WHE EAS , Thel a Buckner applied to the Planning Commission for
a Speci 1 Conditi n Use Permit to establish a community resi-
dential facility for 16 youths at 723 Fuller Avenue , Saint
Paul , Mi nesota; a d
WHE EAS , foll wing a public hearing with notice to affected
property owners h ld by the Zoning Committee of the Planning
Commissi n, the P anning Commission did by its Resolution No.
85-36 da ed April 6, 1985 , approve the issuance of the Special
Conditio Use Permi ; and
WHER RS , the urora/St. Anthony Block Clubs , Inc. appealed
this dec ' sion of the Planning Commission to the Saint Paul
City Cou cil base upon the grounds that the District 8 is
a highly concentra ed area containing community facility resi-
dents ; an
WHER AS , the City Council upon notice to appellant, to
Thelma B ckner and to other affected property owners, conducted
public he rings on this appeal and, having heard the statements
made and considere the application, the report of staff, the
minutes a d findin s of the Planning Commission and the Zoning
Committee togethe with statements made by the Commissioner
of the tate Dep rtment of Corrections that the department
would not grant a community facility license to the applicant
on the rounds th t the District had an over-concentration
of such f cilities , he Council does hereby
RESO VE , that he Council of the City of Saint Paul does
hereby re erse the decision of the Planning Commission, does
hereby de y the Sp cial Condition Use Permit as requested by
Thelma Bu kner, and does hereby grant the appeal of the Aurora/
St. Anthon Block Cl bs , Inc. ; and, be it

group homes, haif=way houses, and other community residential facili-
ties. We s a Council have primarily worked on a case-by-case basis
to develop standards or authorizing applications for new facilities
in St. Paul . However, in the recent appeal of the Aurora-St. Anthony
Block Club of a Plan ing Commission decision on the Buchner Group
Home, the Co ncil went beyond the 1320 feet rule and apptied the state
law regulating conce tration of facilities in a given planning dis-
trict. This decision in effect sets the policy for dealing with such
requests in he future.
As you recall from my memo dated July 23, 1985, Minnesota Statute
245.812 (as amended) prevents state agencies from licensing any new
facilities in planni g districts that have more than 0.5% of their
population i such fac ' lities. It is the intent of this legislation
to disperse community residential facitities throughout the county in
order that n undue ha dship fall on any one neighborhood, regardless
of the socio economic r ethnic makeup.

Ramsey Count indicati g the number of residents in community residen-
tial facilities in eac planning district, a map indicating the same,
and a map i dicating he number of beds remaining available in each
district.
Since these tend to b some of the most controversial issues we face,
we now have some guid lines to base decisions on in the future. I
will be fo warding his information to the planning staff and the
Planning Com ission fo their reference.

On April 18 1985 the Zo ing Committee of the Planning Commission held a public
hearin� on a request fo a Special Condition Use permit to operate a aroup home
for lh boys at 623 Fulle Avenue. The applicant (Thelma Buckner) explained her
proposal an outlined he credentials as a social service provider. She explained
that there is a great ne d for this program in the City. The Zoning Committee also
heard other estimony in support.
Seven indivi .uals testif ed in opaosition. They were concerned with the impact a
group home w uld have on the character of the community. They also indicated that
Plannin� Dis rict 8 has high concentration of community residential facilities
and suggeste that the P anning Commission limit new permits for aroup homes to
less concent ated planni g districts. They also said that a aroup home should
not be locat d within 2 locks of an adult entertainment area where prostitution
flourish��. .

serving even or mor f acility residents subject to the following conditions:
(a) It hall not be located in a two-f amily dwelling unless the community

(b) It oes not ser e more than 16 f acility residents except that structures
designed or newly built specifically for greater capacity may allow a greater
num er provided that all other conditions of special condition use are met.
(c) Subject to the p ovisions of Secti�n 64.300, Subdivision 4, the minimum lot
siz for communi y residential f acilities is that prescribed for a one-f amily
dwelling plus 30 square feet for each f acility resident over and above six
resi ents. In a dition, community residential f acilities serving more than 16
�si ents shall eet the requirements for height, yard setback, and maximum
perc nt of lot o cupied by main building set forth in Chapter 61, subject to
the rovisions o Section 64.300, Subdivision 4.
(d) Subj ct to the p ovisions of Section 64.300, Subdivision 4, a minimum distance
of 1 320 feet wi 1 be required between zoning lots used for community
resi ential faci ities, excluding foster homes.
(e} Ther shall be o e off-street parking space for every two facility residents
subj ct to the p ovisions of Section 64.300, Subdivision 4.
(-f) Perm ssion for s ecia�t condition use applies to the community residentia�
f aci ity only as long as licensing, purpose, size or location do not change.
F. FINDINGS:

6. Granting a special condi�ti�n us° permit in Planning District 8 would be
contr ry to the sp�rit and intent of State Statute 617. That law was
promulgated to pro ote dispersal of group residential f acilities throug'nout the
entire country and requires the county to submi�t a plan that fulfils �Che
follo ing purposes and requirements: "1) No new f acil_ity serving seven or more
persons shall be 1 cated in any planning district where the population in
reside tial f acili ies is highiy concentrated" and "2) The county plan shall
promot dispersal f highiy concentrated residential populations."
High7y concentrate has been de�ined in the law as a population in residential
facili ies that ex eeds one-half of one percent of the population of a
recogn'zed plannin district. Nearly 2q of the general population of District
8 resi es in commu ity care f acilities.
7. Locati g the facil ty at the subject site may bring potentially vulnerable
youth 'n close pro imity to adult entertainment businesses. Granting the
condit'onal use pe mit would be detrimental to the health and weifare of the
Aurora St. Anthony neighborhood.
8. It app ars that co e compliant off-street parking cannot be provided at the
subjec property. Applicant has proposed to lease parking across Fu�ler
Avenue Staff que tions, however, if the parking provided under lease will
reduce available p rking opportunities for the business at the off-site location
below sufficient level . It appears that the fifth condition is not met.

THELMA UCKNER #9732 : Special condition use permit to establish a
communi y residential facility for 16 youths at 623 Fuller.
The app icant was p esent. There was opposition present at the hearing.
Mr. Hai er showed s ides of the site and reviewed the staff report with
a recom endation fo denial . One letter in support and one letter and
petitio with 77 na es in opposition was receive�. The District Council
. sent a etter stati g they were in opposition since they haven't had '
time to review this matter.
� Ms. Zie an said she wanted it noted that the property directly to the
north o this prope ty is residential , that this property is not
abuttin the Faust heatre.
8ob Ba� le, 904 Car oll , distributed copies of a petition with seven
names s pporting th group home. He said that that his sister, 7helma
Buckner bought the house at 623 Fuller to turn it into a group home for
boys.
Thelma uckner, 829 Thomas Ave. No., Mpls., stated that for the last 20
years s e has been nvolved in helping children. She said she had 8 of
her own children, a d had cared for 560 other chifidren, free of cost,
over th last 20 ye rs. She said that she had kids in her home from one
week to two years a d never had any financial help. She said that she
also di ected a cam for kids, and has been a foster parent. She said that
at time she has be n afraid to sleep in the house with these kids but
has t�ev r had any p oblems with the children she has taken in. She said
she see a need for this home in the community, she wants to expand,
this ho e would all w her to do that and provide some financial help.
She sai this home ould be professionally operated.
_ Mr. Lev said that he zoning administrator indicated that there is
another ommunity r sidential f acility within 1320 feet of this
property. Mr. P ang l sta�ed that is no longer valid, that there is not
anather ommunity r sidential facility within 1320 feeL.
� Mr. Lane ran asked h w Ms. Buckner felt about the close proximity to �he
Faust Th atre, and out the higi� concentrat�on of corranunity residential

Ms. Buck er said she wasn't concerned about the Faust, that teenagers
don't ev n ask to go to the movies anymore, because they can see

Mr. L negran aske how Ms. Buckner felt about the patrons of the Faust
Theat e.
Ms. B ckner said he doesn't see any problem. She said she has a large
yard nd large ho s� and very strict rules, she doesn't expect the kids
from he group ho e to have contact with the Faust patrons.
- Nir. B b Battle said that he has lived in St. Paul sir�ce 1960 and has
never seen a kid o into the Faust Theatre. He alsa said that with HBO
and o her cable T. . that kids don't need to go to the Faust. He said
that concerning th density of cor�nunity residential facilities, that
there is a need fo this home in this location, that the kids that will
be in his group h me will probably be from the neighborhood.
Ms. Bu kner said t at she had a group home in Grand Rapids, but since it
was in Cass County the kids were nat referred from Hennepin or Ramsey � � -
County She said hat the home was burned down because it wasn't wanted
in Cas County. S e said that she now has her maney tied up in 623
Fuller that there is a need for a group home there.
Ms. Mo ton asked h r how long the kids would be staying in the group
home. Ms. Buckner said that it would be determined by the county or
state gency that ends her the kids.

teenag rs irr troub e. Ms. Buckner stated yes, and this is why she wants

Revere d Walter Ba tle, 220 E. 42nd St., Mpls., spoke in support. He
said t at he is pa tor of the Gaspel Church on Hague Avenue and is the
brothe of Thelma uckner. He said that when he first came to the Twin
Cities he only int nded to stay for a sho�t �ime and then go back to
Missis ippi , but h saw a need to help black youth in Minnesota. Ne said
that his fa�nily op rates group homes for children and that they train
childr n, that the e won't be any problem with this facility in this
. neighh rhood. -
Burr�ie attle, 421 0. Dale stated that he �is president and owner of
Battle lectric Co pany located at 624 Fuller, and he is Ms. Buckner' s
brother. He said t at 623 Fuller is located next door to his business.
He said that he sup orts the youth center, and he will supply parking on
his pro erty. He also said that he has never seen any teenagers go into
� the Fau t Theatre.
Johnath n Price, 67 Fu11er, spoke in opposition. He said that he
doesn't feel a grou home for kids should be lacated near the Faust
Theatre and Flick, here prostitution flourishes. He said that these
group h �es should e spread out, not all concentrated in one
neighbo hood.
7iger J ck Rosenblo m, 643 FuT1er, spoke in opposition, He said that he
m3de it on his ovrn ithout group homes and can't understand why this
f acilit should be llowed. He said he is very upset because he views .

the ne ghborhood. He said that he understands that some young aduits
need s ecial atten ion, but th_at the residents of this area shouldn't be �
subjec ed to a hig concentrataon of these facilities.
Charle Neal , 629 uller, spoke in opposition. He said that he lives
next d or to 623 F ller and has some questions about the group home. Ne
wanted to know if here was a curfew time, and if the kids will have
cars, e was conce ned aaout parking. He said that last summer there was
a problem with a 1 t of kids in th� area partying, and felt that this -
may co flict with he group home. He asked how many adults will be at
the pr perty to su ervise the youth, and when they would be there. He
wanted to know if here would be 16 kids there all the time and wha to
see if there is a ro57em with the group home.
Mr. P a gal said th t P�is. Buckner can answer his questions later on, but
that t e Minnesota State Welfare Department is in charge of licensing
the pr gram.
Ramsey Jackson, 63 Fuller spoke in opposition. He said that he has
lived n the neigh orhood for 35 years. He said that there are good
citize s in the neignborhood and he wants to see the neighborhood lcept
nice a d is depending on the zoning committee to make the right
decisi n.
Credella Young, 67 Fuller, spoke in opposition. She said that if this
group ome is a110 ed in the neighborhood, it should be coordinated.
Aletha Jackson, 63 Fuller, spoke in opposition. She said that she is
84 yea s oid and h s seen the area grow and depreciate. She said that
the re idents in t is area had a hard time when the freeway came
throug because th y had to leave their homes and move. She said that
the ne ghbori�ood w s quiet and did real good until the Faust Theatre .
came i . She said that area youth don't have a playground nearby and
the ki s play in t e streets and alleys. She said that there isn't room
for mo e kids in t e neighborhood and there is not enough room for 16
kids a 623 Fuller She said that she doesn't want the neighborhood
change any more.
Beatri e Goss, 665 Fuller, spoke in opposition. She said that she
signed the petitio in favor of the group home, but after studying the
p.rogra further, s e is in opposition, and would like her name deleted
� f rom t e siapportin petition. She said that she works with youth, and
knows t�e problems that will arise. She said that youth need discipline
and ed cation. Sh said that the neighborhood is a good one, and that
if the group home ��s allowed, the property in the area will depreciate. .
Greg Finzell , Comm nity Organizer of the Summit University Planning

Mr. angal asked if he was opposed to the group home, or if the District
- Coun il just has 't discussed the matter yet.
Mr. inzell said that they were opposed because they haven't discussed
the atter yet.
Mr. Levy asked w he was opposed. �
Mr. Finzell said that the District Council hasn't gotten feedback. from
the eighborhood. He said the District Council was only given 2 weeks
notic and this asn't enough time to get the neighborhood together to
discuss this mat er. Ne said that rather than to take no stand at all
on this issue, they would oppose it. He said that he asked Mr. Battle
for postponmen , but that this wasn't agreeable. He said that the
District Council annot make a recommendation without input from the
neigh orhood. �
Mr. 8 b Battle said that he attended a District Council meeting and that
there was no oppo ition, except that they wanted to discuss the matter
furth r. He said they would be willing to go to another District
Counc'1 meeting t discuss the group home, but asked that this matter
not b postponed oday.
Ms. B ckner discu sed some of the concerns that were raised by the
neigh orhood resi ents. She said that there are no other community
resid ntial facil 'ti�s within 1320 feet of 623 Fuller. She said that
she w s afraid at t�mes sleeping with some of the kids in the house, but
that he never ha a problem she couldn't handle. She said that none
of th kids will ave cars. She said that concerning parking problems,
that here is a 4 car garage on the property, and that staff can also
park ext door at Battle Electric Comgany. She said that the licensing
depar ment has ru es concerning curfew hours, and that it will be 11:00
p.m. nless the k'ds are at church or at their job. She said that she
doesn t know how any kids she will have at one time, but that the
maxim m is 16.
Mr: P ngal asked ow many staff she will have.
Ms. 8 ckner said hat she will have two full-time and one part-time
perso per shif t, as well as cooks and maintenance people. She said
that he is a goo citizen, and wants to help remold young lives and
help hildren. S e said that the kids won't be locked into the house.
She s id that the group home will be called Youth Tech, and will try to
help ids acquire a good profession. She wants to make the co�nunity
safer by helping ids.
Ms. M rton asked ow often Ms. Buckner would be on the premises.
Ms. 8 ckner said hat she will be there 12 out of 24 hours. She said
she w 11 be the m in cook and nutritionist while training someone else.
Ms. Z eman asked i this f acility will be only for boys ar for both boys

Ms. Zi man moved t lay the matter over to 5-2-85 to allow time for the
comnun ty to meet ith the applicant. Mr. Levy seconded the motion.
Ms. iNo ton stated he would be opposed to laying the matter over because
it may create a ha dship on the applicant.
Mr. Le y said that the District Council should have taken action on this
matter already, bu didn't, and that this issue was important.

Mr. Bo Battle sai that they have borrowed money and are paying

take al1 of May to complete. She said that she needs the license
approv d first, th n they can renovate and hope to open by 6-1-��. She
said t at their pa ents on this property will be due starting 5-I-85.
Mr. l.an gran asked hat the purpose of a community meeting would be.
Mr. Lev said that eeting the needs of a particular individual is
import t, but meeting the n2eds of a community is important also.
Ms. Zie an said tha group homes are a sensitive issue and that the .
distric council pr cess is important.
Mr. Pan al asked Mr. Finze3l if the district council process could be
complet d by May 2.
Mr. fin ell stated hat it could not, they could flyer the immediate
neighbo hood, but n t the whole community, in such a short amount of
time.
Ms. Mor on noted th t there wouldn't be any point fn laying the matter
. over to t�lay 2, that the district council still wouldn't have enough
time.
Mr. Lan gran said t at he would vote against the motion, that the zoning
ordinan es provide or notification of the immedia�e neighborhood and
that th district c uncil process is separate. He said that ideally
they sh uld have ha a public meeting, but that this did not happen.

- Club s a cohesiv neighborhood organization. Under the direction of -
Ron P uline many rojects have been planned and implemented to enhance and
prese ve the stab lity of this ever changing Summit-University
neigh orhood.
Due t the transi ional period this area is going through, I do not feel
it wo ld be in th best interest of the neighborhood, or the clients of the
halfw y house, to locate this faciLity at 623 Fuller Avenue. Perhaps one
day o ganizations such as the Aurora-St. Anthony Block Club, University
Avenu Developmen Corporation, District 8 and District 7, will be able
to su port the ge erous concept of halfway houses. The energies of these
organ zations are now focused upon the continued fight to stabilize their

SUBJECT: Implementati n of Planning Requirements Relating to the Overcon-
� centration/Diapersal of Community Reaidential Facilities
The location and zoni g aection of the Minnesota Welfare Licenaing Act
(Minnesota Statutes, section 245.812) was intended to provide protections to
neighborhoods by preve ting overconcentration of communi.ty residential
facilzties ti�rough us of the 1 ,320 feet distance requirP�ent between com-
munity re$idential fa ilities. As unlicenaed facilities fnr adult mentally
ill persons were developed local3.y, a pattern of overconcentration emerged .
In 1981 , when the Leg'slature ma@� funds available to assist facilities
serving the mentally 'll to meet Iicensure requirementa, they also provided
a temporary exemption from the exceasive concentration requirements for
facili.tiea serving th mentally ill which were established prior to July 1,
1980. 7Ch� exemption, ending July 1 , 1984, was needed to allow time for
local camdnunities and the Department of Human Services to develop a plan
that woul� �rotect th interests of residents living in facilitiea that did
not meet zoning crite ia.
Althaugh many of the acfliti.ea in question did receive eonditional or spe-
cial uge permita in r lati.on to the 1,320 feet requirement, some neighbor-
hoods con�inued to ex ress concerns about the overconcentration of community
residential facilitie . In response, the 1984 Legialature adopted, and the
Governor signed, Sena e File 1628 (now chapter 617) which amenda the
Minnesata Licensing A t to more clearly establieh a policy of not excluding
community residential facilities from residential aettings yet also
requiring that counti s having an overconcentration of facilities develop
plans to ramote diap rsal af these facilities. The legislation also
extended �he temporar zoning exemption from July 1, 1984 to July 1, 1985.
This bull�tin conveqs to counties the plan requirements and timetables con-
tained in the law.

alternative plac ment.

not �n t-he best nterest of the clients served, the county shall

DHS Review Proceas an Sanctions Within 45 days of receipt, the Commis—
sioner sh�all review t e plana submitted to DHS and notify the county whether
the plan meets the re uirements of the law. If the Coasmiasioner determines
that the plan daes no meet ghe requirements of the law, the county will
have 30 d�ays in which to aubmit plan amendments. The county may also
request a hearin� in ccordance with the provi.eions of Minnesota Statutes,
ehapter 14 to appeal he Cammigsioner' s decision. After Julp 1, 1985, the
Commissioiner will wit hold that portion of the Rule 12 grant� which would be
used for facilities 1 cated in planns.ng districts or administrative sub—
divisions hav�.ng an o erconcentration of facilities until an acceptable plan
has been !developed.

The City Council , at its meeting on May 16th, continued the
appeal he�ring reg rding the above community facility for the
purpose of receivi g information as to any State Attorney Gen-
eral ' s opinion tha may have been requested from either the
State Department f Corrections or the Department of Human
Services.
-�- I am advi'S�'d by a taff person from the Human Services Depart-
ment that no Atto ney General ' s formal opinion was requested
but that Ithe poli y of the Department is to deny licenses
in an area such s District 8 that is overly concentrated,
as defined by Chap er 617 , Laws of 1984. (See letter of A1
Oertwig da!ted June 3 , 1985) .
I was further advi ed by a staff person of the Department of
Corrections , John cLagan, that his department also has not
requested any form 1 legal opinion of the Attorney General ,
but that I,his depar ment is to issue a policy which also will
state tha� no corr ction license will be issued in any district
which is over-con entrated as defined by Chapter 617 , Laws
1984. This policy has not been issued as of this date , and ,
he indicat�d would b forthcoming in about two more weeks.

specifically to Planning istrict £3 in St. Pau1.
'I9ze facts are t
1 . Ramsey Cau�ty is r quired by Minn. Stat. 245.812, su�d. 7 to sul�nit a
di.sper�al plan bec use it has facilities locat�d within 1320 feet of
other facilities;
2. Based on informati n available to the Departirent and, as reflected in
the Ramsey County ispersal Plan, District 8 meets the definitiai of
"highl� cancentra d" as established in M.S. 245.812, sul�d. 7. That
is, the populatirn in residential facilities serving seven or r.�re
persrns exceeds an -half of one percent of tY�e populaticxz in Planning
Distri�t 8;
3._ The law requires cauzty to provide assurances it wili not per.nit
a new $acility to ocate in a highly cancentrated plar�iing district and;
4. This law requires Commissioner to certify whether t�e dispersal
plans noeet the re irements of the law.
Because the Comnissioner as been placed in th� role of certifying dispersal
plans, and sin�ce such pl �aust contain assurances that no new facilities will be
established in highly con ntrated areas, a licensing applicatiai which is
su}�mitted and which is in onflict with an approved county c�is,persal plan will
be denied. '
