4VHEREAS , i�iinnesota Statutes §349. 17 , Subd. 2, provides
that a person may not lease his property to organizations for
more than four bingo occasions in any week provided, however,
-chat the State Charitable Gambling Control Board may waive
this restriction upon a finding by the Board that the waiver
is consistent with the purposes of Section 349 . 11 to Section
349.222, and that the following procedures are followed:
(1 ) The person applies for a waiver and states the number
of additional weekly bingo games desired; and
(2) The Board notifies the governing body of the City
in which the premises are located; and
( 3) The City Council fails to adopt a resolution disapproving
the waiver within 30 days of the notification; and
WHEREAS , Joseph Perkovich, owner of the Ideal Hall , 1494
North Dale Street, Saint Paul , Minnesota, has made application
to the Minnesota Charitable Gambling Control Board for permission
to lease his hall for more than four bingo occasions per week;
and
WHEREAS , the Saint Paul City Council has received notice
of Mr. Perkovich' s request for this waiver from the State Chari-
table Gambling Control Board so as to permit him to lease his
premises for seven bingo occasions per week; and
WHEREAS , the Council has notified Mr. Perkovich that it
would conduct a hearing on his application for a waiver to
be held on Wednesday, June 4, 1986 , and further notified Mr.
Perkovich �hat the City Council was considering taking action
to disapprove the waiver on the grounds that the City Council ,
in March of 1986 , approved Mr. Perkovich' s application to the

State Charitable Gambling Control Board for a waiver to allow
six weekly bingo occasions at his hall , provided that the City
Council would not approve more than six weekly bingo occasions
at this location; for the reason that the Ideal Hall is located
in what is primarily a residential neighborhood and that more
than six weekly bingo occasions at this hall would not be consis-
tent with the adjacent residential uses of the property; and
that the existing traffic and parking problems would be aggravated
by the addition of more bingo occasions at this location; and
WHEREAS, Mr. Perkovich has failed to present substantial
evidence and testimony to convince the Saint Paul City Council
that justification exists for the State Charitable Gambling
Control Board to grant his application for a waiver of the
standard regulations of Minnesota Statutes ; now, therefore ,
be it
RESOLVED , that the Council of the City of Saint Paul does
hereby notify the Minnesota State Charitable Gambling Control
Board that the application of Joseph Perkovich for a waiver
of the restriction contained in Minnesota Statutes, §349. 17 ,
Subd. 2, so as to permit him to lease his premises for seven
weekly bingo locations , be and is hereby disapproved and the
Board is hereby urged to deny the waiver request based upon
the disapproval contained herein and further, upon a finding
by the Board that the proposed waiver is not consistent with
the purposes set forth in Sections 349. 11 through 349.22.
