The meeting was called to order at 4:02 p.m.
Gerry Strathman stated this public hearing is to hear objections to the issuance of licenses to
Wilson Auto Parts, 933 Payne Avenue.
Larry Zangs reported this is an application by Timothy S. Wilson, DBA Wilson Auto Parts. The
licenses aze for Second Hand Dealer-Motar Vekricle Parts and Auto Repair Garage. LIEP is
approving the license subject to six condirions which are as follows:
l. Activities associated with auto parts sales shall be conducted in the manner of a retail
business only. The disassembling of vehicles on the property for the purpose of salvaging
auto parts is expressly forbidden.
2. Auto repair activity shall be confined to light line mechanical work only. All vehicle repair
shall be conducted inside the building.
3. Customer/employee parking shall only be in the areas designated on the site plan filed with
License, Inspec6ons, and Environmental Protection (LIEP).
4. Discarded car parts shall not be stored outdoots unless placed in a covered dumpster,
screened from view by a six foot high wood obscuring fence. The location of the dumpster
enclosure must be approved by this office before instaliafion.

At the first hearing on this matter, stated Mr. Strathman, there was a question as to whether this
license is legal in this zoning district. Mr. Zangs responded that has been resolved. The original
application was approved as an auto service station, which usually involves the sale of petroleum
products. There is also an auto repair facility license that deals with light mechanical duties,
which is similar to what an auto service station would be permitted to have. Based on that
intezpretation, the zoning office decided as long as the auto repair aetivity is confined to light line
mechanical work only, then the owner could operate there and be in compliance with the zoning
ordinance.
Katya Ricketts, East Side Neighborhood Development Company (ESNDC), Inc., 900 Payne
Avenue, appeared and stated the physical aesthetics and general commercial health of Payne
Avenue is important to her organizarion. The ESNDC is in opposition to a new license. It was
there understanding that the new license would be for auto salvage, which would be a detrimem
to Payne Avenue.

Mr. Strathman asked is there a distinction between auto repair and auto salvage. Mr. Zangs
responded auto salvage involves dismantling a vehicle and reselling or recyciing those parts.
Auto repair involves taidug a vehicle and repairing it by using parts or exchanging parts, but the
parts ate only used with the intent and purpose of repairing the vehicles. If this license was
granted, Mr. Wilson could not do auto salvage at this location. If those parts were salvaged
someplace else and brought to this faciliry, it can be sold from this location.
Ms. Rickets requested the following conditions be added to the license: i) The display
showroom will be cleaned and made more attractive; 2) Car parts will not be stored outside in
the pazking lot azea; 3) Cazs will not be repaired in the parking lot; 4) The pazking lot wili be
cleaned and possibly resurfaced; 5) The building will be fixed up and painted; 6) There will be
a limit on the number of cars parked overnight.
Mr. Strathman stated he has received the following letters objecting to the issuance of the
licenses: Bruce Sylvester, District Five Plauning Council, 1014 Payne Avenue; Maureen
Mariana, Payne Arcade Business Association, 900 Payne Avenue; Mike Anderson, East Side
Neighborhood Development Company, 900 Payne Avenue; Shirley R. Nordstrom, 619 Sims
Avenue; Michael J. Wagner, Jr., Wagner Management, 1032 Seventh Street West #201; Michael
J. Wagner, Jr., The Martin Holdings, 43 East Golden Lake Road, Circle Pines; Katya Rickets,
East Side Neighborhood Development Company, 900 Payne Avenue.

Tim Wilson, owner, appeared and stated he owns two lots at this location: one lot is for pazking
and the other is for the building and parking. He gave a renter a chance to run the garage for a
year, but he ran it shabbily. A Chevy in one of the photographs belongs to a teacher at Como
Pazk who wanted to get the car started. A motor was being installed in one vehicle and the other
was getting started. Most of the vehicles an the photographs belong to Mr. Wilson. He
purchased the business in May 1995, and ran it as an auto repair facility. The license was kept
until lately when he wanted to put the business under one name. Mr. Wilson was the one that got
his renter out of there. No one came to Mr. Wilson with any problems except for one neighbor.
It is tough to do business in this neighbarhood. His business is the longest to stay at this
location.

In order to keep the garage clean, Mr. Wilson stated, he has to be able to afford it. Since May,
the business has cost him close to $400,000. He pays $6,000 a year in taxes and $2,000 a month
in building payments. Therefare, he needs the auto parts and light auto repair to wark together.
The basic thing he wants to do is sell used tires and put in batteries. The photographs from the
ESNDC show the problems that come with a facility that deals with changing motors, etc. An
auto repair facility is always waifing for parts. However, with the system he has in place, there
should be almost no overnight parking.

(Mr. VJilson presented a certificate of occupancy dated 8-13-99, which states the building is in
fiill compliance.)
Mr. Strathman stated the improvement in the photographs is conspicuous. The ESNDC has
conditions they would like to see on the license. It seems some of these conditions aze
compatible with the LIEP conditions already agreed to by the owner. Mr. Zangs responded it
would be difficult to enforce the limit of cazs in the parking lot overnight (ESNDC Condition
#6).
Mr. Strathman stated the three conditions recommended by the ESNDC that have not been
agreed upon by Mr. Wilson are as follows: clean the display showroom, ciean and resurface the
lot, and paint the building. Mr. Wilson responded the showroom has improved. Ms. Rickets
responded some of the glass in the showroom is not being used and is dirry. The pazking lot has
been cleaned; the resurfacing would be for the oil spiils and stains. The painfing is for the
general upkeep of the building.
Mr. Strathman stated the building is of legal use and the owner has agreed to LIEP's
recommended conditions that address some of the concerns in the letters. Mr. Strathman does
not think the City can require the owner to resurface the parking lot. As for cleaning and
painting the building, there are building inspectors that deal with properry code enforcement.
The City cannot require the owner to paint the building un61 the building inspector detennines
the exterior is not in compliance with the building maintenance code.
Gerry Strathman recoxnmended approval of the license with the conditions recommended by
LIEP.

enclosure must be approved by this office before instaliafion.
5. Storage of vehicle fluids, batteries, etc. shall be in accordance with Ramsey County
Hazardous Waste regulafions.
6. The obscuring fence along the west property line shall be maintained in good condition.
At the first hearing on this matter, stated Mr. Strathman, there was a question as to whether this
license is legal in this zoning district. Mr. Zangs responded that has been resolved. The original
application was approved as an auto service station, which usually involves the sale of petroleum
products. There is also an auto repair facility license that deals with light mechanical duties,
which is similar to what an auto service station would be permitted to have. Based on that
intezpretation, the zoning office decided as long as the auto repair aetivity is confined to light line
mechanical work only, then the owner could operate there and be in compliance with the zoning
ordinance.
Katya Ricketts, East Side Neighborhood Development Company (ESNDC), Inc., 900 Payne
Avenue, appeared and stated the physical aesthetics and general commercial health of Payne
Avenue is important to her organizarion. The ESNDC is in opposition to a new license. It was
there understanding that the new license would be for auto salvage, which would be a detrimem
to Payne Avenue.

Mr. Strathman asked is there a distinction between auto repair and auto salvage. Mr. Zangs
responded auto salvage involves dismantling a vehicle and reselling or recyciing those parts.
Auto repair involves taidug a vehicle and repairing it by using parts or exchanging parts, but the
parts ate only used with the intent and purpose of repairing the vehicles. If this license was
granted, Mr. Wilson could not do auto salvage at this location. If those parts were salvaged
someplace else and brought to this faciliry, it can be sold from this location.
Ms. Rickets requested the following conditions be added to the license: i) The display
showroom will be cleaned and made more attractive; 2) Car parts will not be stored outside in
the pazking lot azea; 3) Cazs will not be repaired in the parking lot; 4) The pazking lot wili be
cleaned and possibly resurfaced; 5) The building will be fixed up and painted; 6) There will be
a limit on the number of cars parked overnight.
Mr. Strathman stated he has received the following letters objecting to the issuance of the
licenses: Bruce Sylvester, District Five Plauning Council, 1014 Payne Avenue; Maureen
Mariana, Payne Arcade Business Association, 900 Payne Avenue; Mike Anderson, East Side
Neighborhood Development Company, 900 Payne Avenue; Shirley R. Nordstrom, 619 Sims
Avenue; Michael J. Wagner, Jr., Wagner Management, 1032 Seventh Street West #201; Michael
J. Wagner, Jr., The Martin Holdings, 43 East Golden Lake Road, Circle Pines; Katya Rickets,
East Side Neighborhood Development Company, 900 Payne Avenue.

Tim Wilson, owner, appeared and stated he owns two lots at this location: one lot is for pazking
and the other is for the building and parking. He gave a renter a chance to run the garage for a
year, but he ran it shabbily. A Chevy in one of the photographs belongs to a teacher at Como
Pazk who wanted to get the car started. A motor was being installed in one vehicle and the other
was getting started. Most of the vehicles an the photographs belong to Mr. Wilson. He
purchased the business in May 1995, and ran it as an auto repair facility. The license was kept
until lately when he wanted to put the business under one name. Mr. Wilson was the one that got
his renter out of there. No one came to Mr. Wilson with any problems except for one neighbor.
It is tough to do business in this neighbarhood. His business is the longest to stay at this
location.

In order to keep the garage clean, Mr. Wilson stated, he has to be able to afford it. Since May,
the business has cost him close to $400,000. He pays $6,000 a year in taxes and $2,000 a month
in building payments. Therefare, he needs the auto parts and light auto repair to wark together.
The basic thing he wants to do is sell used tires and put in batteries. The photographs from the
ESNDC show the problems that come with a facility that deals with changing motors, etc. An
auto repair facility is always waifing for parts. However, with the system he has in place, there
should be almost no overnight parking.

fiill compliance.)
Mr. Strathman stated the improvement in the photographs is conspicuous. The ESNDC has
conditions they would like to see on the license. It seems some of these conditions aze
compatible with the LIEP conditions already agreed to by the owner. Mr. Zangs responded it
would be difficult to enforce the limit of cazs in the parking lot overnight (ESNDC Condition
#6).
Mr. Strathman stated the three conditions recommended by the ESNDC that have not been
agreed upon by Mr. Wilson are as follows: clean the display showroom, ciean and resurface the
lot, and paint the building. Mr. Wilson responded the showroom has improved. Ms. Rickets
responded some of the glass in the showroom is not being used and is dirry. The pazking lot has
been cleaned; the resurfacing would be for the oil spiils and stains. The painfing is for the
general upkeep of the building.
Mr. Strathman stated the building is of legal use and the owner has agreed to LIEP's
recommended conditions that address some of the concerns in the letters. Mr. Strathman does
not think the City can require the owner to resurface the parking lot. As for cleaning and
painting the building, there are building inspectors that deal with properry code enforcement.
The City cannot require the owner to paint the building un61 the building inspector detennines
the exterior is not in compliance with the building maintenance code.
Gerry Strathman recoxnmended approval of the license with the conditions recommended by
LIEP.
