of Sai t Paul nd the zoning maps thereof.
WHEREAS, Pursuan to Mi esota Statutes, § 462.357 and § 64.210 of the
Legislative Code, Co o North own Credit Union duly petitioned to rezone 982
Lexington Parkway, 1 cated the east side between Front and Hatch Streets and
1085 Front Avenue, 1 cated the north side between Lexington and Churchil
Streets, from RT-1 t B-2 f r the purpose of permitting a building and par ing lot
expansion; the petition havi g been certified by the Planning Division on 0 tober
14, 1986 as having b en cons nted to by at least two-thirds of the owners o the
area of the property to be r zoned, and further having been consented to by at
least 67% of the own rs of t e property situated within 100 feet of the tot 1
contiguous property ithin o e year preceding the date of the petition; and
WHEREAS, The Zoning Com 'ttee on November 20, 1986 conducted a public h aring
for the purpose of c nsideri g the rezoning petition, and pursuant to Secti n
107.03 of the Admini trative Code, submitted its recommendation to the Plan ing
Commission that the etition be granted; and
WHEREAS, The Pla ning C mission considered the rezoning petition at it
meeting held on Nove ber 21, 1986 and recommended that the City Council app ove
the petition; and
WHEREAS, Notice f a pub ic hearing before the City Council on the said
rezoning petition wa duly p blished in the official newspaper of the City n
November 29, 1986 an notice were duly mailed to each owner of affected pr perty
and property situate wholly or partly within 350 feet of the property soug t to
be rezoned; and
WHEREAS, A publi hearin before the City Council , having been conducte on
December 11 , 1986 wh re all 'nterested persons were heard, and the Council aving

1. The applicant opera es the e isting credit union at the northwest corner of Lexingt n and
Front Aven e. At t is time he credit union is proposing a 2,050 square foot buildi g
addition wi� two d ive-up 1 nes and 15 additional parking spaces. Two abutting r sidential
lots have bc n purc ased an plans are to sell and move the existing structures. Th se two
lots are the �ubject f this r zoning petition.
2. 'The proposa� maint ins a 28 parkway setback along Lexington Avcnue and provide access to
the drive-up from L xingto . A new curb cut from Front Avenuc allows access to t e new
rcar parking, lot. A ' 6" scr ening fence will be placed at the north and east prope ty lines.
3. Parking standards c n be m t with 22 off-street parking spaces; the site plan indica es 24
spaces. Thc City's t affic e gineering department has detcrmined that the number f stacking
spaces for tlie drive up meet current City policy.
4. To implemc#�t the p oposal, he portion of the alley south of 982 Lexington must be vacated.
This procedure was tarted nd the vacation plan will be reviewed by the City Cou cil on
December l �, 1986.
5. The intent qf the B 2 distri t is to serve the needs of a consumer population longer han that
served by t�e B-1, 1 cal busi ess district, and is characterized by a cluster of establ shments

traffic from'Energy Park Dr've (the I-1 uses at Energy Park). Between Minnehaha nd
Horton, Lexington h s an av rage daily traffic volume of 17,875 vehicles (11/84 fig res). It is
classified as a mino arterial B street connecting one community to another within t e same
subregion. This typ of acce s is appropriate for the proposed expansion.
6. Other uses p rmitte in a B- district include retail businesses and service establish ents,
restaurants, �rivate lubs, th aters or assembly halls, business schools and food cater ng
establishments.
7. The City's Compreh nsive P n's land use policy states that "the city ... through ... zo ing will
encourage businesse to redu e traffic and parking problems."

The applicant was pr sent. T ere was opposition present at the meeting.
Ms. Datsko showed sl des of t e site and reviewed the staff report with a recommend tion
for approval. She sta ed that istrict 6 called with a statement in support.
Ms. Zieman asked as d Ms. atsko if a credit union is as same as a bank. Ms. Datsk
answered yes, as far s the Z ing Code. Ms. Zieman stated that Ms. Datsko pointed ut
that a bank could go nto B-1. Ms. Datsko stated that the credit union property is no B-2,
the rezoning would b adding B-2 to either end of it.
George Jenks, 1093 F ont Ave ue, Treasurer-Manager of the Credit Union, stated tha a
credit union and a ba k are d fferent. A credit union is a non-profit organization. he
credit union has been in exist nce since 1940. Their rapid growth led to board decisi ns to
stay in the Como are . Their urrent membership, which changed in 1984, extends to 11
residents in the Com Midwa area. He referred to the site plan explaining that an L
shaped property prop ses a n mber of problems. They have gone through many plans
trying to find one fo maximi ing the use of the property. 'They wanted to improve t affic
flow and reduce poss ble traf ic accidents. This new plan should help do that. He st ted
that the architccts ar present if the committce had any questions to address to them.
Ms. Zieman stated th t she w glad the credit union was staying in the neighborhood as
they have always kep a good usiness. One of her concerns is the increase in traffic ith
the development in E ergy Pa k. She is concerned about their drive-in and driveway
especially the drivew y going east on Front. Mr. Jenks explained the traffic flow ref rring
to his enlarged site pl n. He xplained their traffic flow pattern will improve on wh t it is
now especially since he new ront Avenue drive will be further from the Lexington- ront
intersection. Ms. Zie an aske Mr. Jenks if their new driveway would be where the
existing rambler is n w. Mr. enks answered yes.
Ms. Zieman stated th t she is oncerned because there is parking on both sides of Fro t.
Mr. Jenks answered t at there is not parking on both sides of Front where the credit nion
is located, parking is ocated couple of blocks back. Ms. Zieman stated that she is
concerned Front will ecome 4-lane street, and she sees this as being another fast ro te to
280. She is concerne the cha ges will add possibilities for traffic accidents because f the
traffic flow. Mr. Jen s stated that his plan addresses those possibilitics to limit possi le
traffic accidcnts.
Ms. Datsko stated tha the Pa k's Department, in thc site plan review process, has reje ted
two driveways on Le ington nd that she docs not believe the issuc has been resolved. Mr.
Soderholm stated tha no, it h s not been resolved.

Vic Spaulding, 1266 oma A enue, Roseville, stated that he and his wife, Mary own he
duplex on 98 Lexin ton and 94 Lexington. He stated that they have well-maintain d
properties. The hom they ar proposing to move has acted as a buffer between his
property and the cre it union If the rezoning is allowed, his renters will be looking t the
drive-in out t'heir wi dow. T is will devalue their property. He stated that they hav
consulted two realtor who h ve agreed that this rezoning will devalue their property
With the parking lot ext to is property it would be hard for him to rent to good te ants,
and much harder to 11 his p operty. He would like to be compensated or have the
rezoning den�ed. Th credit nion's driveway would be closer to his property and all y
access would be diffi ult bec use of increased traffic.
Mr. Jenks stated that the cred t union has no intention of customers using the alley i fact,
the new plan separat s credit union and residential alley uses. He received names of
adjoining property o ners fr m the County Recorder's Office and Mr. Spaulding's n me
was not on that list p rtainin to either of his properties.
Mr. Pangal st ted tha the pri t-outs thcy have from the County Recorder's office lis s Mr.
Spaulding as a taxpa er on e ch of his properties. Mr. Jenks stated that they were to d that
the property owners ad to b listed as fee owners and so they followed Planning Di ision
guidelines. Mr. Pang 1 stated that Mr. Spaulding is present to testify as a contract
purchaser and has a ight to stify. Mr. Jenks stated that he was just pointing that f ct
out.
Ms. Zieman asked M Jenks ow many credit union members there are. Mr. Jenks
answered 5,0 0. A b anch of ice services approximately 40% of thcir customers.
Regarding traffic, . Jenks tated that at a credit union business you typically do n t
have a steady stream of traff c. Some members might be there for one-half hour on
closing of a loan, mo t transa tions are 5 minutes. There is not a heavy car usage.
Hearing no f�urther t stimony Mr. Pangal closed the public hearing portion of the m eting.
Mr. Lanegran made motion o recommend approval based on findings 1 through 9 the
staff report. Mr. Le y secon ed the motion, which passed on a unanimous voice vote of 6
to 0.
