WHEREAS, Chauncey �riggs (SBD #165) has submitted the attached
proposed lot split for City Council approval; and
WHEREAS, the Depar�ments of Planning and Economic Development and Public
Works have reviewed the attached lot split at 749 Surmiit Avenue as
described on the a�tached survey; and
WHEREAS, the proposed lot split meets the requirements of Sections 67.304
and 67.406 of the Zoning Code provided an appropriate declaration of
covenants concerniMg maintenance of the commonwall garage is recorded with
this lot split;
NOW, THEREFORE, BE IT RESOLVED, that the City Council accepts and approves
this lot split contingent on the applicant recording and meeting all terms
and conditions of said covenants; and
BE IT FURTHER RESOLVED, that said covenants be recorded at the time of the
recording of this lot split.

A. PURPOSE: To consider a lot split to permit separate ownership of the lots.
B. SITE & AREA CONDITIONS: A large single family residence occupies lot 1 . Lot 2 is
occupied by a carriage house which has been converted to a single family
residence. The surrounding area is developed primarily with large single f amily
residences interspersed with mixed density housing.
C. MINIMUM LOT REQUIREMENTS: The R-2 zoning district regaires a lot width of 60'
and a lot area of 7,2((�Tsq. ft.
D. CURRENT WIDTH & AREA: The current lot is an irregular shaped parcel with 111 '
fronting umnit Avenue and 256.55' along Grotto Street. The lot area is
approximately 30,936 sq. ft.
PROPOSED WIDTH & AREA: Lot 1 is an irregular shaped lot with 111 ' fronting
Sumnit and 20 .64' a ong Grotto. The lot area is approximately 23,437 sq. ft.
Lot 2 is an irregular shaped lot with 143.97' fronting Portland Avenue and 48.91 '
along Grotto Street. The lot area is approximately 7,499 sq. ft.
E. FINDINGS:
l . All the applicable provisions of the Legislative Code are complied with.
2. The proposed subdivision will not be detrimental to the present and potential
surrounding land uses.
3. The area surrounding the subdivision can be planned and developed in
coordination and compatibility with the proposed subdivision.
4. The subdivision is consistent with the City's Comprehensive Plan.
5. The subdivision preserves and incorporates the site's important existing
natural features whenever possible.

6. All land intended for building sites can be used safely without endangering
the residents by peril from floods, erosion, continuously high water table,
severe soil conditions, or other menaces.
7. The subdivision can be economically served with public facilities and
services.
F. STAFF ANALYSIS: A large garage straddles the boundary line between Lot 1 and
Lot 2. The owners of Lot 1 and Lot 2 desire to use the garage. A covenant
concerning the maintenance and use of the commonwall garage should be recorded
with the lot split.
_ G. STAFF RECOMMENDATION: Based on findings 1 through 7 and the staff analysis,
staff recorrmends approval of the lot split contingent on the applicant recording
and meeting all terms and conditions of the covenant.
