An Ordinance amending Chapter 60 of the Saint Paul
Legislative Code pertaining to zoning for the City
of Saint Paul and the zoning maps thereof.
WHEREAS, Pursuant to Minnesota Statutes, § 462.357 and § 64.210 of the
Legislative Code, the Housing and Redevelopment Authority duly petitioned to
rezone Lot 18, Block 2, Selby, McClung and VanMeter's Addition, located at 487
Selby Avenue, from RM-2 to P-1 for the purpose of constructing a parking lot, the
petition having been certified by the Planning Division on May 15, 1985, as having
been consented to by at least 67% of the owners of the area of the property to be
rezoned, and further having been consented to by at least two-thirds of the owners
of the property situated within 100 feet of the total contiguous proper�ty within
one year preceding the date of the petition; and
WHEREAS, The Zoning Committee on June 6, 1985, conducted a public hearing for
the purpose of considering the rezoning petition, and pursuant to Section 107.03
of the Administrative Code, submitted its recommendation to the Planning
Commission that the petition be granted; and
WHEREAS, The Planning Commission considered the rezoning petition at its
meeting held on June 14, 1985, and recommended that the City Council approve the
petition; and
WHEREAS, Notice of a public hearing before the City Council on the said
rezoning petition was duly published in the official newspaper of the City on
June 22, 1985, and notices were duly mailed to each owner of affected property and
property situated wholly or partly within 350 feet of the property sought to be
rezoned; and
WHEREAS, A public hearing before the City Council , having been conducted on
June 27, 1985, where all interested persons were heard, and the Council having
considered all the facts and recommendations concerning the petition; now,
therefore,

THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1.
That the zoning map of the City of Saint Paul , Sheet No. 20, as incorporated
by reference in Section 60.301 of the Saint Paul Legislative Code, as amended, is
hereby further amended as follows:
That property located at 487 Selby Avenue, being
more particularly described as Lot 18, Block 2,
Selby, McClung, and VanMeter's Addition, be and is
hereby rezoned from RM-2 to P-1.
Section 2.
This ordinance shall take effect and be in force thirty (30) days from and
after its passage, approval and publication.

An Ordinance amending Chapter 60 of the Saint Paul
Legislative Code pertaining to zoning for the City
of Saint Paul and the zoning maps thereof. -
WHEREAS, Pursuant to Minnes�ota Statutes, § 462.357 and § 64.210 of the
Legislative Code, the Housing and Redevelopment Authority duly petitioned to
rezone Lot 18, Block 2, Selby, McClung and VanMeter's Addition,- located at 487
Selby Avenue, from RM-2 to P-1 for the purpose of constructing a parking lot, the
petition having been certified by the Planning Division on May 15, 1985, as having
been consented to by at least 67% of the owners of the area of the property to be
rezQned, and further having been consented to by at least two-thirds of the owners
of the property situated within 100 feet of the to�al contiguous property within
one year preceding the date of the petition; and
WHEREAS, The Zoning Committee on June 6, 1985, conducted a public hearing for
the purpose of considering the rezoning petition, and pursuant to Section 107.03
of the Administrative Code, submitted its recommendation to the Planning
Commission that the petition be granted; and �
WHEREAS, The Planning Commission considered the rezoning petition at its
meeting held on June 14, 1985, and recommended that the City Coun.cil approve the_
petition; and
WHEREAS, Notice of a public hearing before the City Council orr the said
rezoning petition was duly published in the official newspaper of the City on
June 22, 1985, and notices were duly mailed to each owner of affected property and
property situated wholly or partly within 350 feet of the property sought to be
rezoned; and
WHEREAS, A public hearing before the City Council , having been conducted on
June 27, 1985, where all interested persons were heard, and the Council having

therefore,

A. PURPOSE: Rezone property from RM-2 to P-1 to permit construction of parking lot
accessory to a mixed corr�nercial/residential structure.
B. SUFFICIENCY: Petition found sufficient by Planning Division on May 15, 1985.
P arcels eligible: 32; Parcels needed: 22; Parcels signed: 22.
C. PARCEL SIZE: 40' fronting Selby X 116.75' for 4670 square feet of land area.
D. EXISTING LAND USE: Vacant
E. SURROUNDING LAND USE:
North: Medium Density Residential (RM-2)
East: Mixed uses including commercial interspersed among residential (RM-2)
South: Restaurant, private club, commercial , parking (B-2)
West: Mixed cammercial/residential (B-2)
F. FINDINGS:
1. Petitioner proposes rezoning this residentially zoned land to provide off-
street parking for a mixed commercial/residential building to the west.
Thirteen off-street parking spaces will be provided for a building that
currently operates without on-site parking.
2. The site improvements have been reviewed and approved by the Heritage
Preservation Commission.
3. Approval of a rezoning to P-1 is conditioned on eight findings:
a. The parking lot is accessory to a business use and adjoins the use's zoning
lot, meeting the first condition.
b. The parking lot must remain open on a 24-hour basis to accomodate residents
of the apartment building. Condition two does not apply in this case.
. c. No loading area is shown on the site plan, and the parking space dimensions
are designed only for private passenger vehicles, meeting the third
condition.
d. Petitioner will not use the lot for repair work, service, or sales,
meeting the fourth condition.
e. Petitioner propose no signs on the lot; the fif th condition does not apply.
f. Petitioner propose no buildings on the site; the sixth condition does not
apply.
g. Applicant has submitted site plan that illustrates parking space
dimensions, meeting the seventh condition.

h. The site plan is being reviewed by city staff. The following comments have
been received:
- A performance bond or irrevocable letter of credit must be submitted to
ensure installation of landscaping and obscurring fence.
- The curb-cut must be 23' wide at the property line and constructed
under a permit issued by the Public Works Department.
- A variance must be obtained or required setbacks accorr�nodated. On June
11, I985, the Board of Zoning Appeals will consider relaxing front and
sideyard required in a P-1 zone.
4. The rezoning is consistent with the DistrTCt 8 recommendation: "To make sure
that enough land is set aside for off-street parking ... before all publicly
owned land on Selby Avenue is sold".
G. STAFF RECOMMENDATION: Based on findings 1 through 4, staff recorr�nends approval of
the rezoning to P- , provided that the final site plan camplies with city
standards.
