The applica t has st ted that standards 1 through 6 can be met. Thc site plan submi ted by the applican indica es that the drive on Virginia is 20 feet from the abutting reside tially zoned parcel Sectio 62.104(9)(c) states, "Entrances and exits to and from all parkin facilities loo ted in and zoned other than R-1 through R-4, RT-1, and RT-2 shall be at least 25 feet from any ad oining property in R-1 through R-4, RT-1 and R7'-2 zoning dist icts." The placeme t of th driveway is based on the required 20 feet maneuvering lane b tween opposing 90, parkin spaces. If the drive is moved S feet south, three events will oc ur: an existing ash ree wil be removed, one parking space will be lost and the entrance wi 1 jog south from � e requ red maneuvering area. Because a parcel zoned P-i is restricted o use during busi ess hou s only, in this case approximately 11:00 a.m. to 11:00 p.m., noxio s use of the lot by raj ing au omobiles at early morning hours will not occur; therefore, the 5 feet buf- fering loss t abutti g property owners appears acceptable. Given these events, a m difica- tion of the 5 feet d ive placement requirement is consistent with tl�e intent of the ode and with the rea onable njoyment of the adjacent property. 5. The City's and Us Policy states that "the City...through...zoning will encourage bus nesses to - reduce traff, c and rking problems." The L-shape� drive rom University and Virginia will provide access to vehicles tu ing east on Univers� y from irginia and thus reduce traffic access problems ti�at may occu with this redevelopm nt. 6. The District 7 plan tates as two goals of its transportation plan as assuring traffic fety for both pedest ians an vehicles and minimizing the impact of...vehicular traffic and rking in residential reas. Ms. Datsko showe slides f the site and reviewed the staff report with a recommendatio for ap- proval of the rezo ing an to grant a modification to allow driveway placement at 20 fee from the residential pr perty li e. No correspondenc was re eived on the matter. Clark Armstead, 1 40 Hil rest Avenue, St. Paul, stated that the property w:is purchased a year ago and he proposes t open a Frogtown diner. They are primarily in the food Uusiness but li uor will be sold on the pre ises. he restaurant will close at 10:30 or 11:00 in the evening. He exp ained that the rezoning f the p rcel will allow them to provide 47 off-street parking spaces for the res- taurant. Mr. Arm tead pr sented drawings of the proposed plans. Dawn Goldschmit , 368 S erburne, District 7 Community Organizer, reported that the pre iminary plans were review d on y 26 and consensus at that time was approval. The District Co ncil has not received any ppositi n to the project. The proposal would be consistent with the dist ict plan. There is a d finite eed for off-street parking; it is difficult to permit businesses ai ng University Avenu unless parking is provided. As a resident of the area, Ms. Goldschmitz indi- cated that the exi ting bu lding is an eyesore and the people in the neighborhood are exci d about the proposed resta rant. Hearing no furthe testim ny, Mr. Pangal closed the public hearing portion of the meetin . Mr. Levy made a ' otion t recommend approval of the rezoning based on staff findings 1 through 6 and further rec mend o the Planning Commission that a modification of the 25' driv way setback on Virgin'a be gr nted to allow placement at 20' from the residential property lin . The appl cant in nds to rebuild the existing vacant bar at 353 University Avenu , just south an adjace t to this property, into a sit down "nostalgic-type" diner.
