WHEREAS, Pu �uant to Minnesota Statutes, . 462.357 and . 64.210 of the
Legislative od �, Gene Franck and Eugene Linson duly petitioned to rezone 1286
Hudson Road oc jted on the south side between Johnson Parkway and English
from OS-1 t IB- ifor the purpose of permitting the estab]ishment of an electrical
contractor' sh p; the petition having been certified by the Planning Division on
April 2, 19 a � having been consented to by at least two-thirds of the owners of
the area of hejproperty to be rezoned, and further having been consented to by at
least 67% o th owners of the property situated within 100 feet of the total
contiguous opirty within one year preceding the date of the petition; and
WHEREAS Th � Zoning Comnittee on May 1, 1986 conducted a public hearing
for the pur se of considering the rezoning petition, and pursuant to Section
107.03 of t A ministrative Code, submitted its recomnendation to the Planning
Cor�nission at !the petition be granted; and

WHEREAS Th � Planning Comnission considered the rezoning petition at its
meeting hel oniMay 9, 1986 and recommended that the City Council approve the

this rezon ' g. The petitioner's representative testified. At the close of the public hearing,
the Comm tee voted 4 to 0 to approve the rezoning based on the hardship caused by the
property's loca ion which precludes viable office space usage and causes a general lack of
access.
On May 9 II�'198 , the Planning Commission upheld the Zoning Committee's recommendation
on a unan !mo s voice vote.
This rezo ing s scheduled to be heard by the City Council on May 29, 1986. Please notify

WHEREAS j�Ge �e Franck and Eugene Linson, file #9894, have petitioned to rezone 1286 Hudson
Road situa d o south side of Hudson Road between Point Douglas and English from OS-1 to B-2
for the pur ose �f making lease space available for a small electrical contractor; and
WHEREAS i�the '�Zoning Committee of the Planning Commission on May 1, 1986 held a public hear-
ing at whi al �persons present were given an opportunity to be heard pursuant to said applica-
tion in acc �da ce with the requirements of Section 64.400 of the Saint Paul Legislative Code; and
WHEREA ISai t Paul Planning Commission, based on the evidence presented to its Zoning Com-
mittee at t t p Iblic hearing as subsequently reflected in the minutes, made the following findings
of fact: I'
1. T II a �licant's parcel is one lot, enclosed on two sides by the OS-1 district. The
a lic nt's sale of their parcel is contingent upon rezoning from OS-1 to B-2. The pre-
vi s t asee used this space as offices for a tire company.
2. It s t g intent of the B-2 district to serve the needs of a consumer population larger than
th t se ved by the "local business district" and it is generally characterized by a cluster of
es �bli hments generating large volumes of vehicular traffic.
3. U s p rmitted in a B-2 zone include retail businesses, service establishments--including .
t t o I an electrical contractor, private clubs, restaurants, business schools, physical cul-
t 'e a d health clubs and food catering establishments.
4. T le p � perty does have a hardship because of its location and general lack of access
w ich ,�precludes viable office space usage.
NOW, TH RE ORE, BE IT RESOLVED, by the Saint Paul Planning Commission that the petition
of Gene F �nc and Eugene Linson to rezone property at 1286 Hudson Road more particularly
described s L t 4 and S, Blk 33, Suburban Hill Addn. from an OS-1 zoning classification to B-2
zoning cl ifi ation is consistent with the Comprehensive Plan for the City; and

The applicant as present. There was no opposition present at the hearing.
Ms. Datsko sh �e �slides of the site and reviewed the staff report with a recommendation for
deniai. Ms. D }Sk �stated that if a B-2 zoning classification is allowed, large advertising signs
would be allo ed n this property.
David Brooks i�62 South Shore Blvd., White Bear Lake, stated that he is a small contractor and
has a chance bu this vacant building. He said the building will be used for an electrical
contractor. H sai that he doesn't think very much traffic would be generated by this use. He
said the prese �t z hing classification would probably create more traffic than his proposed use.
He said the p pe ky' is currently very run-down.
Hearing no f Iptthe� testimony, Mr. Pangal closed the public hearing portion of the meeting.
Mr. Pangal st I�ed hat he lives near this property. He said that at one time there was an entrance
and exit to th � pr perty off of Hwy. 12 but now there is no entrance or exit off the freeway. He
said this prop rty �has been vacant a couple of years, that people can't find this building, and that
businesses th ha e located here tend to go broke. He stated he felt this property would be ap-
propriate for n e ectrical contractor and that this would not interfere with the residential
character of e �ighborhood.
Mr. Lanegran��sk d about advertising signs that would be allowed in a B-2 zone.
Mr. Pangal st Ited �t was not likely that an electrical contractor would want to erect a large adver-
tising sign, b ,� th t if he were offered enough money, the applicant may want one.
Ms. Zieman s �gge ted that the committee ask Mr. Brooks about an advertising sign.
Mr. Pangal st ted Ithat a billboard could be erected, but that you don't get that much money for
having one o I th $e on your property.
Mr. Brooks s Ited Ithat as a good businessman, if he were offered enough money, he would prob-
ably conside iere ting an advertising sign.
Mr. Lanegra Ilsta led that he felt this property was a hardship case.
Mr. McGuire I�sk I if owners of property adjacent to the freeway were compensated when the
freeway was �ut n and access to the highway was closed off.
Mr. Pangal s tedlthat no compensation was made.

5. The it s comprehensive plan states that the city will review its present commercial
zon' g t ensure that each zoning classification reflects uses appropriate to the intended
app cat n of that district. The OS-1 district is intended to accommodate various types
of o fic uses performing administrative, professional and personal services and "to serve
as a :a �itional use between the more intensive uses oi' [ancl such as...commercial districts,
and he ess intensive uses of land such as one-family residential." It is clear that the in-
tent �n the OS-I zoning district in this location was to accommodate less intensive uses
suc as usiness or professional offices.
G. TA F N `LY I : Amendments to zoning ordinances are not meant to be easily obtained.
The rati nal for such changes can be disaggregated into three considerations: (1) a mistake in
the orig al oning, (2) the eharacter of the neighborhood has changed to such an extent as to
justify zo �ng, and (3) a public need exists for the rezoning. Staff does not find that the
applica s h ve met any of the above criteria.
