Maryland Ave. for City Council approval; WHEREAS, the appropriate City departments have reviewed the plat and found, as explained in the staff report to the City Council, that it meets the requirements of Chapter 67 of the Zoning Code; WHEREAS, the Lake Phalen Townhomes development is an implementation step in the Phalen Village Small Area Plan, which was adopted by the City Council as part of the Comprehensive Plan; WHEREAS, notice of a public hearing before the City Council was duly published in the official newspaper of the City and notices were mailed to each owner of affected property including all property situated within 350 feet of the subject property; WHEREAS, the City Council held a public hearing on the proposed plant on December 23, 1998, where all interested parties were heard and the Council considered all the facts and recommendations concerning the plat; NOW, THEREFORE, BE IT RESOLVED, that the City Council accepts and approves the attached preliminary and final plat for Phalen Village Townhomes subject to the following conditions: 1. The developer shall file a copy of the Council Resolution approving the plat with the Ramsey County Recorder's Office. The developer shall file a copy of the Council Resolution on each property deed within the development. 2. HISTORY/DISCUSSION: The Lake Phalen Townhomes development is a step in the implementation of the Phalen Village Small Area Plan. Although the demolirion of the apartments that previously occupied the site was controversial, the townhouse redevelopment has already received several City approvals, including site plan review, financing from the HRA Board, and building pernuts. Now the townhouses are under construction and the land needs to be subdivided to match the new development. The new lots need to be approved by the City and recorded by Ramsey County befare the they can be sold to new homeowners. The present application was initially submitted as a Prelixninary Plat. After the developer received feedback on the pretiminary plat and made changes requested by city staff, the applicadon was upgraded to a combined Preliminary and Final Plat. G. DISTRICT COiJNCIL RECONIlI4ENDATION: The District 2 Community Council supports the Lake Phalen Townhome development. H. REQUIRED FINDINGS: 1. All the applicable provisions of the Legislative Code are complied with. City staff have reviewed tlte proposed preliminary and final plat and have reviewed the site plan. • They have determined that a11 applicable pmvisions of city codes aze met. 2. The proposed subdivision will not be detrimental to the present and potential surrounding land uses. The townhouses aze an investrnent by the city and the developer in the improvement of the azea. The plat will be beneficial to surrounding land uses. 3. The area surrounding the subdivision can be planned and deveIoped in coordination and compatibility with the proposed subdivision. The redevelopment of this site is being done in coordination with other proposals in the Phalen Village Small Area Plan. These include: the restored wefland in Phalen Pazk to the west of the site, taldng down the raikoad berni, an@ efforts to upgrade the strip shopping center to tlte east of the site. To provide a left tum lane on E. Mazyland Ave., the developer is dedicating ten feet of land along the street as right-of-way, as requested by the Public VJorks Dept. 4. The subdivision is in conformance with the Comprehensive Plan. The Phalen Village Small Area Plan was adopted by the City Council as part of the Comprehensive Plan. 5. The subdivision preserves and incorporates the site's important esisting natural features, wherever possible. The site plan includes protection of a wetland area on the site and the final plat has one fewer townhouse than the preliminary plat to auoid a low 2 • °I°I -8'S • azea in the northwest comer of the site. 6. All land intended for building sites can be used safely without endangering residents by peril from flood, erosion, continuously high water table, severe soil conditions or other menace. The site previously had an apartment complex. It can be safely redeveloped with townhouses. These issues were addressed in the site plan review process. 7. The development can be economically served with public facilities and services. This is a redevelopment site in a neighborhood that is already served by public facilities and services. Utility connections were addressed in the site plan review process. STAFF RECOMMENDATION: Based on required fmdings 1 through 7, staff recommends approval of the preliminary and final plat for Lake Phalen Townhomes at the northwest comer of E. HISTORY/DISCUSSION: The Lake Phalen Townhomes development is a step in the implementafion of the Phalen Village Small Area Plan. Although the demolition of the apartments that previously occupied ttle site was controversial, the townhouse redevelopment has already received several City approvals, includiug site plan review, financing from the HRA Boazd, and building perxnits. Now the townhouses are under conshuction and the land needs to be subdivided to match the new development. The new lots need to be approved by the City and recorded by Ramsey County before the they can be sold to new homeowners. The present application was initiat2y submitted as a Preliminary Plat. After the developer received feadback on the preluninary plat and made changes requested by city staff, the application was upgraded to a combined Preliminary and Final Plat. G. DISTRICT COiJNCIL RECOMNIENDATION: The District 2 Community Council supports the Lake Phalen Townhome development. H. REQUIRED FINDINGS: AA the applicable provisions of the Legislative Code are complied with. City staff have reviewed the proposed preliminary and final plat and have reviewed the site plan. • They have determined that a1I applicable provisiotts of city codes aze met. 2. The proposed subdivision will not be detrimental to the present and potential surrounding land uses. The townhouses aze an investment by the city and the developer in the improvement of the area. The plat will be beneficial to surrounding land uses. 3. The area surrounding the subdivision can be planned and developed in coordination and compatibility with the proposed subdivision. The redevelopment of this site is being done in coordinafion with other proposals in the Phalen Village Small Area Plan. These include: the restored wefland in Phalen Pazk to the west of the site, taking down the raikoad berm, and efforts to upgrade the strip shopping center to the east of the site. To provide a left turn lane on E. Maryland Ave., the developer is dedicating ten feet of land along the street as right-of-way, as requested by the Public Works Dept. 4. HISTORY/DISCUSSION: The Lake Phalen Townhomes development is a step in the implementafion of the Phalen Village Small Area Plan. Although the demolition of the apartments that previously occupied ttle site was controversial, the townhouse redevelopment has already received several City approvals, includiug site plan review, financing from the HRA Boazd, and building perxnits. Now the townhouses are under conshuction and the land needs to be subdivided to match the new development. The new lots need to be approved by the City and recorded by Ramsey County before the they can be sold to new homeowners. The present application was initiat2y submitted as a Preliminary Plat. After the developer received feadback on the preluninary plat and made changes requested by city staff, the application was upgraded to a combined Preliminary and Final Plat. G. DISTRICT COiJNCIL RECOMNIENDATION: The District 2 Community Council supports the Lake Phalen Townhome development. H. REQUIRED FINDINGS: AA the applicable provisions of the Legislative Code are complied with. City staff have reviewed the proposed preliminary and final plat and have reviewed the site plan. • They have determined that a1I applicable provisiotts of city codes aze met. 2. The proposed subdivision will not be detrimental to the present and potential surrounding land uses. The townhouses aze an investment by the city and the developer in the improvement of the area. The plat will be beneficial to surrounding land uses. 3. The area surrounding the subdivision can be planned and developed in coordination and compatibility with the proposed subdivision. The redevelopment of this site is being done in coordinafion with other proposals in the Phalen Village Small Area Plan. These include: the restored wefland in Phalen Pazk to the west of the site, taking down the raikoad berm, and efforts to upgrade the strip shopping center to the east of the site. To provide a left turn lane on E. Maryland Ave., the developer is dedicating ten feet of land along the street as right-of-way, as requested by the Public Works Dept. 4. The subdivision is in conformance with the Comprehensive Plan. The Phalen Village Small Area Plan was adopted by the City Council as part of the Comprehensive Plan. The subdivision preserves and incorporates the site's important existing natural features, wherever possible. The site plan includes protection of a wetland azea on the site and the fmal plat has one fewer townhouse than the preluninary plat to avoid a low 2 � �t�-gs • azea in the northwest corner of the site. 6. All land intended for building sites can be used safely without endangering residents by peril from flood, erosion, continuously high water table, severe soil conditions or other menace. The site previously had an apattment complex. It can be safely redeveloped with townhouses. These issues were addressed in the site plan review process. 7. The development can be economically served with public facilities and services. This is a redevelopment site in a neighborhood that is already served by public facilities and services. Utility connections were addressed in the site plan review process. HISTORY/DISCUSSION: The Lake Phalen Townhomes development is a step in the implementation of the Phalen Village Small Area Plan. Although the demolirion of the apartments that previously occupied the site was controversial, the townhouse redevelopment has already received several City approvals, including site plan review, financing from the HRA Board, and building pernuts. Now the townhouses are under construction and the land needs to be subdivided to match the new development. The new lots need to be approved by the City and recorded by Ramsey County befare the they can be sold to new homeowners. The present application was initially submitted as a Prelixninary Plat. After the developer received feedback on the pretiminary plat and made changes requested by city staff, the applicadon was upgraded to a combined Preliminary and Final Plat. G. DISTRICT COiJNCIL RECONIlI4ENDATION: The District 2 Community Council supports the Lake Phalen Townhome development. H. REQUIRED FINDINGS: 1. All the applicable provisions of the Legislative Code are complied with. City staff have reviewed tlte proposed preliminary and final plat and have reviewed the site plan. • They have determined that a11 applicable pmvisions of city codes aze met. 2. The proposed subdivision will not be detrimental to the present and potential surrounding land uses. The townhouses aze an investrnent by the city and the developer in the improvement of the azea. The plat will be beneficial to surrounding land uses. 3. The area surrounding the subdivision can be planned and deveIoped in coordination and compatibility with the proposed subdivision. The redevelopment of this site is being done in coordination with other proposals in the Phalen Village Small Area Plan. These include: the restored wefland in Phalen Pazk to the west of the site, taldng down the raikoad berni, an@ efforts to upgrade the strip shopping center to tlte east of the site. To provide a left tum lane on E. Mazyland Ave., the developer is dedicating ten feet of land along the street as right-of-way, as requested by the Public VJorks Dept. 4. The subdivision is in conformance with the Comprehensive Plan. The Phalen Village Small Area Plan was adopted by the City Council as part of the Comprehensive Plan. 5. The subdivision preserves and incorporates the site's important esisting natural features, wherever possible. All land intended for building sites can be used safely without endangering residents by peril from flood, erosion, continuously high water table, severe soil conditions or other menace. The development can be economically served with public facilities and services. This is a redevelopment site in a neighborhood that is already served by public facilities and services. Utility connections were addressed in the site plan review process. HISTORY/DISCUSSION: The Lake Phalen Townhomes development is a step in the implementafion of the Phalen Village Small Area Plan. Although the demolition of the apartments that previously occupied ttle site was controversial, the townhouse redevelopment has already received several City approvals, includiug site plan review, financing from the HRA Boazd, and building perxnits. Now the townhouses are under conshuction and the land needs to be subdivided to match the new development. The new lots need to be approved by the City and recorded by Ramsey County before the they can be sold to new homeowners. The present application was initiat2y submitted as a Preliminary Plat. After the developer received feadback on the preluninary plat and made changes requested by city staff, the application was upgraded to a combined Preliminary and Final Plat. G. DISTRICT COiJNCIL RECOMNIENDATION: The District 2 Community Council supports the Lake Phalen Townhome development. H. REQUIRED FINDINGS: AA the applicable provisions of the Legislative Code are complied with. City staff have reviewed the proposed preliminary and final plat and have reviewed the site plan. • They have determined that a1I applicable provisiotts of city codes aze met. 2. The proposed subdivision will not be detrimental to the present and potential surrounding land uses. The townhouses aze an investment by the city and the developer in the improvement of the area. The plat will be beneficial to surrounding land uses. 3. The area surrounding the subdivision can be planned and developed in coordination and compatibility with the proposed subdivision. The redevelopment of this site is being done in coordinafion with other proposals in the Phalen Village Small Area Plan. These include: the restored wefland in Phalen Pazk to the west of the site, taking down the raikoad berm, and efforts to upgrade the strip shopping center to the east of the site. To provide a left turn lane on E. Maryland Ave., the developer is dedicating ten feet of land along the street as right-of-way, as requested by the Public Works Dept. 4. The subdivision is in conformance with the Comprehensive Plan. The Phalen Village Small Area Plan was adopted by the City Council as part of the Comprehensive Plan. The subdivision preserves and incorporates the site's important existing natural features, wherever possible. The site plan includes protection of a wetland azea on the site and the fmal plat has one fewer townhouse than the preluninary plat to avoid a low 2 � �t�-gs • azea in the northwest corner of the site. 6. All land intended for building sites can be used safely without endangering residents by peril from flood, erosion, continuously high water table, severe soil conditions or other menace. The site previously had an apattment complex. It can be safely redeveloped with townhouses. These issues were addressed in the site plan review process. 7. The development can be economically served with public facilities and services. This is a redevelopment site in a neighborhood that is already served by public facilities and services. Utility connections were addressed in the site plan review process. STAFF RECOD�VIENDATION: Based on required findings 1 through 7, staff recommends approval of the preliminary and final plat for Lake Phalen Townhomes at the northwest corner of E. Maryland Ave. and Clazence Street by Lake Phalen Townhomes, LLC with the following conditions: The developer shall file a copy of the Council Resolution approving the plat with the Ramsey County Recorder's Office. The developer shall file a copy of the Council Resolution on each property deed within the development. 2. A copy of the Council Resolution shall be attached to and become part of the • townhouse declazation for this development which shall be provided to each properiy purchaser and their successors.
