WHEREAS, Pursuant to Min esota Statutes, § 462.357 and § 64.210 of the
Legislative Co e, Pat icia M Ginnis Wilhelm duly petitioned to rezone 1582 eech
Street, locate betwe n Haze wood and Germain from R-4 to RT-1 for the purp se of
permitting a c nversi n to a duplex; the petition having been certified by he
Planning Division on uly 24 1986 as having been consented to by at least o-
thirds of the wners f the rea of the property to be rezoned, and further having
been consented to by t leas 67% of the owners of the property situated wi hin
100 feet of th total contig ous property within one year preceding the dat of
the petition; and
WHEREAS, T�e Zoni g Comm ttee on September 4, 1986 conducted a public h ring
for the purpos of co sideri g the rezoning petition, and pursuant to Secti n
107.03 of the l�dminis rative Code, submitted its recomnendation to the Plan ing
Commission tha the p tition be denied; and
WHEREAS, T e Plan ing Co ission considered the rezoning petition at its
meeting held on Septe ber 12 1986 and recommended that the City Council de
the petition; nd
WHEREAS, N tice o a pub ic hearing before the City Council on the said
rezoning petition was duly p blished in the official newspaper of the City
September 20, 986 an notic s were duly mailed to each owner of affected p perty
and property situated wholly or partly within 350 feet of the property sough to
be rezoned; an
WHEREAS, A public hearin before the City Council , having been conducted on
October 2, 198� where all in erested persons were heard, and the Council hav'ng
considered all the fa ts and recommendations concerning the petition; now,
therefore,

Ms. Datsko showed slid s of the ite and reviewed the staff report with a recommendati n

Pat Wilhelm, 1582 Beec , testifi d that she has lived in the house for l5 years, has raise
over 40 foster c �ldren n the h me. The neighborhood is not used to low density at tha
location and wi 1 proba ly look orward to having only her son, daughter-in-law and
herself living t ere. Ms Wilhel stated she understood the need to not rezone areas
capriciously bu� what i legally tated as the R-4 neighborhood is not accurate. In the
existing neighbarhood, here are a number of structures within one-half block that are
currently being used as uplexe There is an increasing problem with single family ho es
in the area bein� rented She sta ed that she needs to make some conversions to facilitat
her family needs over a long pe 'od of time and she will have to proceed to do that for
economic and f mily re sons. S e has no particular objection to reconverting the struct re
to a single fami�y dweli ng if th t is necessary but the character of the neighborhood is
changing and a 40-acre tudy of the area might be appropriate at this time. This was
discussed at the District 1 meeti g as an appropriate issue for them to hold hearings on
sometime withi� the ne t 3 to 6 onths.
There was discu sion re arding mother-in-law apartment. Ms. Datsko stated that if Ms
Wilhelm would l�ke to c ange he house so that a family member could reside in part an
have it separate in part rom th main dwelling unit, that wouid be permitted and is not

Ms. Wilhelm stat{�d that he coul not guarantee that she will either be in a position to
maintain the ho�hse hers lf or th t she will sell it. �
Ms. Lane report d that t e Build ng Department would not issue a building permit if it
were a complete�y separ te dwel 'ng unit regardless who was living there. There can be
two kitchens in a single amily welling but there could not be a separate dwelling unit.
Ms. Summers asl�ed how 't is det rmined whether there is a separate dwelling unit.
Ms. Lane stated �hat one way is i there is access between the two units. In some cases t y
will ask an applicant to nbmit a statement indicating that they're going to be using it as a
single family dwelling a d that hen they sell it, they will be selling it as a single famil
residence. If it looks lik it is b ild as a duplex where the floor plan of lower level is
identical to the pper le el, the uilding Department would consider it to be a duplex.

Mr. Repke not�d that here are 4 duplexes on the block in question and the block to th
north.
Ms. Lane repo�ted tha duplex were allowed anywhere in the City prior to 1975. Th City
did not have exclusive y single family zoning districts. Duplexes that were establishe
legally before �hat tim were a lowed to remain and are considered legal nonconformi g
uses.
Ms. Wilhelm st ted tha the ex ansion to her home was done in the fall of I975 to han le

Hearing no fu ither tes imony, . Pangal closed the public hearing portion of the mee ing.
Ms. Morton ma e a mo ion to r commend approval of the rezoning based on the fact t t a
lot size of 6,00�sq. ft. s requir d and the applicant has 9,800 sq. ft.; a 50-foot frontag is
required and t�e appli ant has n 80-foot frontage; remodeling will be done entirely w thin
the structure; t ere is ff-stree parking for three cars; there is a duplex across the stre t
on Beech and a�nd two ore on argaret; the rezoning will not affect the general welf re
of the commun�ty or a jacent roperties; and the density of the neighborhood will not e
increased. Mr. Repke conded the motion, which failed on a roll call vote of 3 to 4 (
Summers, Ms. Iracy, . Ziema and Mr. Pangal voted against the motion).
Mr. Zieman ma�de a mo ion to r commend denial based on staff findings 3 through 6 a d
the staff analy is, and o recom end a 40-acre study to determine if the character of t e
area has chang�d since 1975 to arrant rezoning to RT-1. Ms. Summers seconded the

2. The applicant has s ated th t her son and daughter-in-law would reside in the seco unit
for possibly the nex five y rs while they complete school. She further stated that she
believes the neighb rhood is beginning to change character from owner occupied si gle-
family to o�}e with bsentee landlords.
3. The applicant's pro erty is t o lots, 9,800 square feet, located in the R-4, single fa ily
zone. One h�alf bloc to the ast is Cemstone, a conerete and gravel company, locate on
Minnehaha �n an I- and P-1 zone. The closest residential zoning discrict other than ,
single famil is loc ed two locks to the east on the north side of Minnehaha (RM- );
otherwise th�e area i a homo eneous R-4 district.
4. The intent q'f the R 1 throu h R-4 zoning districts is "to provide for an environmen of ,'
predominan�ly low ensity, ne family detached dwellings..." (Section 60.412). ,
5. The Compre�ensive lan ide tified that one of the most important v�lues to homeo ners
in City neighborhoo s is the protection of neighborhood character. If further states in ;
Policy 1-8 " onversi n of la e single family structures to two family use will be all wed
on a limited�basis in city nei hborhoods. Conversions will be restricted to prevent a -
verse impac� on nei hborhoo character..". :
In response to this p licy, Pl nning Staff developed conversion guidelines which we e �
revised and pprove by the Zoning Committee and reviewed and approved by the lan-
ning Commi�sion an the Di trict Housing Plan Task Force. These guidelines are:
