WHEREAS , Northern States Power Company (NSP) filed with
the Minnesota Public Utilities Commission on February 28 , 1985,
a request for a gas general rate increase (MPUC Docket No.
G-002/GR-85-108) ; and
WHEREAS , the Council of the City of Saint Paul adopted
on February 12, 1985, ordinances granting to NSP franchises
to supply gas (Ordinance No. 17210) and electricity (Ordinance
No. 17211 ) within the City of Saint Paul ; and
4UHEREAS , the City Council , at the time the above ordinances
were adopted, did not know about this proposed rate increase
and has had no opportunity to consider what impact this proposed
increase may have on City residents or on City revenues from
the gross earnings fees specified in the above franchise ordi-
nance; now, therefore, be it
RESOLVED, that the City Council reconsider the terms and
conditions of the above franchise ordinances , which relate
to the design of the gross earnings fee; and, be it
FURTHER RESOLVED, that the City Council direct City staff
to reopen negotiations with NSP on the terms and conditions
of the above gas and electric franchise ordinances that relate
to the design of the gross earnings fee.

WHEREAS, the City Council, at th time the above ordinances were adopted, did

WHEREAS,the procedure specified in the Ci Charter for approval of franchise
ordinances has not been completed for the a ove franchise ordinances, and the
City Council has stated its intent to amend he above gas franchise ordinance
as a condition of its approval by means of a solution (C.F. 85301 )adopted
by the City Council on February 28, 1985; now, herefore, be it
RESOLVED, that the City Council reconsider the term and conditions of the
above franchise ordinances, particularly those terms and conditions which re-
late to the design of the gross earnings fee; and be
FURTHER RESOLVED, that the City Council direct City staff o reopen negotia-
tions with NSP on the terms and conditions of the above ga and electric fran-
chise ordinances; and be it

84-1366 -gas; Ordinance 0.84-1367 -electricity) be extended until June 30, 1985,
