WHEREAS, P rsuant to Min esota Statutes, § 462.357 and § 64.210 of the
Legislative Co�e, Jos ph M. nd Mary Ann C. Jelinek duly petitioned to rezo e
1174 West Seventh St et, lo ated on the south side between Tuscarora and W tson,
from 6-2 to B-� for t e purp se of establishing a used vehicle sales lot; he
petition having been ertifi d by the Planning Division on October 14, 1986 as
having been consented to by t least two-thirds of the owners of the area o the
property to belrezone , and urther having been consented to by at least 67 of
the owners of the pro erty s tuated within 100 feet of the total contiguous
property withir� one y ar pre eding the date of the petition; and
WHEREAS, The Zoni g Comm ttee on November 20, 1986 conducted a public h ring
for the purpos� of co sideri g the rezoning petition, and pursuant to Secti n
107.03 of the Adminis rative Code, submitted its recorrnnendation to the Plann'ng
Commission that the p tition be granted; and
WHEREAS, The Plan ing Co ission considered the rezoning petition at its
meeting held onI Novem er 21, 1986 and recommended that the City Council appr ve
the petition; and
WHEREAS, No�tice o a public hearing before the City Council on the said
rezoning petition was duly p blished in the official newspaper of the City o
November 29, 19�6 and notices were duly mailed to each owner of affected pro erty
and property situated holly r partly within 350 feet of the property sough to
be rezoned; and,
WHEREAS, A public earing before the City Council , having been conducted on
December 11 , 19$6 wher all i terested persons were heard, and the Council h ving
considered all the fac s and ecommendations concerning the petition; now,

On November 20, 198 , the Zo ing Committee of the Planning Commission held a pub ic
hearing on thi� rezoni g. At t e close of the public hearing, the Committee voted 6 to 0 to
approve the rezoning ased on staff findings.
On November �1, 1986 the Pla ning Commission upheld the Zoning Committee's
recommendation on a nanimo s voice vote.
This rezoning �s sched led to b heard by the City Council on December 11, 1986. Ple se
notify me by Decembe 9, 1986 if any member of the City Council wishes to have slid s of
the site presented at t public hearing.

WHEREAS, Joseph M. a d Mary Ann C. Jelinek, File #10000 has petitioned to rezone 11 4 West
Seventh Street s�tuated n the so thwcst side between Watson and Tuscarora from B-2 to B-3 for
the purpose of establish'ng a sec ndhand motor vehicle sales lot; and
WHEREAS, the �oning ommitt e of the Planning Commission on November 20, 1986, h ld a
public hearing ajt which all pers ns present were given an opportunity to be heard pursu nt to said
application in accordan e with t e requirements of Section 64.400 of the Saint Paul Legi lative
Code; and
WHEREAS, Sair�t Paul lanning ommission, based on the evidence presented to its Zon ng
Committee at the public hearing as subsequently reflected in the minutes, made the foll wing
findings of fact:
1. The applica�t's pro erty wa vacant less than one year before the applicant was app oached to
rent it as a used ve icle lot. There is an existing two-story 30' x 60' warehouse attac ed to a
single story �41' x 28 office uilding in the middle of the parcel. Display area for u ed
vehicles would be t the eas and south of the building and employee-customer park ng would
be to the south.
2. Other uses permitte in the -3 zoning district include retail uses, showrooms, work hops,
parcel deliv�ry servi ce, cont actor's shops and manufacturing of small precision goo s.
Conditional uses in lude ne and used car sales, fast food and drive-in restaurants nd vet
clinics.
3. West Seventh Street is classi ied as a minor arterial B street; land uses adjacent to th se streets i
are generally comm rcial. I this area of West Seventh Street are found both comme cial and �I
residential ulses.
4. The City's Compreh nsive P an's land use section recommends development of comp tible
mixed uses along ex sting co mercial strips.
5. The District 9 physi al plan recommends encouraging commercial uses along West Se enth
Street.
6. The proposeid rezon ng woul increase the diversity of services offered in the area.

The applican was pr sent. T ere was no opposition present at the hearing.
Ms. Datsko showed sl des of t e site and reviewed the staff reports with recommenda ions
for approval. She sta ed that n #10000 one letter was received in opposition. She al o
stated that shle is add ng one ore condition to #10004 that the number of used vehic es on
the lot be limited to 0 at any time.
Richard Glassman, 2 50 W. 7t St., attorney with the firm Nilba and Frisch, represen ing
both the Jelineks and Mr. Tho as, stated that the applicants can comply with all staf
recommendation's im osed. T e lot has been paved: No one that they have been in c ntact
with is in opposition. No aut work will be done on the property. 'The space in the
building will be used only for storage. The legal description on the staff report is
incorrect; Ms. Datsko stated s e would correct that. They will be doing additional
landscaping. Mr. Gla sman re erred to the site plan and stated that in the area befor the
fence gates there is r om eno gh for two additional parking spots. He briefly went o er
the staff reports and tated th y will comply to all conditions, etc.
Mr. Pangal asked Mr. lassma if he was aware of the additional condition of limiti the
number of vehicles o the lot o 20. Mr. Glassman answered yes, and that number is more
than they ant�cipate aving. he lot will accommodate no more than 20.
Ms. Zieman a ked Mr Thoma what he plans on doing with the warehouse. Mr. Thom s
stated that he plans o using i for storage. The upstairs is empty and he plans on lea ing
it empty. Ms. Ziema asked r. Thomas if he would be displaying cars in the wareho se.
Mr. ?homas a swere no, it is hard for cars to get in and out of the building without
scratching th m.
Hearing no f rther t timony Mr. Pangal closed the public hearing portion of the me ting.
Ms. Summers made a otion t recommend approval on the Jelineks' rezoning petitio
based on staff findin s .1 thro gh 5, that West Seventh Street is a mixed residential-
commercial use strip nd that the proposal would increase the diversity of services of ered
in the area. Mr. Lev seconde the motion, which passed on a unanimous voice vote.
