Chairmanlj 1 ssman, referred to a copy of a letter from
Councilp I s n Kiki Sonnen, (dated May 27, 1986, addressed to Ed
Starr, �it Attorney) proposing some changes. Chairman Glassman,
requeste t t the Board review the proposed arnendments:
1 . Notil� e f all Board of Appeals and Review hearings shall be
sen ' t property owners within 100 ft. of the building under
revil' w. This notice shall be sent 30 days prior to the
publ!!ic hearing. Notice of the Board of Appeals and Review
hea iin shall also be sent to the affected District
Cou il (s) at least 30 days prior to the public hearing.
Ron Glaslla asked for some input on this. Steve Roy, from the
BuildingllI pection and Design Division stated that this would
create ai h e ring circus, not to mention the additional cost to
the city.ii resently, the Board notifies the neighbors on either
side and c ss the street, and directly behind the property.

Glenn GI' us ann stated this was discussed at the April 8th, 1986
meeting 'I o the Board of Appeals. At that time, the Board
recommelde that maybe a fee for owner occupied and one for owner
non-occ pi d be set. The Board concurs with this proposed
amendme .

seconde t e motion.
3 . Th equirement that a written staff report be included on
alj� i ems at least seven days before the appropriate meeting
of �l t e Board of Appeals and Review. Staff reports should
in llu e information on the hearing's purpose; the parcel
sij nd location in question; surrounding land use;
ho li , building, fire code affected by the building under
co � i ration; findings of fact; and the staff
re m ndation.
Steve � y, from the Building Inspection and Design Division
stated hi requirement was irrelevent and time-consuming. Ron
Glassma � s ted the reports that are sent from the inspectors are
suffici t; which are mailed out to the Board Members before the
meeting.l lenn Gausman rnade the motion to reject the proposal
( item #31 . Seconded by Harold Knutson. MOTION CARRIED UNANIMOUSLY.
4. Stalfi g for the Board of Appeals and Review shall be
pro id d through the Saint Paul Community Services
Dep rt ent and/or the Fire Department, depending on which
sec io of the Legislative Code is being appealed.
The Boarl w s unclear on this proposal . Steve Roy, from the Building
Inspecti n nd Design Division, assumed that if we were to notify
all per on within 100 feet, the department involved would
provide he staff for this. Motion was made by Harold Knutson to
reject te No.4. Seconded by Rosie Bostrom. MOTION CARRIED

App al and Review hearings.

appellan s and explained the procedures and goais of the board,
stating th t the board is here to do wnatever they can to help
the appe la ts solve their code problems. •

SUBJECTA pe lant requesting a waiver of the Vacant Building and
delinque t fees. This building had been sold and the previous
owners t ie to rehab the building, the cost was enormous so that
the Appe ' la t relcaimed the property. At present the Appellant
is in th p ocess of selling the property to Croix Properties and
they wil r hab the buitding.

PROCEEDI GS Appellant purchased this property ten years ago, the
property a condemned, appellant fixed up the property to nearly
completi n. Two years ago Appellant soid the property to two
young f ll ws who vacated the building and started renovation of
the buil in and then the new owners ran out of finances and the
new owne s ust walked away from the property. The city, unknown
to Mr. W ke ield boarded up the buildings This property reverted
back to r. Wakefield the end of January, 1986. Mr. Wakefield
thought e had this property sold, but that transaction fell
through. l resently, Mr. Wakefield has sold the property (940
Desoto) o Croix Properties. The new owners have paid the
delinque fees and have taken out a permit. New owners are
presentl r modeling the building.
Steve Ro ,, from the Building and Inspection Division stated the
fees onll 4 DeSoto have been paid. On 938 DeSoto the fees have
not been a�d and no attempt has been made to take out a permit.
The amo t of the fees on 938 DeSoto are in the amount of
$230. 00. t is will cover till July lst, 1986. July lst the fee
will be o her $50. 00.

SUBJECT I! A pellant is requesting a variance on stored firewood.
He feelsllth t the wood is stored properly in his yard area.
PROCEEDIIGS Mr. Kilby received a letter from the Health
Departrne t on April 7, 1986 stating the wood pile in the back
yard wa ot stacked properly. On April 15 or 16 the animal
shelter am out because, they were informed there was a racoon
in the w od pile. Someone from the animal shelter came out to set
a trap, ft r a discussion with Mrs. Kilby, who suggested no trap
be left. l N trap was set. On May 5th, the appellant received a
letter f om the Health Department to find out what has been done.
Dick Li pe t, from the Health Department stated that the
complain r ferred to rodents in the wood pile. Mr. Lippert sees
no probl m ith the wood pile as far as rodents are concerned.

permit a equirements regarding putting up the fence. The city
followed wi h final inspection, the inspector maintains the fence
is not i la ordance with the code.

PROCEEDI GS Tom Griebling gave the measurments to be; two windows
17x65, nd a bay window 50x41 on the first floor. Second floor
windows ea ure 17x61 ,two windows, and a bay window 49x38. Third
floor w nd ws measure 28x54. The second exit from the third
floor i a circular staircase that goes to the second floor and
then out iI fr nt.
Pat Fish f om the Fire Prevention Bureau suggested to the board
to grantla ariance to allow the window to be broken if need be.

Proceedi s Gale Smack came to the meeting with different bids
from Ete r cal Contractors. Mr. Smack has no more cash on hand
to have hi work done. If he is to do this work he will have to
raise th r nt for the tenants. Between 1980 and 1983 Appellant
spent $8 00 00 to replace the eaves , exterior painting, storm
windows, 'I s orm doors, also insulation, fencing and resurfacing
the par in lot and driveway. If the appellant is to borrow the
money h ill have to raise the rent to be able to make the
payments enants cannot afford to have the rent raised.
A Certif I a e of Occupancy was issued in 1974 and renewed twice
and no m t on of need for extra repairs.
Harold u son stated the requirement for electrical outlets is
to have ' t ree in the kitchen, two must be accessible. Ron
Glassmanl, s ated that no matter who does the work, it must done

Pat Fishl r the Fire Prevention Bureau, states the Housing Code
makes no 11 wance for room size only that it requires 3 outlets
