WHEREAS, the City of Saint Paul through its Division of Parks and
Recreation provides a variety of special events for youth,
including soccer programs at various recreation centers; and
WHEREAS, Saint Paul Parks and Recreation Division is in need of
soccer goals for its Fall soccer programming; and
WHEREAS, Highland Groveland Recreation Association owns soccer
goals which it uses during the summer, but which are available
during the Fall; and
WHEREAS, Highland Groveland Recreation Association is willing to
give permission to Parks and Recreation to use its soccer goals
during the Fall soccer programming, but wishes to be indemnified
for any injuries which occur during their use; and
13 WHEREAS, the Saint Paul City Council finds that encouraging youth
14 participation in athletic events is a legitimate public purpose
15 which serves the youth population and fosters stronger
16 communities within the City; and,
17 WHEREAS, the expenditure o£ public funds, which includes the
18 promise of indemnification and defense, for such a purpose will
19 facilitate and enable it to take place, nor therefore, be it
2� RESOLVED, that the City of Saint Paul shall defend, indemnify and
21 hold harmless Highland Groveland Recreation Association from any
22 claims, suits or judgments arising or resulting from the City's
23 use of Highland Groveland Recreation Association's soccer goals
24 during the Fall soccer program; and be it

25 FURTHER RESOLVED, that nothing in the foregoing provision shall
26 be construed as a waiver of the municipal tort liability limits
27 set forth in Minn. Stat. §466.01 et seq. nor of the immunities
28 and defenses provided therein.
