� WHEREAS, Pursuant to Minnesota Statutes, § 462.357 and § 64.210 of the

WHEREAS, T e Zoni g Committee on August 7, 1986 conducted a public hear ng
��'or the purpos of co sidering the rezoning petition, and pursuant to Secti n
107.03 of the dminis rative Code, submitted its recommendation to the Plan ing
Gommission tha the p tition be granted; and
WHEREAS, T e Plan ing Commission considered the rezoning petition at it

WHEREAS, Clar Armst ad File #9951 has petitioned to rezone 497-499 Virginia Street ituated

�YHEREAS, the oning ommittee of the Planning Commission on August 7, 1986, held public
hearing at which all per ons present were given an opportunity to be heard pursuant to aid ap-
plication in acco dance ith the requirements of Section 64.400 of the Saint Paul Legisl tive
Code; and �
\i'HEREAS, Sain Paul P anning Commission, based on the evidencc presented to its Zon ng Com-
mittee at the pu lic hea 'ng as subsequently reflected in the minutes, madc the followin findings
of fact:
l. The applica t inten s to rebuild the existing vacant bar at 353 University Avenue, ust south
and ad jacenj to this property, into a sit down "nostalgic-type" diner. He plans to re onstruct
the entry wi h a bui ding addition and pave the existing parking. As part of this i prove-
mcnt effort, he wou d like to add 17 additional parking spaces on the parcel which s now
zoned RT-1.'
2. A new resta rant w th approximately 4,300 square feet of usable floor area would quire 36 �
off-street p rking s aces. With the rezoning of this parcel, the applicant will have 7 off-
street parki g space .
3. As set forth'in Secti n 60.723, the proposal for a P-1 zoning district must meet eigh require-
ments as fol ows:
(1)the parki g facil ty shall be accessory to one or more businesses; (2) the parking acility
shall be ina cessible for public use during those hours when the principal use is not in
operatian; ( ) it sha 1 be used solely for parking of private passenger vchicles and s all not be

4. The applica t has st ted that standards 1 through 6 can be met. Thc site plan submi ted by
the applican indica es that the drive on Virginia is 20 feet from the abutting reside tially
zoned parcel Sectio 62.104(9)(c) states, "Entrances and exits to and from all parkin
facilities loo ted in and zoned other than R-1 through R-4, RT-1, and RT-2 shall be at least
25 feet from any ad oining property in R-1 through R-4, RT-1 and R7'-2 zoning dist icts."
The placeme t of th driveway is based on the required 20 feet maneuvering lane b tween
opposing 90, parkin spaces. If the drive is moved S feet south, three events will oc ur: an
existing ash ree wil be removed, one parking space will be lost and the entrance wi 1 jog
south from � e requ red maneuvering area. Because a parcel zoned P-i is restricted o use
during busi ess hou s only, in this case approximately 11:00 a.m. to 11:00 p.m., noxio s use of
the lot by raj ing au omobiles at early morning hours will not occur; therefore, the 5 feet buf-
fering loss t abutti g property owners appears acceptable. Given these events, a m difica-
tion of the 5 feet d ive placement requirement is consistent with tl�e intent of the ode and
with the rea onable njoyment of the adjacent property.
5. The City's and Us Policy states that "the City...through...zoning will encourage bus nesses to -
reduce traff, c and rking problems."
The L-shape� drive rom University and Virginia will provide access to vehicles tu ing east
on Univers� y from irginia and thus reduce traffic access problems ti�at may occu with this
redevelopm nt.
6. The District 7 plan tates as two goals of its transportation plan as assuring traffic fety for
both pedest ians an vehicles and minimizing the impact of...vehicular traffic and rking in
residential reas. It further states that zoning should be used as a tool to regulate p rking
lo.s, ";nc.ud ng scre nin� fro�r� �ie�� a�ijaceat p►operties, clean-up anu security.°
This propos 1 will h lp to ensure traffic safety, as stated above, and will help to all viate on-
street parki g probl ms by adding 17 new spaces for commercial users. The P-1 zon ng
requirement includ a 4 foot buffer and wood obscuring fence between P-1 and res dentially
zoned parce s as we 1 as the added security of restricted access when the business is ot open.

LARK AR T D # 1 : Petition to rezone at 497-499 Virginia Street from RT-1 to P-1 to
provide off-street parkin for an adjacent restaurant.
The applicant was present There was no opposition present at the hearing.
Ms. Datsko showe slides f the site and reviewed the staff report with a recommendatio for ap-
proval of the rezo ing an to grant a modification to allow driveway placement at 20 fee from
the residential pr perty li e.
No correspondenc was re eived on the matter.
Clark Armstead, 1 40 Hil rest Avenue, St. Paul, stated that the property w:is purchased a year ago
and he proposes t open a Frogtown diner. They are primarily in the food Uusiness but li uor will
be sold on the pre ises. he restaurant will close at 10:30 or 11:00 in the evening. He exp ained
that the rezoning f the p rcel will allow them to provide 47 off-street parking spaces for the res-
taurant. Mr. Arm tead pr sented drawings of the proposed plans.
Dawn Goldschmit , 368 S erburne, District 7 Community Organizer, reported that the pre iminary
plans were review d on y 26 and consensus at that time was approval. The District Co ncil has
not received any ppositi n to the project. The proposal would be consistent with the dist ict
plan. There is a d finite eed for off-street parking; it is difficult to permit businesses ai ng
University Avenu unless parking is provided. As a resident of the area, Ms. Goldschmitz indi-
cated that the exi ting bu lding is an eyesore and the people in the neighborhood are exci d about
the proposed resta rant.
Hearing no furthe testim ny, Mr. Pangal closed the public hearing portion of the meetin .
Mr. Levy made a ' otion t recommend approval of the rezoning based on staff findings 1 through
6 and further rec mend o the Planning Commission that a modification of the 25' driv way
setback on Virgin'a be gr nted to allow placement at 20' from the residential property lin . Ms.
Summers seconde the mo ion, which passed on a roll call vote of 6 to 0.

60.721. Inten . The -1 Vehicular Parking District is intended to permit the establis ment of
off-street par ing fa ilities to be used solely for off-street parking of private passen er
vehicles as a se inci ental to a principal use. The district will serve a use district w ich has
developed wi hout a quate off-street parking.
G. FINDINGS: 'I
1. The appl cant in nds to rebuild the existing vacant bar at 353 University Avenu , just
south an adjace t to this property, into a sit down "nostalgic-type" diner. He pl ns to
reconstru t the e try with a building addition and pave the existing parking. As part of
this impr vemen effort, he would like to add 17 additional parking spaces on th parcel
which is ow zo d RT-1.
2. A new re tauran with approximately 4,300 square feet of usable floor area woul require
36 off-st eet par ing spaces. With the rezoning of this parcel, the applicant will ave 47
off-stree parkin spaces.
3. As set fo th in S ction 60.723, the proposal for a P-1 zoning district must meet ei ht
requirem nts as llows:
(1)the pa king fa ility shall be accessory to one or more businesses; (2) the parki g
facility s all be ' accessible for public use during those hours when the principa use is
not in op ration; 3) it shall be used solely for parking of private passenger vehic es and
shall not! e used on an off•street loading area; (4) no repair work, sales or displa shall be
conducte from e lot; (5) no signs other than those designating entrances are pe mitted;
(6) no bu'� ldings re to be erected on the premises unless specifically approved by the
planning admini rator; (7) applications for P-1 rezonings shall include a site pla which

conforms o the st ndards of Section 62.104. The Planning Commis�ion may grant
modificat ons of ection 62.104 based on findings that such modification is consis ent
with the i tent of the code and with reasonable en joyment of ad jacent parking; (8 P-1
district sh 11 be d veloped and maintained in accordance with the requirements o Section
62.104.
4. The appli, ant has stated that standards 1 through 6 can be met. The site plan sub itted
by the ap licant i dicates that the drive on Virginia is 20 feet from the abutting esiden-
tially zon d parce . Section 62.104(9)(c) states, "Entrances and exits to and from a 1 park-
ing facilit'es loca ed in land zoned other than R-1 through R-4, RT-1, and RT-2 s all be
at least 2 feet fr m any adjoining property in R-1 through R-4, R'T-I and RT-2 oning
districts."
The place ent of the driveway is based on the required 20 feet manetrvering lane be-
tween op osing 9 °parking spaces. If the drive is moved 5 feet south, three even s will
occur: an existin ash tree will be removed, one parking space will be lost and th
entrance ill jog outh from the required maneuvering area. Becat�se a parcel zo ed P-1

5. The City' Land se Policy states that "the City...through...zoning will encourage
businesse to red ce traffic and parking problems."
The L-sh ped dri e from University and Virginia will provide access to vehicles urning
east on U iversit from Virginia and thus reduce traffic access problems that m occur
with this' edevel pment.
6. The Dist 'ct 7 pl n states as two goals of its transportation plan as assuring traff c safety
for both edestri ns and vehicles and minimizing the impact of...vehicular traffi and
parking i reside tial areas. It further states that zoning should be used as a too to regu-
late park ng lots, "including screening from view adjacent properties, clean-up a
security."
This pro osal wi help to ensure traffic safety, as stated above, anci will help to Ileviate
on-street arking problems by adding 17 new spaces for commercial users. The P 1 zoning
requirem nts inc ude a 4 foot buffer and wood obscuring fence between P-1 and esiden-
tially zo d parc ls as well as the added security of restricted access when the b siness is
not open.
H. TAFF RE EN ATI : Based on findings 1 through 6, staff recommends ap roval of
the rezoning rom R -1 to P-1 and further recommends to the Planning Commission hat a
modification f the feet driveway on Virginia be granted to allow driveway place ent at
20 feet from he resi ential property line.
