M^ ADDENDUM 9Q- q 3 5 On November 5, 1997, Shawna Bradlich was a passenger in a pick-up truck driven by Jessie Sutheriand. At the intersection of Snelling Avenue and Engiewood, Sutherland's vehicle struck the left rear corner of a St. Paul Public Works tandem truck which was driven by Patricia Legato, an employee of the City of St. Paul. Ms. Legato was traveling eastbound on Englewood which is controlled by a stop sign at Snelling. Ms. Legato has testified she stopped, but did not observe the Sutherland vehicle, so she proceeded across the intersection. Jessie Sutherland was traveling northbound on 5nelling and a witness has reported that Sutherland may have been speeding. Sutherland did not observe the tandem truck crossing Snelling in front of him until shortly before the accident. Sutherland's vehicle was also heavily loaded with construction materials which may have inhibited braking. Ms. Bradlich claims as a result of this accident she sustained injury to her neck, back, jaw and knees and has sought medical and chiropractic treatment for these injuries. Her doctors believe Ms. Bradlich has suffered permanem injuries to her back, neck and jaw. Following the accident, Ms. Bradlich also claims she could not continue in her job as a roofer, thus she quit and has lost approximately $50,000 in income because of this. Ms. Bradlich has brought suit in State District Court against Jessie Sutherland, Patricia Legato and the City of St. Paul. Following a pretrial conference scheduled in this matter the parties discussed settlement and have agreed to a proposed settlement of $20,000. The City of St. Faul would contribute $10,000 and Jessie Sutherland would also contribute $10,000. This office recommends approval ofthe settlement.
