City Council member Kiki Sonnen advises me that you have been hired to direct Midway Transitiona7 Living Incorporated and has requested that I �bring yau up to date on the zoning and licensing issues associated with this property. The site is zoned for general business use (B-3). A tist of land uses allowed in a general business zone (B-3) is enclosed for your reference. , During the past several months, inquiries for zoning information have focused on four uses of the property. 7hese include a: 1) hotel ; 2) community residen�ial facility; 3) room and board facility, or 4) mixed commercial/residential structure. A summary of these four uses follows: 1. Notel A hotel is a �principal use permitted in a general business (B-3) zoning district where your building is located. No further zoning approval is required. A hotel license is required. Please note that if the City Council grants a hotel license, you wtll be required to operate in strict accordance with Chapter 407 of the St. P aut Legislative Code which defines "Hotel" as "every building or structure, � kept, used, maintained, advertised, or held out to the public to be a place where sleeping or rooming accorr�nodations are furnished to the generaT public for a shorter period of time than one week, whether with or without meals". 2. Community Residential Facilitv A community residential facility is a use permitted in the general business zoning district (B-3) subject to special conditions. To be considered as a community residential facility, the program must be either licensed by the State of Minnesota or be a bona-fide room and board facility that is recognized by resolution of the Ramsey County Board of Cor�anissioners as a resource eligible for public reimbursement. A full description of the zoning requirements to establish a room and board facility is outlined later in ' ` this letter. � On February 22, 1985, the Planning Commission determined that a special condition use permit eannot b� granted at the subject site because the proposal failed to meet the conditions set forth in Section 60.423(3) of the Zoning Code. Additionally, it now appears that allowing the property to be used as a licensed community residential facility wouid be contrary to State Statute 245.812. This law requires the county to provide assurances it will not permit a new facility in a planning district where additional development would create an overconcentration of facility residents. Therefore, the Planning Division will recommend against issuing a conditional use permit for any licensed community residential facility at this location. 3. Room & Board Facility Room and Board facilities are not permitted in the general business (B-3) zoning district. To establish a room and board facility would require rezoning the property to a multi-family zon9ng classification (RM-2). Zoning Code section 64.400 requires that the owner of the property obtain the consent signatures of two-thirds of the owners of all prqperty situated within 100' of the parcel in order to file for consideratian of rezoning. Without these signatures, an application cannot be filed. Processing this petition begins seven working days after receipt of the petition in our office with the appropriate fee. The total process time is approximateiy three months. If the zoning change is approved you must acquire � special condition use permit, and a Rooming/Boarding House license must also be obtalned from the Gity of St. Pau� License Division, 203 City Hall. 4. Mixed Comnercial/Residential Structure A mixed commercial/residential r structure is allowed in a general business district provided that residential dwellings are li�ited to the second and third stories and not more than 50� of the first floor. The Zoning Code defines a dweliing as a portion of the building designed exclusively for and occup9ed by a family for residential purposes and having cooking facilities. I have enclosed copies of pertinent City and State legislation regarding the above cited issues. I hope this clarifies some options for you.
