RESOLVED, that upon execution and delivery of a release in
full to the City of Saint Paul, the proper City officers are hereby
authorized and dire ted to pay out of the Tort Liability Fund
09070-511-000 to D. Patrick McCullough and Marlys A. McCullough
the sum of $5, 000. 00 in full settlement of their claim for damages
sustained in Januar 1985, as more particularly set out in a
communication to t City Council on January 10, 1985 .

by D. Pat ick and Marlys A. McCullough
The McCulloughs own a building in Maplewood which houses Mr.
McCullough' s law fi m. It is serviced by the Maplewood sewer
system and a St. Pa 1 pumping station. Twice in January 1985
St. Paul city emplo ees incorrectly operated the pumping station,
causing an overflow of raw sewage into the McCullough building.
This damaged tile, arpeting, walls, furniture and some personal
property. The sum f $5, 000 accurately represents the damages.
