An Ordinance a ending Chapter 60 of the Saint Paul
Le islative Co e pertaining to zoning for the City
of Saint Paul nd the zoning maps thereof.
WHEREAS, Pur uant to Min esota Statutes, § 462.357 and § 64.210 of the
Legislative Code Frank W. H as duly petitioned to rezone Chute Bros. Div. No. 2,
Lots 29 and 30, ocated at 5 5 North Dale from B-2 to RM-2 for the purpose of
converting comme cial floor rea to dwelling units the petition having been
certified by the Planning Di ision on April 3, 1985, as having been consented to
by at least 67% f the owner of the area of the property to be rezoned, and
further having b en consente to by at least two-thirds of the owners of the
property situate within 100 feet of the total contiguous property within one year
preceding the da e of the pe ition; and
WHEREAS, The Zoning Comm ttee on April 18, 1985, conducted a public hearing
for the purpose f consideri g the rezoning petition, and pursuant to Section
107.03 of the Ad inistrative Code, submitted its recommendation to the Planning
Commission that he petition be granted; and
WHEREAS, The Planning Co ission considered the rezoning petition at its
meeting held on pril 19, 19 5, and recommended that the City Council approve the
petition; and
WHEREAS, Not ce of a public hearing before the City Council on the said
rezoning petitio was duly p blished in the official newspaper of the City and
notices were dul mailed to ach owner of affected property and property situated
wholly or partly within 350 eet of the property sought to be rezoned; and
WHEREAS, A p blic hearin before the Ci.ty Council , having been conducted on
July 11, 1985, w ere all int rested persons were heard, and the Council having
considered all t e facts and recommendati6ns concerning the petition; now,
therefore,

� LJHEREAS, Purs ant to Minn sota Statutes, § 462.357 and § 64.210 of the
Legislative Code, Frank W. Ha s duly petitioned to rezone Chute. Bros. Div. No. 2,
Lots 29 and 30, 1 ca�,ed at 51 North Dale from B-2 to RM-2 for the purpose of
converting commer ial floor a ea to dwelling units the petition having been
certifieci by the lanning Div�sion on April 3, 1985, as having been consented to
by at least F7% f the owners of the area of tre �ro�erty te be rezoned, and
further having b en consented to by at least two-thirds of the owners of the
property situate within 100 feet of the total contiguous property within one year
preceding the da e of the pe ition; and
WHEREAS, The Zoning Committee on April 18, 1985, conducted a public hearing
for the purpos� f consideri g the rezoning petition, and pursuant to Section
107.03 af the Ad inistrative Code, submitted its recummendation to the Plarrning
Commission that he petition be granted; and
u1HEREAS, The Planning Co mission considered the rezoning petition at its
mee�ing held on pril 19, 19 y, and recommended that the City Council approve the
petition; and
WHEREAS, Not ce of a pub ic hearing before the City Council on the said
rezoning petitio v��as duly p blished in the official newspaper of the City and
notices were dul mailed to ach owner of affected property and property situated

UIHEREAS, Frank W. Naas (n9726 has petitioned to rezone property from a community business

March, 1983, a smo e detector affidavit signed by the applicant certified that
t'r,ere ere 5 apartrent units in the building. Applicant now indicates he
desire to rezone he property to retain 6 apartment units in the building.
The ap licant appe rs to have created his own hardship by adding residential
units n a commerc ally zoned building without city authorization or permit.
2. Rezoni g the subje t site to an RM-2 classification would create an isolated
apartm nt zone in he comm�anity.
3. Rezoni g the subje t property would be inconsistent with Land Use Plan policy
4.2-1 hicn states "The city will support a diverse commercia1 activity base by
workin with busin ss and community groups to: 1) develop plans for cluster
commer �al areas; ) continue physical improvement programs to reinforce
identi ies 4vhich a tract customers; 3) continuing efforts to encourage small
b�!sin ss; and 4) p oviding assistance to secure business loans and
impro ements.
4. Rezoning the subject property would also be inconsistent with the Economic
Devel ment Strat policies which state:
S . Paul shall base its neighborhood commercial development efforts on a
r cognition o the interdependence between neighborhood commercial areas
a d the adjac nt residential communities.
S . Paul shal continue to give priority to assisting the retention and
e pansion of xisting small commercial firms.

WHEREAS, Pur uant to Minn sota Statutes, § 462.357 and § 64.210 of the
Legislative Code Douglas L. nd Marion B. Scott and Raymond D. Duvall and
Catherine S. Hall duly petiti ned to rezone the north 8 feet of Lot 3 and the
north 8 feet of he west 52.4 feet of Lot 4, High Winds Addition No. 1, located
on an eight foot strip of lan on the north edge of lots at 1685 and 1691
Princeton from R 3 to RT-1 fo the purpose of conveying land to the owner of the
property at 142 ambridge the petition having been certified by the Planning
Division on April 17, 1985, a having been consented to by at least 67% of the
owners of the ar a of the pro erty to be rezoned, and further having been
consented to by t least two- hirds of the owners of the property situated within
100 feet of the otal contigu us property within one year preceding the date of
the petition; an
WHEREAS, The Zoning Commi tee on May 2, 1985, conducted a public hearing for
the purpose of c nsidering th rezoning petition, and pursuant to Section 107.03
of the Administr tive Code, s bmitted its recommendation to the Planning
Commission that he petition e granted; and
WHEREAS, The Planning Com ission considered the rezoning petition at its
meeting held on ay 3, 1985, nd recommended that the City Council approve the
petition; and
WHEREAS, Notice of a publ 'c hearing before the City Council on the said
rezoning petitio was duly pu lished in the official newspaper of the City and
notices were dul mailed to e ch owner of affected property and property situated
wholly or partly ithin 350 f et of the property sought to be rezoned; and
