Dear Sir: I
On September 4,I 1986, t e Zonin Committee of the Planning Commission held a public
hearing on this i�onconf rming se permit. The petitioner testified. At the close of the
public hearing, xhe Com ittee v ted 4 to 3 to deny the permit because the applicant sho ed
insufficient har�iship a d provi ed off-street parking for only one vehicle.
On September 12, 1986, he Plan ing Commission upheld the Zoning Committee's recom en-
dation on a una�imous oice vot .
This appeal is schedule to be h ard by the City Council on October 23, 1986. On Octo er
20, 1986, it will �be revie ed by he City Development and Transportation Committee a
slides will be presented t that t me.

Committee at th�public earing s subsequently reflected in the minutes, niade the follo ing

Ms. Datsko sho ed slid s of the sitc and reviewed the staff report with a recommendati n
for approval su ject to he apar ment meeting all City buildiag and fire codes. A lette
was received fr m Dist ict 4 in upport.
Ms. Zieman ask d staff about t availability of on-street parking.
Ms. Datsko repo tcd tha she vis ted the sitc and reviewed the land uses in the area and
also talked wit the Di rict pla ner to see if there was any concern about parking in t e
area. Because t e prop rty is o a dead-end street, it appeared that the siee could handl
two additional n-stree vehicle .
Keith Smith stated that he was ne of the joint owners of the residence and introduced is
wife, Elaine Smith.
Mr. Pangal askcd Mr. S ith if h rosided at 1239 E. Seventh. Mr. Smith stated that he d d
live there.
Ms. Tracy asked when t e convc sion was done. Ms. Smith statcd that they moved in
November of 1970 and ix mont s later the second unit was completed. In 1972 the thir
unit was added.
Ms. Zicman inq ired ab ut the cess to the basement unit and the rental income for th
two units.,
Ms. Smith indic ted tha the bas ment apartmeat has its own entryway. The rental inco e
for the basemen unit is $250, t e main floor is a500 and they live on thc second floor.
Mr. Pangal aske if the was a oom on the first floor in the front part of the building
that has been re ted ou as a slc ping room.
Ms. Smith expla ned tha the ma n floor has 2-bedrooms and the person that rents the m in
„ floor has a frie d who lso lives there. It is not a separate unit, there is a sliding door t at
opens up to the whole ain floo . The person who rcnts the main floor p�ys the rent to
hcr.
. • Mr. Pangal expressed co cern ab ut the main floor unit becausc some time ago, it was
advertised in tho paper s a slee ing room.

There was discu sion re arding onversions that the Building Department did not know
about initially when th Certifi ate of Occupancy program started. Ms. Lane reported at
conversions are ometi es disco ered through the City Directory, if someone files a
complaint, or at the tim of the ale of the house. She stated that the Assessor's Office
receives a copy f all b ilding rmits and there was no record of any permit to add an
additional unit. �
Mr. Repke mad a moti n to rec mmend approval based on staff findings 1 and 2, subj ct
to the apartmen� mceti g all Ci � building and fire codes. Ms. Morton seconded the mo ion,

1. The app�icants r side in hc second floor apartment; the structurc also has a 2-b droom
unit on xhe first floor a an efficiency apartment in the basement. The basem nt
apartment is the unit in uestion in this action.
2. To gran� legal n nconfo ming status to uses failing to meet Section 62.102, the anning
Commis�ion mu t make ine findings; these requirements and the applicant's ab lity to
w meet them are a follow :
(1) The, use occ rs entir ly within an existing structure.
' The third u it is th basement unit.
(2) The use is milar t other uses permitted within the district.
The reside tial use s similar to other uses permitted in the district; on the ame block
of �ast Sev nth Str et is a 5-unit apartment also in the RT-1 zone.
(3) The use is ppropri te and is consistent with the general welfare of the co munity
and the en' yment f adjacent property.
ThE additi nal unit is consistent with the general welfare of the communit and en-
joyment of adjacen property.
(4) Th� use ha been i existence for a period of at least ten years prior to the applica-
tio� to the lannin commission.
The applic nt prov ded a notarized letter from an adjacent neighbor whic attests to
the� existen e of th e units at 1239 E. Seventh since 1972. The City Assess r's Office
last inspec ed the p operty in 1970 when it was a single family home with pace for a
doCtor's of ice.

(5) The o�ff-stree parkin is adequate to serve the use..
A new three nit wou d require four off-street parking spaces. The applican has one
off-sC'reet spa e in a rage. Parking is also available on-street on both sides f
Atlaqtic, a d ad-end treet north of East Seventh Street. Parking therefore a pears
sufficient.
(6) The use is in substan 'al agreement with the comprehensive plan.
The �ompre ensive lan states that "conversion of existing housing should o cur on a
limited basis in most eighborhoods to avoid concentration and disruption o neigh-
borhood cha acter."
The continu nce of e unit which has existed for a period of at least 10 ye rs will
not disrupt t e neigh orhood character.
(7) Hardship w uld resu t if the use were discontinued.
The applica t has pr vided a statement indicating that if the third unit was denied,
hardship wo ld resu t due to loss of rental income, reduced selling price an dif-
ficulty payi g off e ergy improvement loans (for new boiler, water heater, nsulation
and �roof re lacemen ).
(8) Rezpning t proper y would result in "spot zoning" or a zoning inappropria e to sur-
rounding la d uses.
