Recitals Incorporated. The foregoing recitals aze incotparated herein. Section 2. St. Paul Approval. St. Paul shall approve the Prelimivary Layouts, including Alternate 4 for the Lexington Avenue Bridge. Secfion 3.1VIn/DOT Condifions. In return for St. Paul's approval, MnIDOT agrees: A. Auxilary lanes i. That it currently does not intend to convert the aiixiliary lanes included in Alternate 4 into full service through lanes nU �OT t0 January 1, 2011, without the prior approval of St. Pau1; and ii That it currently does not intend to aonvert the ausiliary lanes included in Alternate 4 into fuli service through lanes after 3anuary 1, 201 l, without a full public hearing that includes the collaboration of St. Paul; B.1484 federai court order That it remains committed to a 1984 federal court order formalizing an agreement between ivfi�lDOT and various community groups which prohibits more than four through-tr�c lanes on Interstate 35E between West Seventh Street and downtown Saint Paul, and that it has no future plans to add additional capacity to Interstate 35E from Highway 5 to downtown Saint Paul. C. Crosby Farm Regional Park i. That it will design the southbound entrance ramp onto the Lexington Avenue Bridge at Shepard Road in a manner that does not require obtaining additionai right- of-way fram Crosby Farm Regional Pazk; and ii. That the proposed use of Crosby Farm Regional Park for a construction staging area is subject to the provisions of Saint Paul City Charter Section 13A11, and that N1n1DOT will accordingly compensate St. Paul for the area's use; and iii. That it will minunize any pazk or pazk access disruption caused by the constnxcrion of a staging azea and seek prior approval of the plans for such an area from the directar of St. Paul's Division of Parks and Recreation. Furthermore, before presenting any such area plans for approval, Mn/DOT agrees: (1) That it will attempt to increase driver and pedestrian safety and consider providing a vehicle turn-around area to the access road far the park; (2) That it will m;nimize removal or disruption of park vegetation; (3) That it will minimize removal or disruption of any wetlands located within the park; and (5) That it wi11 not eliminate public access to the pazk for any period of time. �l9 , �`i o D. Trail Systems That it will provide access for cyclists and pedestrians from the e�sting traii along Shepazd Road to the proposed trail on the Lexington Avenue Bridge. Furthermore, Mn/DOT will implement measures, at both the southbound entrance ramp and the northbound e�t ramp of I-35E, to improve the safety of cyciists and pedestrians using the Shepazd Road trail. E. Framework Design Team That it will consult with St. Pau1's Framework Design Team at appropriate stages of the design process for the Le�ngton Avenue Bridge. Section 4. Entire Agreemen� The parties agree and understand that this entire agreement supersedes all oral agreements and negotiations between the parties relating to the subject matters hereof. Secrion 5. Term. This Memarandum of Understanding will be effective on Ju1y i, 1949, or upon such date as it is approved and executed by the authorized St. Paul and NIi�1DOT officials, whichever occurs later, and will remain in effect untii January 1, 2012, or until all obiigations set forth have been safisfactorily fulfilled, whichever occurs first. Section 6. Amendment. This agreement may be amended or terminated by mutual written agreement of the parties. Section 7. Authority. Auzilary lanes i. That it currently does not intend to convert the auYiliary lanes included in Alternate 4 into full service through lanes np_or to January 1, 2011, without the prior approval of St. Paul; and ii. That it curtently does not intend to convert the aiixiliary lanes included in Alternate 4 into full service through lanes after January 1, 2011, without a full public hearing that includes the oollaboration of St. Paul; B.1984 federal court order That it remains committed to a 1984 federal court order formalizing an agreement between Mv/DOT and various community groups which prohibits more than four through-traffic lanes on Interstate 35E between West Seventh Street and downtown Saint Paul, and that it has no future plans to add additional capacity to Interstate 35E from Highway 5 to downtown Saint Paul. C. Crosby Farm Regional Park i. That it will design the southbound entrance ramp onto the Lexington Avenue Bridge at Shepard Road in a manner that does not require obtaining addirional right- of-way from Crosby Fann Regional Park; and ii. That the proposed use of Crosby Fann Regional Park for a conshuction staging atea is subject to the provisions of Saint Pau1 City Charter Section 13.Q 1.1, and that Mn1DOT will accordingly compensate St. Paul for the azea's use; and iii. That it will minimize any pazk or park access disruption caused by the construcrion of a staa ng area and seek prior approval of the plans for such an area from the director of St. Paul's Division of Parks and Recreation. Purthermore, before presenting any such azea plans for approval, Mn/DOT agrees: (1) That it will attempt to increase driver and pedestrian safety and consider providing a vehicle turn-around azea to the access road for the park; (2) That it will minim;�e removal or disruprion of pazk vegetation; (3) That it will minimize removal or disruption of any wetlands located within the park; and (5) That it will not eliminate public access to the park for any period of time. aq-�r1 D. Trail Systems That it will provide access for cyclists and pedestrians from the e�sting trail along Shepard Road to the proposed trail on the Lexington Avenue Bridge. Furthermore, Mn/DOT will implement measures, at both the southbound entrance ramp and the northbound e�t ramp of I-35E, to improve the safety of cyciists and pedestrians using the Shepazd Road trail. E. Framework Design Team That it will consult with St. Paul's Framework Design Team at appropriate stages of the design process for the Lexington Avenue Bridge. Secfion 4. Entire Agreement. The parties agree and understand that this entire agreement supersedes all oral agreements and negotiations between the parties relafing to the subject matters hereof. Secfion 5. Term.
