to the To n of t. Paul and west of the extended
center li e o.f acated Madison Street; and also,
the easem nt in the land necessary for the slopes, cuts
and fills, incl ding the right of removal of lateral
support f om su ject lands or remainder thereof
occasione by e cavations thereof or construction
of slopes in th grading of said street lying within
the vacat d are .
Subject express y to he following conditions and reservation :
l. That he va ation be subject to all the terms and c nditions
of Chapter 130, codified March l, 1981, of the St. Paul Legis ative
Code.
2 . Based on utility easement Certificates of Intended on-
Use filed on be alf o Northwestern Bell Telephone Company,

the necessary p rmits for and shall pay all costs and expense
incurred as a r sult f the removal of existing Ci�y street s gns
within �he vaca ed ar a. Removal of said signs must be compl ted
�o the satisfac ion o the Department of Public Works, Traffic
Operations Divi ion.
5 . That he pe itioner pay to the City of Saint Paul t e sum
of $26, 910 . 00 a comp nsation for the vacation. Said compens tion
shall be due an paya le within 60 days of the effective date of
this resolution.
6 . That e petitioner, its successors or assigns, by
acceptance of t ter s and conditions of this vacation, agre s to
indemnify, defen and ave harmless the City of Saint Paul, i'-s
officers and emp oyees from all suits, actions or claims of a
character, inclu ing b t not limited to any claim brought
because of any i jurie or damages received or sustained on
account of this acati n, by any person, persons or property; r
because of any a t or mission, neglect or misconduct of said
petitioner; or b cause of any claims or liability arising from or
based on any vio ation of any law or regulation made in accord nce
wi�h the law whe her b the petitioner or any of its agents or
employees.
