We s a Council have primarily worked on a case-by-case basis to develop standards or authorizing applications for new facilities in St. Paul . However, in the recent appeal of the Aurora-St. Anthony Block Club of a Plan ing Commission decision on the Buchner Group Home, the Co ncil went beyond the 1320 feet rule and apptied the state law regulating conce tration of facilities in a given planning dis- trict. This decision in effect sets the policy for dealing with such requests in he future. As you recall from my memo dated July 23, 1985, Minnesota Statute 245.812 (as amended) prevents state agencies from licensing any new facilities in planni g districts that have more than 0.5% of their population i such fac ' lities. It is the intent of this legislation to disperse community residential facitities throughout the county in order that n undue ha dship fall on any one neighborhood, regardless of the socio economic r ethnic makeup. Since these tend to b some of the most controversial issues we face, we now have some guid lines to base decisions on in the future. That law was promulgated to pro ote dispersal of group residential f acilities throug'nout the entire country and requires the county to submi�t a plan that fulfils �Che follo ing purposes and requirements: "1) No new f acil_ity serving seven or more persons shall be 1 cated in any planning district where the population in reside tial f acili ies is highiy concentrated" and "2) The county plan shall promot dispersal f highiy concentrated residential populations." High7y concentrate has been de�ined in the law as a population in residential facili ies that ex eeds one-half of one percent of the population of a recogn'zed plannin district. Locati g the facil ty at the subject site may bring potentially vulnerable youth 'n close pro imity to adult entertainment businesses. Granting the condit'onal use pe mit would be detrimental to the health and weifare of the Aurora St. Anthony neighborhood. 8. It app ars that co e compliant off-street parking cannot be provided at the subjec property. Applicant has proposed to lease parking across Fu�ler Avenue Staff que tions, however, if the parking provided under lease will reduce available p rking opportunities for the business at the off-site location below sufficient level . She said she had 8 of her own children, a d had cared for 560 other chifidren, free of cost, over th last 20 ye rs. She said that she had kids in her home from one week to two years a d never had any financial help. She said that she also di ected a cam for kids, and has been a foster parent. She said that at time she has be n afraid to sleep in the house with these kids but has t�ev r had any p oblems with the children she has taken in. She said she see a need for this home in the community, she wants to expand, this ho e would all w her to do that and provide some financial help. As unlicenaed facilities fnr adult mentally ill persons were developed local3.y, a pattern of overconcentration emerged . In 1981 , when the Leg'slature ma@� funds available to assist facilities serving the mentally 'll to meet Iicensure requirementa, they also provided a temporary exemption from the exceasive concentration requirements for facili.tiea serving th mentally ill which were established prior to July 1, 1980. 7Ch� exemption, ending July 1 , 1984, was needed to allow time for local camdnunities and the Department of Human Services to develop a plan that woul� �rotect th interests of residents living in facilitiea that did not meet zoning crite ia. Althaugh many of the acfliti.ea in question did receive eonditional or spe- cial uge permita in r lati.on to the 1,320 feet requirement, some neighbor- hoods con�inued to ex ress concerns about the overconcentration of community residential facilitie . In response, the 1984 Legialature adopted, and the Governor signed, Sena e File 1628 (now chapter 617) which amenda the Minnesata Licensing A t to more clearly establieh a policy of not excluding community residential facilities from residential aettings yet also requiring that counti s having an overconcentration of facilities develop plans to ramote diap rsal af these facilities.
