2 . That the assessment is arbitrary, capricious,
d sc iminatory, inequitable and excessive.
3 . That the assessment was not made in conformance
w � h the requirements of Sections 429. 051 and 429.061 of the
M'� n ota Statutes Annotated.
. That the assessment is in violation of the
r � ui ements of Article X, Section 1 of the 1974
Re tr ctured Constitution of the State of Minnesota.
. That the assessment is otherwise grossly excessive
an c ntrary to law.
HEREFORE, Burlington Northern Railroad Company
re ue ts that the Court set aside the assessment of
Bulli gton Northern' s property, order the refund with
in r st of any payments made by Burlington Northern
pu � u t to such invalid assessment, grant its costs,
di u ements and attorneys ' fees herein and grant such
ot r elief as it shall deem just and equitable.
