THE COUNCIL F THE CITY OF SAINT PAUL DOES ORDAIN: �
Section 1.
That the zoning map of the City of Saint Paul, Sheet No. 18 as
� incorporated by reference in Section 60.301 of the Saint Paul Legislative
Code, as ame ded, is hereby further amended as follows:
That property located at 1536 Dayton being more
! particularly described as Lot 5, Block E and D,
Boulevard Addition to the City of St. Paul be and is
hereby rezoned from RM-2 to B-2; and;
� That property located at 1555, 1559 and 1563 Dayton,
more particularly described as W. 15 feet of Lot 19
and all of Lot 18; E. 1/2 of Lot 12 and 16, and all
of Lot 17; and W. 1/2 of Lots 12 and 16 and all of
Lots 11 and 15, Bushnell 's Re. of Blk 3, Boulevard
Addition to the City of St. Paul be and is hereby
rezoned from RM-2 to P-1.

of Saint Paul and the zoning maps thereof.
�j WHEREAS Pursuant to Minnesota Statutes, §462.357 and §64.210 of the
t,^ Legislative� Code, Liberty Bancshares, Inc. and Snelling Avenue Property
4'3 Partnership' duly petitioned to rezone 1536 Dayton, located on the south side of
� Dayton betw en Snelling and Saratoga, from RM-2 to B-2 and 1555, 1559 and 1563
�,,� Dayton, loc ted on the north side of Dayton between Snelling and Saratoga from RM-
� 2 to P-1 fo the purpose of constructing of a surface parking lot; the petition
having been certified by the Planning Division on May 9, 1986 as having been
consented t by at least two-thirds of the owners of the area of the property to
be rezoned,' and further having been consented to by at least 67% of the owners of
the propert situated within 100 feet of the total contiguous property within one
year preced ng the date of the petition; and
WHEREASI The Zoning Committee on June 5, 1986 conducted a public hearing for �
the purpose� of considering the rezoning petition, and pursuant to Section 107.03
of the Admi istrative Code, submitted its recommendation to the Planning
Commission hat the petition be granted; and
WHEREAS� The Planning Commission considered the rezoning petition at its
� meetin�'i��t on June 13, 1�986 and recommended that ttre��-ity Council approve the -- -�

6JHEREAS Notice of a public hearin� before the City Council on the said
rezoning pe ition was duly published in the official newspaper of the City on June
28, 1986 an notices were duly mailed to each owner of affected property and

WHEREAS, Lib rty Bancshares and Snelling Avenue Property Partnership, file #9917, has peti-
tioned to rezone 1536 Dayton, situated on the south side of Dayton between Snelling and Saratoga;
and I555, 1559 d 1563 Dayton, situated on the north side of Dayton between Snelling and
Saratoga, from M-2 to B-2 for thc purpose of allowing construction of a parking lot and future
bank drive-up; d
WHEREAS, the I oning Committee of the Planning Conynission on June S, 1986, held a public
hearing at whic all persons present were givea an opportunity to be heard pursuant to said ap-
plication in ace� dance with the requirements of Section 64.400 of the Saint Paul Legislative
Code; and
WHEREAS, Sain Paul Planning Commission, based on the cvidence presentcd to its Zoning Com-
mittee at the pu lic hearing as subsequently reflected in the minutes, made the following findings
of fact:
1. The ap icants intend to rezone four parcels to provide off-street parking, one on the
south si e of Dayton and thrce on the north side of Dayton. The thrce residcnccs on the
north si e would be removed and a 44 space surface parking lot constructed. At some in-
determi ate future date, a bank drive-up may be constructed on this parcel.
The resi ence and garage on the south side will be maintained and three additional park- .
ing spac s constructed on the rear of the lot.

2. Off-stre t parking for commercial uses may be provided (a) on the same zoning lot, (b) in
a P-1 di trict or (c) within the same district as the principal use and within 300 feet of
the buil ing it is intended to serve.
3. The B-2idistrict would permit retail businesses, theaters, business schools, mail order
houses, ealth clubs, as well as B-1 uses including banks. The proposed drive-up would be
a permi ed accessory use.
4. The Deq mber 1985, Selby-Snelling 'Task Force Report rccommends that area businesses
work to I evelop more off-street parking and that all new parkiag lots be adequately buf-
fered fr m neighboring residential use. It further states that to mect 75 perccnt of the
peak de and for off-street parking would require 98 additional parking spaces. The
propose development would satisfy about half of that demand.
5. Rezonin� the one lot on the south side of Dayton would be a logical extension of the B-2
district o the west. The current proposal is to retain the residential structure for rental
or offic usc.

Ms. Datsko howed slides of the site and reviewed the staff report with a
recommendat on for approval with modification. One letter was received in
opposition.�
Harold Pete son, Liberty Bank security officer and building manager, stated
that the ar a needs additional parkiny. Snelling Avenue is B-3 and there is
spot zoning'Iin the area now.
Mr. Pangal sked the applicant if he was in agreement with the staff's
recorrmiendat on. He answered yes.
George Jurglnson, 1530 Ashland, stated that the matter has been brought before
the Distric Council , and several other councils in the area and that they
have agreed to the rezoning. He stated that this would be a benefit for the
neighborhoo . '
The Comnitt e asked the applicant if 0'Gara's would be able to use the parking
lot. He an wered yes, all businesses would be able to use the lot.
Ms. Zieman sked the applicant why they wanted a B-2 zoning. The applicant
stated that , possibly in the future it could benefit them. _
A1 Levine, t�orney representing Madonna Quaal of 1565 Oayton Avenue, stated
that Ms. Qu 'al has lived in the area all her life and would like to stay
without hav�ng rowdy drunks in the parking lot disturbing her. Mr. Levine
stated that '�the individual who went around getting signatures, did not tell
Ms. Quaal t e absolute truth of the applicant's intentions of the land and
that Ms. Qu al strongly opposes the rezoning.
Kristin Kra er, 1539 Dayton Avenue, stated that she sent a letter to the
Zoning Comm ttee. She stated that besides the two undesirable houses on
Dayton, the rest of the neighborhood is very neat. She stated that there is
congestion n Dayton from the bank customers and people bypassing the
Selby/Snell� y stop light. One and one-half years ago U'Gara's expanded and
since then arking problems have surfaced. Because of this, some neighbors
wanted to m� e out of the neighborhood but could not sell their homes. The
bank ended 4 owning 5 homes in the neighborhood, much to the surprise of the
residents stl' ll living there. The residents are concerned that their property

will be de alued. She didn't know she could withdraw her signature. She
stated tha the petitioner who got her to sign told her that it would be a
landscaped �parking lot, and told her many other things that he knew she would
agree with in order to get her signature. She regretted her decision that
evening. he is concerned with 0'Gara's customer's using the parking lot and
that they 4sually begin showing up at 9 p.m.
Ms. Datsko 'read the code requirements/impacts of a B-2 and P-1 zoning to Ms.
.Kramer. i
Ms. Tracy ked Ms. Kramer if the parking lot� closed at 10 p.m. and if Dayton
became a o -way, if she would agree to the rezoning. Ms. Kramer answered
yes. She so stated that she has not seen 1 squad car monitoring the parking
lot in thr months. At 1 a.m., almost every morning her family is awaken by
0'Gara's c tomers in the parking lot. When the permit parking started, it
really help� d.
Ms. Zieman '� sked Ms. Kramer if she d.id not want 0'Gara's customers Narking in
the lot and that wouldn't it be better to see the customers parking in a lot
rather than parking in another neighborhood.
Ms. Tracy a� ked Ms. Kramer if the Gordon School parking lot is available. Ms.
Kramer stat d that she didn't know.
Barb Broen,11541 Selby, stated that if the parking lot yoes through she hopes
the alley w� ll not be used for egress/ingress. The�e has been a problem with
drainage at the end of the alley because when the parking lot is plowed, they
push all th�' snow into the street. She asked if the parking lot would be
patrolled i the rezoning goes through.
Mr. Pangal tated that the site plan specifies that there must be drainage.
Regarding t e lot being patrolled, other agencies would have to handle these
issues as t e Zoning Committee cannot put conditions on this type of rezoning.
Mr. Pangal Isked Ms. Datsko to read the conditions of a P-1 parking lot.
Ms. Broen s ated that she assumes this rezoning would be approved , but that
she is conc rned about the drainage and patrolling of the parking lot.
William Far elow, 1533 Dayton, stated that he is concerned about his taxes if
the rezonin goes through.
Harold Pete son stated that 0'Gara' s has four private-employed individuals
patrolling he parking lot and that the Bank pays for security patrolmen to
patrol the arking lot also. Regarding the drainage, they will be hiring an
engineer to '� handle the plan and work through these problems. They will be
hiring a pl wing service to take care of the snow removal .
Hearing no urther testimony, Mr. Pangal closed the public portion of the
meeting.

Ms. Zieman s ated that she believes there should not be time limitations on
the usage ofithe parking lot.
Mr. Levy sta�ed that he is prepared to support the rezoning but is concerned
about the in ress/egress of the alley. Mr. Peterson stated that they will not
be using the alley.
Ms. Summers ecommended approval of rezoning one parcel on the south side of
Dayton to B- and rezoning three parcels on the north side to P-1 based on
findings 1 t rough 5 and the staff analysis. Ms. Zieman seconded the motion,

G. TA N L I : Two issues prodominate this rezoning: (1) thc area needs additional off-
street parki g to accommodate demand in the Selby-Snelling commercial node and, (2)
residential es are giving way to commercial uses on this part of Dayton. The question scems
to be how to�accommodate needed off-street parking while lessening its burden of impact on
remaining r sidences on Dayton. Staff believes that this can be accomplished by approving a
B-2 rezonin to 1536 Dayton, the south side, and a P-1 rezoning to the parcel on the north side.
The one par el to the south would retain its residential character as long as the structure was
maintained, ven if the use changed from residential to office. Three parking spots would be
provided in n area that is already essentially gravel. The removal of the three residences on
the north si , however, will drastically affect the character of the north side where only
residences n w prevail.

If a P-1 dist ict was approved, a front yard setback equal to those residential setbacks would
be required.' A visual scrcen (intensive landscaping;� would also be required at this line. This
landscaped ea would mitigate the negative visual impact on the remaining residences. Until
the bank ha definite plans to expand and construct a drive-up teller, this district will satisfy
current and uture needs and provide a certainty of use.

With either rl' zoning alternative, two parking spaces will be lost, because they require
maneuvering room in the entrance drive. The P-1 alternative may lose five additional spaces
to accommod te the front yard setback. These spaces may be picked up again if the plan is

Finally, the rthern parcel could reasonably meet the standards for a P-I district set forth in
60.723.
