T �at t e Zoning Code provides in Section 60.226 that the Planr}'ng ommission and the City Council upon an a peal may consi er t e following factors in addition to the spec ' fied special ondit ons , in determining whether or not a sp cial condition ,use p rmit should be given: "The ; speci 1 condition use differs from the variance in seve al re pects. A special condition use does not re- quir hard hip in order to be allowable. The special cond tion ses that are found in this Code appear as ' Spe ial A proval ' by Planning Commission. These land uses� could not be conveniently located to one zone or anot er, o the effects of such uses could not be defi itely foreseen as of a given time. The Century Company proposal would take adva tage of the chang� in ele ation by constructing one building -- the eastern portion would e one story conve ience/ tail center with self-service gasoline and the western portion w uld be a two s� ry off' c center with enclosed parking. 3. The a�� plicati n came before the Zoning Committee twice in Ju�e. Staff pres nted a reco mendat on in support because all conditions of the code could be met. � , lice Departme�nt repo ed that most accidents that'�occur at t is �ntersec ion are property dam ge accidents. A tanker � rucker will have to make a left turn on Wilson Avenue and begin a sharp decline , n gra . Almost immediately another left turn will have t be made onto the prope ty wit an even steeper upgrade. A truck trying to do this maneuver to make a deli, ery a the adjacent Sun Cliffe apartments, wound up in the f ont yard of the home a ross om the proposed site last winter. If the payload had been gasoline inste� d of ypsum board, we could have had a majorcalamity. The contours of the parcel; and i s relationship to the street must be considered an someone familiar with � his size and type of payload must determine if the truck wil be able to safely nego iate t e grades and turns. We'd like,' to re ommend only Ruth Street entrances but realize that th cramped design probabl� does 't allow for it. If it were possible then the above entioned safety questio woul be eliminated as well as the headlight glare into t e Wilson Avenue homes. There appears to be minimal turning radius. There i � also some question about the legality of cars parking ac ss the whole store ront - should there not be an open area allowing clear pump isibil- ity and pede trian raffic? If some are removed do they still meet the equire- ment? There� have lso been questions about the legality of a gasolin tanker using Wilson� Avenu to enter the station. It is a residential street and the enormous pay�oad is a Class 3 hazardous material . If it is not legal , hen the special cond'tion u e permit should be denied because the tanker will not be able to maneuver 'n site using only the Ruth Street exit/entrance. B�cking out on Ruth Street by a �oaded anker we are told by oil company engineers is illegal . We also� reque t that the Fire Marshall carefully examine this plan Where are the unde ground tanks, and what are they made of? In closin , the District 1 Community Council asks that if the proje t is constructed th, t the City give early and careful consideration to the inst lla- tion of a tra fic si nal . T e proposed location for the dirve which is s ggested to safely accomodate a large gasoline � t uck, is proposed at 89' from the center of R th Street on L�Jilson Avenue. The City states t e slope at this point is 5-6%. We asked a tired Corps. of Engineer person to use a site � g ass and he considers this to be a 10-12q grade lope. � 3. e asked a tank truck driver who delivers to one f the stations on Ruth Street to do a test of ow difficult it would be to make the proposed urn. He did a test with a witness on June `L3, 986 and in doing so, used not only his lane ut 2/3 of the other lane, and his right wheels ent over the right-side curb. This test was one with an emPty tanker, and done twice. Know �Ihe fac that have been presented previously, and the above! metion d facts, we sincerely wish that you would take a seri ous 1 k at this proposal and understand for the safety of a � argel populated residential neighborhood, this is a very ; armfu addition to our neighborhood. It has come t � my a tention that a conveniPnce store has been �roposed for construct � on on the corner of Wilson Avenue and Ruth Street. Alth ugh I personally eliev that a convenience store is not an a�propriate u e of this spa.ce� it i not to this issue that I address this letter. 1Ny specific c� ncern is regarding the installation of gasoline pumps a this store a � the elated semi-truck traffic that will re.sult. It should be poi ted o t that there is a very steep grade downward on Wi son from Ruth Str� et to Hazel. During the winter of 1984, a large semi-t ailer truck was tra eling up Wilson, where it stopped at Ruth Street. Beca se of icy condit�'ons, he truck lost traction, rolled backwards, and rol ed speedily tow d my amily who were standing on the� front steps, just eaving for an outin � . Tha kfully the back end of the truck was stopped by t e combination f a la ge snow bank and a series of bushes or my fami�y ight have been ki led. e truck front end then jack-knifed and swung aro nd to where I w s jus gettinq into our car. It went just past me and i to the neighbor!s f en e. We were all so shaken we did not go out as we ad planned. I ' sure ou can understand our deep concern. 1t�e Wilson h' l1, during the w nter onths, is many times impossible to drive up, exce t with 4-wheel driv vehi les. If gasoline trucks were to use this street, potential fo majo disaster could occur. Additionally� sinc Wilson is a residential street, it would not be appropriate,� even n the summer, foz trucks to try to manuever in an out of the propd ed co venience store, or to drive down Wilson, even if total parking ban � ere i posed on Wilson. Again, I wou� d lik to reiterate that my opposition is to the instal ation of gasoline � umps t this store. The owne is reques� ing thr e functions for use on less than a three fourths acre site. Secondly� the sc ematic plans barely meet the parking requirements. Further develop ent of hese plans will indicate the need for circulation and service spaces. i t's like y that parking spaces would be consumed in order to meet these ne ds. C ple this with insufficient snow storage area and you have a parking ' hortag . The next likely step would be to request for a parking variance. Thirdly,'gas tan ers will need to use Wilson Avenue because there is only one curb cut on Rut Street and there is insufficient room for truck maneuvering. Wilson venue i a very steep residential road. I question the legality of a loaded � nker t uck using 4 residential road, especially such a steep road. Additi � ally, a esidential lot has many restrictions in terms of setbacks and lot cov rage. he business across the street has very few restrictions. Unli ited lot cov rage a zero lot line setbacks work well in a business neighborhood, ut are ver out of character in a residential one. Further, nearly all the adjacen surrou ing co munities require that a percentage of the property be dedicat d to gree space.
