Minutes , o the May 13 , 1986 meeting were approved as submitted in writing Chairma G assman, referred to a copy of a letter from Council er on Kiki Sonnen, (dated May 27, 1986, addressed to Ed Starr, Ci y Attorney) proposing some changes. Chairman Glassman, request d hat the 8oard review the proposed amendments: 1 . No ic of all Board of Appeals and Review hearings shall be se t o property owners within 100 ft. of the building under re ie . This notice shall be sent 30 days prior to the pu li hearing. Notice of the Board of Appeals and Review he ri g shall also be sent to the affected District Co nc 1 (s) at least 30 days prior to the public hearing. Ron Gla sm n asked for some input on this. Steve Roy, from the Buildin nspection and Design Division stated that this would create t ree ring circus, not to rnention the additional cost to the cit . Presently, the Board notifies the neighbors on either side an a ross the street, and directly behind the property. Harold Kn tson made a motion that the Board of Appeals defeat this a nd ent Seconded by Rosie Bostrom. . MOTION AR IED UNANIMOUSLY. 1 ill , - lU-_��° ���� 2. Tle amount of the filin fee sh g all be established by a re olution of the City Council . Glenn au mann stated this was discussed at the April 8th, 1986 mestin f the Board of Appeals. At that time, the Board recomm nd d that maybe a fee for owner occupied and one for owner non-oc up ed be set. The Board concurs with this proposed amendm nt . Glenn IGa smann moved approval of this amendment. Harold Knutson second d he motion. 3. Tle requirement that a written staff report be included on a � l tems at least seven days before the appropriate meeting o he Board of Appeals and Review. Staff reports should i cl de information on the hearing's purpose; the parcel slze and location in question; surrounding land use; h us ng, building, fire code affected by the building under c ns deration; findings of fact; and the staff r co mendation. Steve IRo , from the Building Inspection and Design Division stated t is requirement was irrelevent and time-consuming. Ron Glassm n tated the reports that are sent from the inspectors are suffic en ; which are mailed out to the Board Members before the meetin . Glenn Gausman rnade the motion to reject the proposal ( item 3) Seconded by Harold Knutson. MOTION CARRIED UNANIMOUSLY. 4. 5 f ing for the Board of Appeals and Review shall be p v ded through the Saint Paul Community Services D a tment and/or the Fire Department, depending on which s t�on of the Legislative Code is being appealed. The Bo d was unclear on this proposal . Steve Roy, from the Building Inspec io and Design Division, assumed that if we were to notify all p _ s ns within 100 feet, the department involved would provid ' t e staff for this. PROPERTY APPEALED APPELLANT 24-86- 938-940 Desoto St. W. Wayne Wakefield SUBJEC Ap ellant requesting a waiver of the Vacant Building and delinq en fees. This buitding had been sold and the previous ownersl r ed to rehab the building, the cost was enormous so that the Ap el ant relcaimed the property. At present the Appellant is in he process of selling the property to Croix Properties and they w 11 rehab the building. APPEAR NC W. Wayne Wakefield PROCEE IN S Appellant purchased this property ten years ago, the proper y as condemned, appellant fixed up the property to nearly comple io . Two years ago Appellant sold the property to two young �fe lows who vacated the building and started renovation of the bulld ng and then the new owners ran out of finances and the new ow er just watked away from the property. The city, unknown to Mr. 'jWa efield boarded up the buildings This property reverted back t M . Wakefield the end of January, 1986. Mr. Wakefield though e had this property sold, but that transaction fell throug . Presently, Mr. Wakefield has sold the property (940 Oesoto ' o Croix Properties. The new owners have paid the delinq n fees and have taken out a permit. New owners are presen ly remodeling the building. Steve y from the Building and Inspection Division stated the fees n 40 De5oto have been paid. On 938 DeSoto the fees have not be aid and no attempt has been made to take out a permit. The a u t of the fees on 938 DeSoto are in the amount of $230.0 . this will cover till July lst, 1986. July lst the fee will b a other $50. 00. Kilby SUBJEC ppellant is requesting a variance on stored firewood. He feel, at the wocd is stored properly in his yard area. PROCEE I' N Mr. Ki ;by received a letter from the Health Depart n on April 7, 1986 stating the wood pile in the back yard s not stacked properly. On April 15 or 16 the animal shelter; ca e out beca��se, they were informed there was a racoon in the o pile. Som=one from the animal shelter came out to set a trap,!' a er a discussion with Mrs. Kilby, who suggested no trap be leftf o trap was set. On May 5th, the appellant received a letter ro the Healtn Department to find out what has been done. Dick L�' pp rt, from the Health Department stated that the complai ' t eferred to rodents in the wood pile. Mr. Lippert sees no problem with the wood pile as far as rodents are concerned. Pat Fisl, rom the Fire Prevention Bureau suggested to the board to gran a variance to allow the window to be broken if need be. Mr. Smack has no more cash on hand to have hi work done. If he is to do this work he wiil have to raise th r nt for the tenants. Between 1980 and 1983 Appellant spent �8 00 00 to replace the eaves , exterior painting, storm windows, ! s orm doors, also insulation, fencing and resurfacing the par in lot and driveway. If the appeliant is to borrow the money h ill have to raise the rent to be able to make the payments enants cannot afford to have the rent raised. A Certiflca e of Occupancy was issued in 1974 and renewed twice and no m nt on of need for extra repairs. Harold �Inu son stated the requirement for electrical outlets is to have�i t ree in the kitchen, two must be accessible.
