WHEREAS, Mary C. Schnaith (SBD#153) has submitted the attached
proposed lot split for City Council approval; and
WHEREAS, the Departments of Planning and Economic Development and Public
Works have reviewed the attached lot split at 1165-1167 Bush and 1161 Bush
described as:
Tract A (1165-1167 Bush): "Lot 22, Block 3, Terry's Addition, except
the West 5.55 feet thereof;"
Tract 6 (1161 Bush): "Lot 21 and the West 5.55 feet of Lot 22, Block
3, Terry's Addition, except the West 16,587 feet of said Lot 21,
subject to an easement over the West 3.9 feet of the South 82.15 feet
of the above de�cribed tract;" and
WHEREAS, the proposed lot split meets the requirements of Sections 67.304
and 67.406 of the Zoning Code; except for minimum lot width;
NOW, THEREFORE, BE IT RESOLVED, that the City Council accepts and approves
this lot split, with the following variances: Reduce required lot frontage
for the duplex structure at 1165-67 Bush (Parcel A) from 50' to 44.45' ; a
variance of 5.55' ; and reduce required lot frontage for a single-family
structure at 1161 Bush (Parcel 6) from 40' to 38.96' ; a variance of 1.04' .

A. PURPOSE: Consideration of a lot split with variances to allow separate
ownership of the existing structures.
B. SITE & AREA CUNDITIONS: Parcel A: Two-family dwelliny
Parcel B: One-family structure with attached yarage.
C. MINIMUM LOT REQUIREMENTS: Sinyle family: 40' width; 5,UOU sq. ft. area;
Tide yards. Two family: 50' width; 6,000 sq, ft, area; 9' side yards.

F. FINDINGS:
l . The parcels will conform to the schedule of reyulations for minimum lot area,
setback, and density.
2. N variance of minimum frontaye is required as follows.
Reduce required lot frontage for the duplex structure at 1165-67 Bush (Parcel A)
from 5U' to 44.45' ; a variance of 5.55' .
Reduce reyuired lot frontaye for a sinyle-family structure at 1161 Bush
(Parcel B) from 4U' to 38.96' ; a variance of 1 .04' .
3. The request for variance is based on the existiny physical conditions of the
property and additional lot frontaye is not available. Grantiny a variance of
required lot frontage is therefore consistent with the spirit and intent of the
Zoning Code.
4. Granting a variance of rninimum lot frontage would not impair tfie reasonable use
or enjoyment of adjacent property.
5. Residential structures occupy the site in a manner that is consistent with the
yeneral development of the area. Strict application of minimum lot frontage
reyuirements would deprive the landowner of riyhts commonly enjoyed by other
property owners in the same zoniny district.
G. STAFF RECUMMENDATION: Based on the above findings, staff recommends the lot split
be approved with variance as required.
