' 86-242 approved March 5, 1986 did vacate certain public right of-way which is more particularly described in said resolution; a d, WHEREAS, the terms and conditions of said resolution incorporate the requireme t in Chapter 130 of the Saint Paul Legislative Code that the terms an cqnditions imposed therein be completed within 60 days; and, WHEREAS , 'the purpose of this vacation is to permit the construction fia residential apartment complex; and, WHEREAS the petitioner , Mr. Bradley Stark , is requesting an extention o the compliance date to September 30 , 1986 due to unforeseen de ays in the overall closing of this project, THEREFO , BE IT RESOLVED, that the compliance date of resolution C.F. 86-242 i hereby extended until September 30, 1986 and that the compensation u� for this vacation be assessed interest at the rate of 128 per annu from May 7 , 1986; and BE IT URTHER RESOLVED that in all other respects, Council resolution C F. 86-242 shall remain in full force and effect. Pursuant to telephone conversation with Lorraine from your office and a letter dictated by me on May 15, 1986, we currently have an agreement to extend the deadline for payment of compensation in this matter till July 5, 1986. Due to circu stances beyond his control, Mr. Stark is having difficulty s heduling closing for the other aspects of this development roject. He would prefer to pay compensation regarding th vacated portion of Bradley Street contemporaneous with closing on the other parts of the development. I attempted to contact L rraine in your office on June 24, 1986, and was informed tha she is on vacation. Another person in your office referred me Dick McCann in finance. I spoke with Mr. McCann regarding ob aining an extension of time for Mr. Stark to pay the compensa ion, and he indicated that the best way to obtain an extension ould be to put an extension before the City Council. He 'ndicated that I should notify you by mail of Mr. Stark' s sire to extend the deadline for payment of Compensation, and that I should request in my letter that you forward it t finance so that Mr. McCann can cause the appropriate resolution t� be drafted and placed on the agenda. Please consider thi to be a letter written for that purpose. Mr. Stark an ' cipates that the closing on the overall project, which has be delayed, will occur in Spetember of 1986.
