An Ordinance amending Chapter 60 of the Saint Paul
Legislative Code pertaining to zoning for the City
of Saint Paul and the zoning maps thereof.
WHEREAS, ursuant to Minnesota Statutes, § 462.357 and § 64.210 of the
Legislative C de, Skipper's, Inc. duly petitioned to rezone 594 and 596 Sherburne
Avenue locat on the south side between Dale and Kent from RT-1 to P-1 for the
purpose of c nstruction of a surface parking lot; the petition having been
certified by he Planning Division on May 12, 1986 as having been consented to by
at least two- hirds of the owners of the area of the property to be rezoned, and
further havi been consented to by at least 67% of the owners of the property
situated wit n 100 feet of the total contiguous property within one year
preceding th date of the petition; and
WHEREAS, he Zoning Committee on June 5, 1986 conducted a public hearing
for the purp e of considering the rezoning petition, and pursuant to Section
107.03 of th Administrative Code, submitted its recommendation to the Planning
Commission t at the petition be granted; and
WHEREAS, The Planning Cormiission considered the rezoning petition at its
meeting held on June 13, 1986 and recommended that the City Council approve the
petition; an
WHEREAS, Notice of a public hearing before the City Council on the said
�ezoning pet tion was duly published in the official newspaper of the City on June
28, 1986 and notices were duly mailed to each owner of affected property and
property sit ated wholly or partly within 350 feet of the property sought to be
rezoned; and
WHEREAS, A public hearing before the City Council , having been conducted on
July 10, 198 where all interested persons were heard, and the Council having
considered a 1 the facts and recomnendations concerning the petition; now,
therefore,

; Section 1.
That thei oning map of the City of Saint Paul , Sheet No. 20, as
incorporated y reference in Section 60.301 of the Saint Paul Legislative Code, as
amended, is reby further amended as follows:
That property located at 594 and 596 Sherburne
Avenue being more particularly described as Lots 9
and 10 Subd. of B1k.13, Stinson's Division be and
is hereby rezoned from RT-1 to P-1 .

this rezonin . The petitioner testified. At the close of the public hearing, the Committee
voted 6 to Oi o approve the rezoning based on staff findings.
On June 13,� 1986, the Planning Commission upheld the Zoning Committee's recommendation
on a vote of� 10 to 0 with 1 abstension.
This rezoni g is scheduled to be heard by the City Council on July 10, 1986. Please notify

WHEREAS, Skip er's Inc, file #9914, has pctitioned to rezone 594 and 596 Sherburne situated on
the south side ofl Sherburne between Dale and Kent, from RT-1 to P-1 for the purpose of allowing
constructioa o£ a� parking lot; and
WHEREAS, the I oning Committee of the Planning Commission oa June S, 1986, held a public �
hearing at whic all persons present were given an opportunity to be heard pursuant to said ap-
plication in acc dance with the requirements of Scctio� 64.400 of the Saint Paul Legislative
Code; and
WHEREAS, Sai� Paul Planning Commission, based on the evidence presented to its Zoning Com-
mittee at the pu lic hearing as subsequently reflected in the minutes, made the following findings
of fact:
l. The ap �licant intends to establish a seafood restaurant at 601 University Avenue. The
area of'I he proposed rezoning would provide additional off-street parking for the res-
taurantl and is located directly north of the restaurant site.
2. The sit will provide 24 parking stalls and access will be through the Skipper's entrance
on Uni ersity Avenue or from the alley which divides the two parcels. There will be no
direct a� cess from Sherburne.
The sit plan sutimitted by the applicant indicatcs that the residential setback along Sher-
burne ill be maintained and taadscaped. A wood obscuring fence would be rcquired on
the eas side of the property; a heavily landscaped 36 inch berm would provide screening
for res� ences oa the north side of Sherburne.
3. The citj 's land use policy states that "The City...through...zoning will encourage businesses
to redul e traffic and parking problems." This lot will reduce parkiag problems associated
with a hange of business use. Through appropriate signage which would direct traffic
movem nts to the west and south, traffic problems associated with joint commercial-
reside� ial alley use can be minimized.
4. The D' trict Seven Plan states that vacant housing should either be rehabilitated or
demoli hed and that the District will support (in concept) rezoning to P-1 on the south
side of Sherburne. The plan further states that thc District will assist busiaesses to stay
in the rea and will work to attract new businesses.

Henry F. D' Long, 599 Sherburne Avenue, stated that if Skipper's meets all the
staff's re ommendations he would like to see the Zoning Committee grant the
rezoning. �
Lenora S. leuphr, 603 Sherburne Avenue, stated she lives across the street
from the t o homes showed in the slides. She stated that former tenants in
the homesi ere undesirable. She also stated that if Skipper's meets all the
staff's r� ommendations she would like to see the Zoning Committee yrant the
rezoning � pecially because there would be no liquor sold.
W. Ross Y�schek, 8810 Jesamine, Eden Prairie, Real Estate Agent, stated that
sometimes ;Skipper restaurants do apply for liquor licenses.
James Mat �ison, 450 N. Syndicate, Suite 5, realtor, stated that the property
has been acant for some time. Skipper's will buy the property if the
rezoning oes through and are willing to put a great deal of money into it to
improve a d enhance the property.

the meeti g.
The Commi � tee discussed the site plan, fence, and the parking issues.
