1 WHEREAS, The City of Saint Paul has the authority to grant cabie television franchises, receive franchise
2 fees, and negotiate and enforce cable franchises under federal law and under Chapter 238 of Minnesota law; and
3 WHEREAS, Senator Steven Kelley has introduced legislation (S.F. 2133) that would repeal Chapter 238 and
4 replace Chapter 238 and Chapter 237 with a new law as Minnesota Statute 237A; and
5 WHEREAS, the proposed new Statute 237A, among other things, would revoke the City's ability to franchise a
6 cable operator, the City's ability to regulate cable, and the City's ability to collect franchise fees from cable
7 operators; and
8 WfIEREAS, the City has significant and relevant interests in retaining its ability to franchise cable operators,
9 administer cable franchises, and collect franchise fees; and
10 WHEREAS, other cities in Minnesota have similaz interests and concezns regarding this legislation; and
11 WHEREAS, the Minnesota Associafion of Community Telecommunications Administrators (MACTA) is an
12 advocate of cities' interests in the area of cable and telecommunicarions and cities' continued authority over
13 cable franchises and the collection of franchise fees; and
14 WIiEREAS, the City of Saint Paui is a member of MACTA; and
15
16 WHEREAS, MACTA is seeking funds from its members to educate legislators and advocate cities' interests at
17 the state le�slaiure; and
18
19 WHEREAS, it wouid be in the City of Saint Paui's interest to join other Minnesota cities and provide funds to
20 assist MACTA and help cities retain their franchising authority and franchise fees; now therefore, be it

RESOLVED, that the City of Saint Paul authorizes that up to ten thousand dollars be paid to MACTA to assist
MACTA in its efforts to retain local franchising authority and franchise fees for cities; and that ttus expense will
be paid from the City's Cable Communicafions budget, Fund 166 Activity 31121-0219.

Approve a resolution which provides financial support to MACTA (Minnesota Association of Community
Television Admiuistrators) to assist them in advocating cities' interests in retaining cablz franchise fees and cable
franchising authority, which Minnesota S.F. 2133 proposes to eliminate.

Initiating Problem, Issue, Opportunity (Who, What, When, Where, Why):
Last spring. Senator Steve Kelley introduced S.F. 2133, which repeals current Minnesota law regarding cable and
telecommunications and replaces it with an entirely new model. This model elnninates the authority of cities to
franchise cable operators and their ability to collect franchise fees. MACTA is a city-based organization that
represents cities' interests in cable and telecommunicafions and MACTA is seeking financial assistance to educate
legislators and advocate cities' interests in franchising and franckuse fees. The City of Saint Pau1 is a long-standing
member of MACTA.
Advantages ILApproved:
MACTA will be in a better position to defend and advocate cities' interests and influence legislation.
Disadvantages If Approved:
There is no guazantee that MACTA and cities' interests will prevail, and the City would have spent money for this
effort.
Disadvantages If Not Approved:
MACTA will not haue the resources to make an effective nnpact on the legislation and Saint Paul could be more
vulnerable in terms of losing franchising authority and franchise fees without MACTA's presence.
