Legisla ive Co e pertaining to zoning for the City
of Sain Paul nd the zoning maps thereof.
� WHEREAS, Pursuant to Min esota Statutes, § 462.357 and § 64.210 of the
Legislative Code, Lib rty St te Bank duly petitioned to rezone the railroad right-
of-way located behind 1555, 559 and 1563 Dayton from RM-2 to P-1 for the purpose
of constructing a sur ace pa king lot; the petition having been certified b the
Planning Division on ctober 3, 1986 as having been consented to by at least two-
thirds of the owners f the rea of the property to be rezoned, and further having
been consented to by at lea t 67% of the owners of the property situated wi hin
100 feet of the total contig ous property within one year preceding the dat of
the petition; and
WHEREAS, The Zoni g Comm ttee on November 6, 1986 conducted a public he ring
for the purpose of co sideri g the rezoning petition, and pursuant to Secti n
107.03 of the Adminis rative Code, submitted its recommendation to the Plan 'ng
Commission that the p tition be granted; and
WHEREAS, Th�e Plan ing Co mission considered the rezoning petition at its
meeting held ora Novem er 7, 986 and recommended that the City Council appr ve the
petition; and
WHEREAS, Notice o a pub ic hearing before the City Council on the said
rezoning petit�on was duly p blished in the official newspaper of the City n
November 22, 1986 and notice were duly mailed to each owner of affected pr perty
and property situate wholl or partly within 350 feet of the property sou ht to
be rezoned; and
WHEREAS, A public hearin before the City Council , having been conducte on
December 4, 1986 wher all i terested persons were heard, and the Council h ving
considered all the f cts an recommendations concerning the petition; ow,

Dear Sir:
On November 6, 1986, he Zoni g Committee of the Planning Commission held a publi
hearing on this rezoni g. The etitioner testified. At the close of the public hearing, he
Committee voted 6 to to appr ve the rezoning based on staff findings.
On November 7, 1986, he Plan ing Commission upheld the Zoning Committee's
recommendation on a nanimo s voice vote (13-0).
This rezoning is sched led to b heard by the City Council on December 4, 1986. Pleas
notify me by Decembe 2, 1986 if any member of the City Council wishes to have slid s of

Ms. Morton asked Mr. Harold etersen, property manager for Liberty State Bank, if h
would like to make a resenta ion. Mr. Petersen answered no.
Hearing no further te timony, Ms. Morton closed the public hearing portion of the me ting.
Ms. Summers made a otion t recommend approvai based on staff findings 1 throug 5.

WHEREAS, Libert State B nk, File #10006 has petitioned to rezone vacant parcel on railroad
right-of-w�y betw n 1565 nd 1545 Dayton situated on from RM-2 to P-1 for the urpose of
construction of a s rface p rking lot; and
WHEREAS, the Zo ing Co mittee of the Planning Commission on November 6, 19 6, held a
_ public hearing at hich all persons present were given an opportunity to be heard ursuant to said
application in acco dance ith the requirements of Section 64.400 of the Saint Pau Legislative
- Code; and
WHEREAS; Saint ul Plan ing Commission, based on the evidence presented to it Zoning
Committee at the p blic he ring as subsequently reflected in the minutes, made th following
findings of fact:
1. In August 198 the Cit Council approved a rezoning of property located 1555 1559 and 1563
Dayton from M-2 to -1 to allow the construction of a surface lot for 44 vehi les. Sometime
after that acti n, the r ilroad right-of-way behind those parcels became availa le to the
applicant. It i this sec ion of right-of-way that is the subject of this rezoning.
2. Off-street par 'ng for ommercial uses may be provided (a) on the same zonin lot, (b) in a P-
1 district or (c) within he same district as the principal use and within 300 fe of the
building it is i tended o serve.
The parking lo will se e the applicant and other eommercial properties in th area.
3. With the additi nal 10, 00 square feet, the parking can be reorganized to fit 7 vehicular
spaces.
4. The December 9ES Sel y-Snelling Task Force Report recommends that area bu inesses work
to develop mor off-str et parking. It also states that to meet 75 percent of the peak demand
for off-street p rking ould require 98 parking spaces. The proposed develop ent would
- satisfy �bout t ree-fou hs of that demand.
