WHEREAS, Chapter 293 of the Saint Paul Legislative Code was
enacted to regulate the subject of noise in the City of Saint
Paul; and
WHEREAS, §293.11 provides for the granting of variances from
the sound level limitations contained in §293.09, upon a finding
by the City Council that full compliance with Chapter 293 would
constitute an unreasonable hardship on an applicant, other
persons or on the community; and
WHEREAS, Las Americas and E1 Amanecer Restaurant,
represented by Selwin Ortega and Angel Sanchez, respectively,
who have been designated as the responsible persons on the
application, have applied for a variance to allow live music in
the parking lot between 178 and 194 Concord Street, on September
18 and 19, 1999; and
WHEREAS, applicants are seeking a variance for the hours of
10:00 a.m. to 8:00 p.m. on both dates; and
WHEREAS, if applicants are not granted a variance they will
not be able to present the live music; and
WHE12EA5, the Office of License, Inspections, and
Environmental Protection has reviewed the application and has
made recommendations regarding conditions for the variance; now,
therefore, be it
RESOLVED, that the Council of the City of Saint Paul hereby
grants a variance to Las Americas and E1 Amanecer Restaurant,
subject to the following conditions:
1) The variance shall be for the hours of 10:00
a.m. to 8:00 p.m. on September 18 and 19,
1999.
2) All electronically powered equipment used in
conjunction with the event shall not exceed
100 dBA as measured at the closer of the
sound mix or at a distance of 100 feet from
the front of the stage.
3) The applicants shall provide personnel and qq '� 3
equipment who shall provide continuous sound
level monitoring between 10:00 a.m. and 8:00
p.m. on September 18 and 19, 1999 to ensure
compliance with Condition #2.
4) All electronically powered equipment, PA
systems, loudspeakers or similar devices
shall be turned off no later than 8:00 p.m.
on September 18 and 19, 1999.
FURTHER RESOLVED, that any violation of the conditions set
forth above on September 18, 1999 date may result in revocation
of the grant of a variance for September 19, 1999, in addition to
any criminal citation which might issue.

Attached is a sound level variance application from Selwin Ortega, Owner, Las Americas (St.
Paul), and Angel Sanchez, Owner, El Amanecer Restaurant, to allow amplified, live music and
stage emcees on Saturday, September 18, 1999 and Sunday, September 19, 1999. The variance
is requested from 10:00 a.m.,to 8:00 p.m. on both days, on the parking lot at 190 Concord

Attached is a sound level variance application from Selwin Ortega, Owner, Las Americas (St.
Paul), and Angel Sanchez, Owner, El Amanecer Restaurant, to allow amplified, live music and
stage emcees on Saturday, September 18, 1999 and Sunday, September 19, 1999. The variance
is requested from 10:00 a.m.,to 8:00 p.m. on both days, on the parking lot at 190 Concord
Street, betuveen 178 & 194 Concord, bounded by State and Ada.
Also attached is a copy of ihe Public Hearing Notice sent to property owners within 200 feet of
the area on Concord Street.
