An Ordinance amending Chapter 60 of the Saint Paul
Legislative Code pertaining to zoning for the City of Saint
Paul and the Zoning maps thereof.
WHEREAS, the Planning Commission has made a survey of the 40-acres including
the Old Gillette Hospital site, northeast of the corner of Ivy Avenue and
Forest Street for the purpose of considering amendment to the Zoning Ordinance
of the City, and has determined that the number of real estate descriptions
affected by the proposed changes would render obtaining written consent to be
impractical ; and
WHEREAS, the Planning Commission, following public hearings held for that
purpose, has recommended that the zoning code be amended, and the City
Council , having considered the report and recommendations of the Planning
Commission, and having conducted a public hearing on the proposed zoning code
amendments, does hereby amend the Zoning Code pursuant to the authority
granted by and in accordance with the procedures set forth in Minnesota
Statutes § 462.357; and
WHEREAS, the legal description of the property deeded to the City of Saint
Paul from the State of Minnesota differs slightly from the City's survey, and
as new State Legislation would be necessary to correct this minor difference
which will have no substantial effect on the proposed project, the legal
description should read as set forth below, with all other conditions set
forth in full force and effect.

That the Council of the City of Saint Paul does hereby amend the Saint Paul
Zoning Ordinances by amending the zoning classification for the following
property on the zoning maps of the City of Saint Paul , Sheet No. 6, as
incorporated by reference in Section 60.301 of the Saint Paul Legislative
Code:

Attached for your review and action is the recommendation of the Planning
Commission for rezoning 5 acres of the Old Gillette Hospital site near Lake
Phalen to allow the development of approximately 138 units of elderly housing.
This development will also include the reuse of the historic west wing of the
Old Gillette Hospital as housing.
The project proposed has been extensively reviewed by the District 5 Corranunity
Council and its Gillette Task Force and has the approval of these groups. The
development is consistent with the City' s comprehensive plans and contributes
significantly to meeting the City' s goal of 10,000 new housing units by the
year 1990.

WHEREAS, the District 5 Community Council has reviewed and ap�roved the

4�HEREAS, the Zoning Committee of the Planing Corr�nission has reviewed the
proposed rezoning and has recommended it to the Planning Commission for
approval ; and
WHEREAS, pursuant to Minnesota Statutes Section 462.357(5), the Planning
Commission held a public hearing at its January 11 , 1935 meeting; and
WHEREAS, the Planning Correnission has determined:
1. That the number of real estate descriptions affected by the amendments
renders the obtaining of written consent impractical ;
2. That a survey of an area in excess of 40 acres has been made;
3. That a determination has been made that the amendments to the Zoning
Code proposed are related to the� overall needs of the co�nunity, to
existing land use, and to a plan for future larid use; and
4. That pursuant to State Statutes proper notice of the hearing was given
in the Pioneer Press and Dispatch on December 21 , 1984, December 28,

6. STAFF INVESTIGATION & REPORT: DATE 1/21/85 BY Anne Kelly
A. PURPOSE: To rezone property from R-3 to RM-3 for the purpose of developing
approximately 138 units of elderly housing in two new buildings and renovating the
historic west wing of Old Gillette Hospital .
B. 40-ACRE STUDY:
Study Initiation: On August 12, 1983, the Planning Corr�nission unanimously adopted
Resolution #83-34 to initiate this 40-acre study.
40-Acre Study: Minnesota Statutes Section 462.357, Subd. 5, permits St. Paul to
amend its Zoning Code without obtaining consent petitions when all of the following
conditions are met.
1. The whole area of the city or an area of not less than 40 acres has been
surveyed.
2. The number of real estate descriptions affected by zoning changes and
alteratiotns renders the obtaining of written consent impractical .
3. The Planning Corranission reports in writing as to the proposal 's relationship to
the overall needs of the comnunity, to existing land use or to a plan for
future land use.
4. A public hearing on the proposed ordinance, changes, or alterations is
conducted with notice of the time, place, and purpose of the hearing published
at least once a week for three successive weeks prior to the public hearing.
C. FINDINGS:
l. In accordance with the requirements of the statute governing the 40-acre study
outlined above:
a. The area considered is more than 40 acres.
b. Because the City also owns the contiguous property, Phalen Park, the number
of property owners from whom consent signatures would be required under the
usual procedure would be extraordinarily large and impractical .
c. The proposal is consistent with Planning Commission reports, especially the
Comprehensive Plan as detailed below.
d. A public hearing has been set for January 11, 1985, with proper notice
published December 21, 28, 1984, and January 4, 1985. In addition,
notification of the public hearing was mailed to owners of all property
within 350 feet of the property to be rezoned.

2. Proposed Land Use. The actual development area of the proposed project is 5
acres. The project will involve three structures: one highrise, one lowrise,
and the renovated west wing. The remaining area will be open space dedicated
to the City of St. Paual on the final plat for park purposes. The Division of
Parks and Recreation presently maintains the open space area and has agreed to
continue doing so.
3. Citizen Participation. The Saint Paul Department of Planning and Economic
Development has been working to find a suitable development for this site for
some time. Several projects have been proposed which did not meet with
neighborhood approval . This project, however, has received the approval of the
District 5 Council and surrounding neighborhood residents. Additionally, it
meets some important City goals outlined in Planning Commission studies.
4. Plannin Commission Studies. The proposed project is generally consistent with
the aint Paul Comprehensive Plan Land Use and Housing components, especially
Objective 7: "All residents of Saint P aul will have reasonable access to
decent, desirable housing in a suitable residential environment", and the
following policies:
a. Land Use. 4.5-3: "The city in conjunction with the neighborhood and
district council involved will investigate appropriate reuses for vacated
institutional buildings and land giving first consideration to parks only
if specifically called for in the Parks and Recreation Plan and otherwise
giving preference to residential uses or mixed use development".
4.1-3: "On those large vacant sites suitable for residential use the city
will encourage medium to high density housing development".
b. Housin . 1.2-1: "The city will continue to support reuse, rehabilitation,
and restoration instead of demolition in designated heritage preservation
sites and districts ...".
1.4-2: "Projects receiving public financial support will be required to
demonstrate excellence and innovation in design".
2-3: "The city should support development of rental housing in appropriate
locations. A balance should be realized in new development between
erection of new ownership opportunities and continued rental development".
3-4: "Continue to support the development of assisted housing for elderly
households only in those neighborhoods where the existing supply is low and
where demand is apparent".
3-5: "Increase congregate living opportunities for elderly households in
St. P aul".
In housing policy 1-5C, the intent is to encourage high density housing near
downtown and major activity centers, although appropriately sited and reviewed
high density projects such as this one are not ruled out.
1-5C: "High density housing consisting primarily of one and two bedroom
units should be developed in and around the downtown area and within other
high density activity center(s)".
In sum, the intentions and policies of the city as stated in its Comprehensive
Plan arre well met in this project proposal .
5. The intent of the RM-3 district is to provide sites for high-density multiple
dwelling structures serving the residential needs of apartment type of
accomodation with central services. Although this zoning is usually near major
shopping centers this zoning has been used for the elderly highrise projects in
St. P aul . The highrise nature of the distsrict is provided to allow for
greater density with lower coverages, which will in turn result in more open
space on lands which would normally require more intensive development.
D. RECON�IENDATION: Based on findings 1 through 5, staff recommends the rezoning of
the property legally described above from R-3 to RM-3.
