RESOLVED, that upon execution and delivery of a release in
full to the City of Saint Paul, the property City officials are
hereby authorized and directed to pay out of the Tort Liability
Fund 09070-511-000 to Donald J. Mortensen and Sharon M. Mortensen
on behalf of Thomas R. �iortensen, their minor son, the sum of
$1, 000.00 in full settlement of Thomas R. Mortensen' s, Donald J.
Mortensen' s and Sharon M. Mortensen' s claim for damages sustained
on September 13, 1983 , as more particularly set forth in the Summons
and Complaint filed with the City Clerk on January 31, 1985.

Re: Thomas Mortensen vs . City of St . Paul , et al .
Date: September 9, 1985
This is a lawsuit commenced by Donald and Sharon Mortensen individually
and on behalf of their minor son, Thomas Mortensen, resulting fror.l a
deep thigh laceration sustained by Thomas when he ran into a metal
tree support stake surrounding a City owned tree. The injury occurred
at night and required emergency medical care.
The Mortensens have alleged the City was negligent in its installation
and maintenance of, and failure to timely remove the tree stakes . The
Mortensens have also alleged negligence on the part of the owner of the
property where the tree was located.
To eliminate the uncertainty of an adverse jury verdict this office
approves the payment of $1,000. 00 to and on behalf of Thomas Mortensen
to fully and completely settle all matters resulting from this
accident . The owner of the property is also making a monetary payment .
