RESOLVED, That after a hearing and consideration of
the petition of omo-Northtown Credit Union, per Fin nce
File No. 22- 986, or the vacation of part of the alle in
Block 60 Hag rman' Subdivision, all bounded by Lexing on,
Hatch, Front and hurchill, the City Council of the ity
of Saint Pau her by vacates and discontinues as a pu lic
alley, the p opert more snecifically descri�ed as follow :

permanent ease ent f r surface storm water drainage purposes,
by recordable eed, n, over and across the following descri ed
land:
Exce t Lex ' ngton Parkway, the north 20
feet of Lo 11 and the north 20 feet of
Lots 12 an 13 , Block 60 of Hagerman' s
Subd' visio of Lot 60 of Lake Como Villas .
The above desc ibed asement shall be subject to the approval
of the City At orney and the Director of the Department of
Public Works .
3 . That a specifi ease ent be retained within the vacated area,
to protect the inter st of Northern States Power Company.
4 . That the petit ' oner ay $2 , 440 . 00 as compensation for this
vacation which is du and payable within 60 days of the
publication da e of his resolution.
5 . That the petit ' oner, its successors or assigns, by acceptance
of the terms a d con itions of this vacation, agrees to inde nify,
defend and sav harm ess the City of Saint Paul, its officers
and employees rom a 1 suits, actions or claims of any char ter
brought as a r sult f injuries or damages received or sust ined
by anyperson, erson or property on account of this vacati n
including but ot li ited to a claim brought because of any act
of omission, n glect or misconduct of said petitioner or because
of any claims r lia ility arising from any violation of an
law or regulat ' on ma e in accordance with the law whether b
the petitioner or an of its agents or employees.
