This lawsuit rose ut of a DWI arrest on July 29, 1983 . P aintiff
Jeffrey spind er wa arrested for DWI by Officer Kevin Dani ls,
a St. Paul po ice K 9 officer. Spindler blew a . 25 on the reathalyzer
and subsequen ly pl d guilty to over . 10 .
During the ar est, he plaintiff was bitten by the police K 9 .
According to he of icer, plaintiff shoved him in an attemp to
escape, and r n. T e police canine burst throuqh the glass (window
was up) of th rear passenger door of the squad. According to
plaintiff he id no assault the officer nor attempt to esc pe,
but was merel stan ing next to the squad when bitten.
The squad was not e uipped with metal screening on the side windows
as K-9 squads usual y are. The screening was on back order and
the squad had only een on the street for two days . Such s reening
is to insure� that o citizen sticks his/her hand in the sq ad
window when t e gla s is rolled down ( for ventilation) . Th metal
screening is ot to insure that the dog not leap through th glass,
as such an oc urrence has not been known to happen before.
Plaintiff has a per anent small scar on his right upper arm.
Other than initial ou�d cleaning and tetanus shot, no furt er
medical treat nt was required.
Plaintiff has greed to settle his claim in full for $1. 000 .
