported to constitute a public hazard:

WHEREAS, as of September 5, 1985 the fee owner of the above
property through a sheriff ' s foreclosure sale that took place on
April 4, 1985 is Twin City Federal Savings and Loan Association, 801
Marquette, Minneapolis, Mn. Twin City FedQra� can be served through
its attorneys F. L. Thorson and ackelT�� Crows� and Moore, 1600 Twin
City Federal Tower,' Minneapolis,�-554U2 . � Leonard E. and Shelly R.
Hovan, address unknown, have a right of redemption that expires
October 4, 1985. There is a second mortgage on this property
with Beneficial Loan and Thrift Co. , 4433 South Lake Avenue, White
Bear Lake, MN 55110 on file as document No. 2157816. There are no
other judgments of record filed agains� the Hovans .
WHEREAS, the Division of Housing and Building Code Enforcement,
on behalf of the City Council did notify by mail the above noted
oarties of interest at their last known address.
WHEREAS, a public hearing was held by and before the Council of
the City of Saint Paul in the Council Chamber of the Court House of
said city at 10 : 00 a.m. on Thursday, September 26, 1985, to consider
the advisability and necessity of ordering the correction or wrecking
and removal of said structure on the above described property inasmuch

as said structure is reported to constitute a hazard to public health,
safety and welfare.
WHEREAS, upon the facts presented at the said hearing consisting
of photographs, inspection reports and the recommendations of the
Building Department, it is further determined that the above building
constitutes a hazardous building within the definition of Minnesota
Statutes 463 . 15 for the following reasons :
l . The subject property has not been boarded;
2 . Because of age, deterioration, lack of maintenance and the
following list of deficiencies, this building is a public hazard and
a blighting influence on the neighborhood;
a. The Southeast corner of the East wall has cracked and
has crumbling cement blocks%
b. The roof deck is severely rotted and collapsing at
both the North and the South ends;
c. The windows and doors are missing;
d. The garage is filled with debris.
now, therefore, be it,
RESOLVED, That in accordance with Minnesota Statutes Sections
463 , 15 through 463 . 25 and based upon the foregoing findings of the
City Council, the Council of the City of Saint Paul does hereby make
the following Order:
ORDER
l. The owners of the above described building shall make the
same safe and not detrimental to the public peace, health, safety
and welfare by either correcting the hazardous condition of the
building as indicated in this Order or by having the building razed
and the materials therefrom removed from the premises within thirty
( 30) days from the date of the service of this Order;

2 . Unless such corrective action is taken to comply with this
Order or an answer served upon �he City of Saint Pa.ul anci filed in
the oifice of the Clerk of District Court of Ramsey County, Minnesota
within twenty (20 ) days �rom the d��.e of the service of this Order,
a Motion for summary enforcement of this order as it relates to the
razing and removal of the building will be made to the Ramsey County
District Court;
3 . In the event that the building is to be razed by the City of
Saint Paul pursuant to judgment of the District Court, all personal
property or fixtures of any kind which may unreasonably interfere with
the razing and removal of this building shall be removed within ten
(10) days from the entry of judgment; and if not so removed, the City
of Saint Paul shall remove and dispose of such personal property and
fixtures as provided by law;
4. If the City of Saint Paul is compelled to take any corrective
action herein, all necessary costs expended by the City will be
assessed against the above described real estate and collected as
other taxes; and be it
FURTHER RESOLVED, that a certified copy of this resolution and
incorporated Order herein be served upon the last record owners of the
above described property in the manner provided by law.

The Division of Housing and Building Code Enforcement is hereby submitting its
report on the condition of the structure at the location referred to above.
The fee owner of record is: Leonard E. Hovan, 894 E. Third Street, St. Paul,
Minnesota 55106.
The legal description of the property is: Adam Gotzian's sub of blk. 84, Lyman
Dayton's addition to St. Paul, Ex part desc as fol beg at NE cor of Lot 4 th
W 4 ft to apt. the SEly to a pt on E L of and 60 ft S from NE cor of Lot 4 th
N to beg Lot 4.
The building is a detached cement block one-car garage.
The subject property has not been boarded yet. The City is to board it up.
Because of age, deterioration, lack of proper maintenance and the following
condition:

ings, and the continued vacant and boarded-up condition contributes a blighting
influence on the neighborhood, it is the recommendation of this Division that

WHEREAS, Kenneth and Helen Spielman have submitted the attached
proposed lot split for City Council approval; and
WHEREAS, the Departments of Planning and Economic Development and Public
Works have reviewed the attached lot split at 441 Virginia Street and 350-
352 Aurora Street, legally described as Lot 6, Block 6, Elfelt Bernheimer &
Arnold Addition; and
WHEREAS, the Saint Paul City Council at a public hearing held in the City
. Council Chambers of the City Hall on the 26th day of September, 1985 made
the following findings of fact with respect to the propposed lot split:
1 . Granting the requested variances from the strict application of
standards for m�nimum lot size, required yard areas, lot coverage,
density, and parking requirements, in the RT-2 zone will not change the
existing property uses, and will allow owner occupancy of each
structure.
2. Failure to grant the requested variances will result in substantial
hardship for the present property owner as distinquished from mere
inconvenience, in that it will preclude separate sale of two existing
residential structures.
3. Granting the requested variances will not be detrimental to present or
potential surrounding land uses, and will not deprive them of adequate
air, light and ventilation as required by the Zoning Code, provided no
additional new construction takes place on the site.
4. Continued use o�' the existing structures as housing is generally
consistent with the Comprehensive Plan for this area of the City.
