CREEKSIDE COURT
WHEREAS, Lancer & Associates (SBD#158) has submitted the attached proposed
preliminary plat for City Council approval; and
WHEREAS, the appropriate City departments have reviewed the proposed
preliminary plat; and
WHEREAS, the proposed preliminary plat has been determined to meet the
requirements of Section 67 of the Zoning Code;
NOW, THEREFORE, BE IT RESOLVED, that the City Council accepts and approves
this preliminary plat for Creekside Court.

Dear Mr . Tedesco :
We held a meeting on the evening of June 18, 1985 ta
discuss the Lancer & Associates praposal to de�elap the
parcel af land adjacent to the Coach Homes of Paxhways.
Representatives of Lancer were present to answer our
questians and address aur cancerns. Our cancerns with the
project are:
Color - We feel that the blue siding which has been
proposed for the de�elopment will not blend in with the
surroundin9 area. The representati�es of Lancer
indicated that the siding has not been ordered yet and
they agreed to change the color to a more compatible
beige color .
Fenc� - Their proposed de�elapment of two and three
bedroom tawnhomes is geared taward families with
children . We ha�e a large courtyard area which we feel
could tend ta become a play area far children in their
complex . We are also concerned with parking for that
de�elapment spilling into our area. We haWe proposed
� that a fence be erected between the two properties
running from Pathways Dri�e to Parkside Dri�e. Lancer
� has agreed to this and stated that they would pro�ide us
�, funds to erect a fence af our choasing.

� Parking - ased on the diagram, we felt that there was
insuffic' ent parking. Lancer indicated that 72 parking
spaces a�e been allowed for , most of which is in
ges or in front af them. The abo�e-mentioned fence
should act as a deterent to spill-aver parking since
walking around a fence is less con�enient than walking
acrass a lawn .
Road - The lacation af Creekside Way running within faur
�-�.�-�y�
feet of aur property line is also an area af conc�rn .
Lancer indicated that the road was designed in this
manner ta meet Fire Department specifications. Based an
subsequent discussion amang oursel�es, we decided that
we could accept the locatian of the raad as long as the
fence was canstructed.
Based on the agreed upon canditions being met , we
recommend appro�al of the praposed de�elopment .

A. PURPOSE: To consider the approval of the final plat for Creekside Court to
permit construction of 24 two- and three-bedroom townhouses.
B. SITE & AREA CONDITIONS: The subject parcel is flat with no trees or shrubs.
Surrounding land uses include:
North: Multi-family (RT-2, RM-3)
East: Battle Creek Junior High (R-2)
West: Single-f amily (R-2)
South: Battle Creek Park (R-2)
C. REQUIRED FINDINGS:
1. All the applicable provisions of the Legislative Code are complied
with.
2. The proposed subdivision will not be detrimental to the present and
potential surrounding land uses.
3. The area surrounding the subdivision can be planned and developed in
coordination and compatibility with the proposed subdivision.
4. The subdivision is in conformance with the comprehensive plan.
5. The subdivision preserves and incorporates the site's important existing
natural features, whenever possible.
6. All land intended for building sites can be used safely without endangering
the residents by peril from floods, erosion, continuously high water table,
severe soil conditions or other menance.
7. The subdivision can be economically served with public facilities and
services.
D. ADDITIONAL FINDINGS: Planning staff has reviewed and approved the site plan
1096 subject to plat approval .
E. STAFF RECOMMENDATION: Based on the above findings, staff recommends approval of
the preliminary plat for Creekside Court.
