by Danie and Debra Miner
Daniel Miner and h ' s wife, Debra, brought a lawsuit agains the
City of Sain Paul and Police Officers Krismer and Toronto claiming
that the off ' cers sed excessive force when arresting Dani 1 Miner
for speeding and d iving while under the influence of alco ol.
While resist ' ng th t arrest Daniel Miner was hit on the he d with
a flashlight which tore through the cartilege of his ear. Plaintiff
claimed dama es fo injuries including pain, suffering, pa t, present
and future m dical bills, permanent scarring, humiliation nd
mental angui h in xcess of $50, 000 . He also requested pu itive
damages agai st th officers in excess of $50, 000 , plus at orney' s
fees and cos s .
Therefore, t is of ice approves the settlement of the matt r for
the amount o $3 , 4 0 .
