That the petitioner's, their successors and assigns shall pay $500.00 as an administrative fee for
this vacation which is due and payable within 60 days of the effective date of this resolution.
That the petitioner receives a setback variance and site plan approval.
That a permanent utility easement sha1I be retained within the vacated area to protect the interest
ofNorthern States Power Company.
That a permanent utility easement shall be retained within the vacated area to protect the interest
of U.S. West Communication, Inc.
That the petitioners, their successors and assigns agree to indemnify, defend and save harmless
the City of Saint Paul, its officers and employees from a11 suits, actions or claims of any chazacter
brought as a result of injuries or damages received or sustained by any person, persons or
property on account of this vacation or petitioners' use of this properiy, including but not limited
to, a claim brought because of any act of omission, neglect, or misconduct of said petitioners or
because of any claims or liability arising from any violation of any law or regulation made in
accordance with the law, whether by the petitioners or any of their agents or employees.
That the petitioners, their successors and assigns shall, within 60 days of the effective date of this
resolution, file with the City Clerk an acceptance in writing of the c6nditions of this resolution

and sha11, within the period(s) specified in the terms and conditions of this resolution, comply in
all respects with these terms and conditions.
The vacated right of way accruing to Hamline University shall not be considered for the purposes
of compliance with provisions of the Saint Paul Zoning Code, including setback calculations, to
constitute an expansion of Hamline University's campus boundaries. Any use of the vacated
former right of way for any Zoning Code purposes shall require prior approval of a new or
expanded campus boundazy in compliance with Saint Paul Legislative Code § 60.415(7)
8. A copy of this resolufion sha11 be forwarded to the Saint Paul Plamung Administrator (PED) and
the Saint Paul Zoning Adininistrator (LIEP) for inclusion in each departmenYs Hamline
University files.

There aze four mid-block bouses on W. Minnehaha Uiat abut the alley proposed to be vacated. The
houses ali currendy use alley access to reach their off-street parking spaces and garages. The oCf'-street
pazkuig spaces are required by the Zoning Code. If the alley is vacated, the City needs co impose a
condition thst the off-street parking must be maintained as lo�g as thc houses remain and that the parking
spaces must be granted access.
The alley vacation proposal is related to a major and controversial zoning ease, on whicl� we expect to
receive ui application in the neaz future. As designed, the proposed student apartment building requires
a modification of ttie buitding setback standard from the eastem campus boundary along Pascal. TE�e
Planning Gommission has the authority to grant ar deny tl�e modification, and their decision is subject to
nppeal to the City Council.
Moreover, the a(ley becomes directly involved in the zoning case. "Loning roles are different for college
campuses than for the sunrounding residential neighborl�ood. Lach eampus in Saint Paul l�as a defined
campus boundary. Tn tltis case the boundary is the northern edge of the alley. PED staff is
recommending to Hamline University diat they apply to the Planning Commission m extend their
campus boundary to incorporate the whole alley into the c<vnpus when they apply for the setback
modification for the apartment building. ?han the Planning Commission can hold a single public l�earing
to act on Uoth matters.
In conclusion, PED does not objece to the alley vacation provided that Haznline Universiry (the owner) is
legally required to provide access to requirod off-sfreet pazking for the properties on W. Minnehaha Ave.
For poticy coosistency, it would be desirable to Schedule the alley vacation and the apartment zoning
case in the same time frame so that the City Council can make sure that the two decisions fit togethor.

The vacated right of way accruing to Hamline University shall not be considered for the purposes

constitute an expansion of Hamline University's campus boundaries. Any use of the vacated
former right of way for any Zoning Code purposes shall require prior approval of a new or
expanded campus boundazy in compliance with Saint Paul Legislative Code § 60.415(7)
8. A copy of this resolufion sha11 be forwarded to the Saint Paul Plamung Administrator (PED) and
the Saint Paul Zoning Adininistrator (LIEP) for inclusion in each departmenYs Hamline

There aze four mid-block bouses on W. Minnehaha Uiat abut the alley proposed to be vacated. The
houses ali currendy use alley access to reach their off-street parking spaces and garages. The oCf'-street
pazkuig spaces are required by the Zoning Code. If the alley is vacated, the City needs co impose a
condition thst the off-street parking must be maintained as lo�g as thc houses remain and that the parking
spaces must be granted access.
The alley vacation proposal is related to a major and controversial zoning ease, on whicl� we expect to
receive ui application in the neaz future. As designed, the proposed student apartment building requires
a modification of ttie buitding setback standard from the eastem campus boundary along Pascal. TE�e
Planning Gommission has the authority to grant ar deny tl�e modification, and their decision is subject to
nppeal to the City Council.
Moreover, the a(ley becomes directly involved in the zoning case. "Loning roles are different for college
campuses than for the sunrounding residential neighborl�ood. Lach eampus in Saint Paul l�as a defined
campus boundary. Tn tltis case the boundary is the northern edge of the alley. PED staff is
recommending to Hamline University diat they apply to the Planning Commission m extend their
campus boundary to incorporate the whole alley into the c<vnpus when they apply for the setback
modification for the apartment building. ?han the Planning Commission can hold a single public l�earing
to act on Uoth matters.
In conclusion, PED does not objece to the alley vacation provided that Haznline Universiry (the owner) is
legally required to provide access to requirod off-sfreet pazking for the properties on W. Minnehaha Ave.
For poticy coosistency, it would be desirable to Schedule the alley vacation and the apartment zoning
case in the same time frame so that the City Council can make sure that the two decisions fit togethor.

expanded campus boundazy in compliance with Saint Paul Legislative Code § 60.415(7)

Simpson and Pascal (TMS File # 3-99)
There aze four mid-block bouses on W. Minnehaha Uiat abut the alley proposed to be vacated. The
houses ali currendy use alley access to reach their off-street parking spaces and garages. The oCf'-street
pazkuig spaces are required by the Zoning Code. If the alley is vacated, the City needs co impose a
condition thst the off-street parking must be maintained as lo�g as thc houses remain and that the parking
spaces must be granted access.
The alley vacation proposal is related to a major and controversial zoning ease, on whicl� we expect to
receive ui application in the neaz future. As designed, the proposed student apartment building requires
a modification of ttie buitding setback standard from the eastem campus boundary along Pascal. TE�e
Planning Gommission has the authority to grant ar deny tl�e modification, and their decision is subject to
nppeal to the City Council.
Moreover, the a(ley becomes directly involved in the zoning case. "Loning roles are different for college
campuses than for the sunrounding residential neighborl�ood. Lach eampus in Saint Paul l�as a defined
campus boundary. Tn tltis case the boundary is the northern edge of the alley. PED staff is
recommending to Hamline University diat they apply to the Planning Commission m extend their
campus boundary to incorporate the whole alley into the c<vnpus when they apply for the setback
modification for the apartment building. ?han the Planning Commission can hold a single public l�earing
to act on Uoth matters.
In conclusion, PED does not objece to the alley vacation provided that Haznline Universiry (the owner) is
legally required to provide access to requirod off-sfreet pazking for the properties on W. Minnehaha Ave.
For poticy coosistency, it would be desirable to Schedule the alley vacation and the apartment zoning
case in the same time frame so that the City Council can make sure that the two decisions fit togethor.

attached Council Resolution. The purpose of the resolution is to vacate the alley to allow
Hamline University to construct an apartment building for student housing. I have
enclosed photocopies of the Green Sheet, the Council Resolution and a map of the area to
be vacated. Please let me know if there is any additional information you might need.
The resolution is currently being routed for signatures along with the responses from the
utilities and other pertinent information.
